Were you hurt in a crash with an Amazon delivery van or semi-truck in Aventura? You may have a claim. Florida sets time limits that start early.

This guide explains who may be responsible. It describes common injuries. It also explains what families should do next.

Anyone who has merged near Aventura Mall at rush hour knows how crowded these roads get. They also know how much room a big truck needs.

Amazon Delivery Truck Crashes on Aventura’s Roads

Amazon delivery vans and semi-trucks share the lanes of Biscayne Boulevard, I-95, NE 191st Street, and Ives Dairy Road. They share these roads with passenger cars, cyclists, and pedestrians.

When a large truck slows, swerves, or jackknifes, the people around it may have only seconds to react. Heavy weekday traffic leaves little room for error.

This page covers car, truck, cyclist, and pedestrian crashes in the Aventura area. It covers everyday collisions. It also covers catastrophic and fatal crashes. Each one can change a family’s life. Each one deserves careful attention.

Why Amazon Truck Crashes Involve More Than One Company

Many Amazon deliveries are run by contracted delivery companies. A single crash can involve more than one business. The truck may be owned, leased, or driven by a company other than Amazon.

Several parties may be part of a claim. These can include:

  • The driver’s employer
  • The vehicle’s owner
  • The company that maintained the truck
  • The company that loaded or dispatched it

Federal law lets regulators require a motor carrier to control and be responsible for vehicles it does not own. The carrier must operate them as if it owned them. 49 U.S.C. § 14102 That same law directs the Secretary to require, by regulation, that any arrangement with another party for vehicles the carrier does not own specify in writing who is responsible for loading and unloading the property.

Courts decide these questions based on evidence of what happened. They do not decide based on the name painted on the truck.

Can You Sue Amazon After a Delivery Truck Crash?

Sometimes a claim against Amazon is possible. Whether one exists depends on the facts of the crash. Two things matter most: the driver’s relationship to Amazon, and how the delivery was arranged.

Florida uses comparative fault, also called shared fault. Under Fla. Stat. § 768.81, in a negligence action, a court enters judgment against each liable party. In a negligence action, a court enters judgment against each party liable on the basis of its own percentage of fault.

The statute does not use joint and several liability. Fla. Stat. § 768.81 reads: “(4) APPLICABILITY.—This section does not apply to any action brought by any person to recover actual economic damages resulting from pollution, to any action based upon an intentional tort, or to any cause of action as to which application of the doctrine of joint and several liability is specifically provided by chapter 403, chapter 498, chapter 517, chapter 542, or chapter 895.”

Fault is decided on evidence. Photos, truck data, and witness accounts often help show who did what. Don’t assume the answer before the facts are in. A careful review of the crash is how you learn which parties may be responsible.

Injuries Common in Heavy-Truck and Delivery Van Crashes

Crashes with a much larger vehicle can cause serious injuries. These include:

  • Spinal cord, back, or neck injuries
  • Traumatic brain injuries
  • Broken bones
  • Amputation
  • Severe burns
  • Internal injuries

Some of these injuries are catastrophic and permanent. Spinal cord injury and paralysis can change daily life for good. This includes paraplegia (paralysis of the legs and lower body) and quadriplegia (paralysis of the arms, legs, and body). Limb loss can do the same.

Other injuries need a long recovery. Some symptoms may not show up right away. Headaches, dizziness, numbness, and memory problems can appear days after a crash. If you notice any of these, tell your doctor.

Follow your doctors’ care and treatment plans. This section gives general information. It is not medical advice.

Keep copies of every bill, prescription, and appointment note. These records can matter later if a claim is reviewed.

When an Amazon Truck Crash Is Fatal: Wrongful Death and the Family Left Behind

When a crash takes a life, the family’s grief comes first. Florida’s Wrongful Death Act allows certain family members to bring a claim for that loss.

The claim is brought by the personal representative. This is the person legally appointed to act for the person who died. That person brings the claim for the survivors and the estate. A wrongful death claim in Florida is brought by the decedent’s personal representative, who recovers for the benefit of the decedent’s survivors and estate.

Florida law also lists what survivors may recover. Florida law allows a family to recover certain types of damages in a wrongful death case. Here are some examples:

  • A surviving spouse may recover for loss of companionship and protection. A spouse may also recover for mental pain and suffering.
  • Minor children may recover for lost parental companionship, instruction, and guidance.
  • Each parent of a deceased minor child may recover for mental pain and suffering.
  • A survivor who paid medical or funeral bills may recover those costs.

Families often face many tasks at once. Keep receipts for funeral and medical costs. Ask for the crash report. Speak with a lawyer before giving a recorded statement to an insurance company. Let a trusted person help with calls and paperwork while you grieve.

Florida Deadlines and Evidence to Protect After a Crash

Florida generally gives two years to file a lawsuit based on negligence (Fla. Stat. § 95.11(5)(a)). Florida law sets time limits for filing lawsuits, so it is important to contact the firm promptly.

Other time limits can apply. They can differ by party and by claim. Waiting can make a claim harder to prove. Act promptly.

Crash reports matter. Under Fla. Stat. § 316.066, when a crash results in death, personal injury, or a complaint of pain, the investigating officer must forward the completed written crash report within 10 days after the investigation is complete. Fla. Stat. § 316.066 The parties, their legal representatives, and their insurers may get the report.

Evidence in truck crashes can disappear quickly. Useful items often include:

  • The police crash report
  • Photos of the vehicles, the road, and your injuries
  • Dashcam and GPS or other truck data
  • Names and phone numbers of witnesses
  • Medical records and bills
  • The truck’s maintenance and inspection history

Federal rules require employers to test drivers for alcohol and drugs after certain truck crashes. This includes crashes that cause a death. 49 C.F.R. § 382.303 Ask your lawyer early about these records. Avoid posting about the crash on social media.

Florida Truck Crash Data and Why Local Context Matters

Local records show what happens on the roads families use every day. Miami-Dade’s roads carry commuters, school traffic, and heavy commercial vehicles at the same time.

A crash report records the location, the vehicles, and the parties involved. These details can help show how a crash unfolded.

For Aventura residents, this matters. A crash on Biscayne Boulevard or I-95 may involve a delivery van and a family car within seconds. The crash report is one of the first written records of that moment. Requesting it early helps preserve what it shows.

Local context also shapes the evidence. Nearby witnesses and business cameras may hold useful details. But those records can be overwritten. Acting quickly protects what you may need later.
