Hit by an Amazon Delivery Truck in Coral Springs? What Happens Next

If an Amazon delivery truck hurt you or someone you love, the company whose name is on the truck may not be the only one to look at. Many Amazon deliveries are made by delivery companies that work under contract with Amazon. Each one can have its own drivers, trucks, and insurance.

Picture this. You’re driving on Sample Road during the afternoon rush hour. A large box truck drifts into your lane. You wake up in the hospital. A few days later, your phone starts ringing. An insurance adjuster wants a recorded statement. You still can’t stand up without pain.

Amazon truck accidents in Coral Springs can leave a family with fast-moving questions and little time to think. Dealing with an insurance company alone can feel like playing a Florida Panthers game with no teammates on the ice. You don’t have to sort it out by yourself.

In this guide, a “delivery truck accident” means a crash involving a large box truck, semi-trailer, or delivery van. The vehicle must be making deliveries for Amazon or one of its delivery partners.

Can You Sue Amazon If a Driver Hits You?

You may be able to make a claim against more than one party. Whether Amazon itself can be named depends on the facts.

A claim can look at:

  • The driver.
  • The company that employs or contracts the driver.
  • The company that owns or leases the truck. A lessor is the owner who rents out the vehicle.

Suing the driver is one path. Suing the companies behind the driver is another. Those companies may have hired, trained, dispatched, or controlled the driver’s work. The contracts and the ownership of the vehicle matter too.

Courts also look at who chose the carrier. A carrier is the company that moves the goods. Whether federal law affects a particular claim depends on the facts of each case, so the details should be reviewed by a lawyer.

Claims that a company knew or should have known about a problem are allegations. Each of these points depends on the facts of the case. This page does not establish them.

What Happens If an Amazon Delivery Driver Crashes?

After a crash, a police report, scene evidence, and insurance notices usually come first. Then the company starts its own investigation. Records start to matter.

Florida requires a Florida Traffic Crash Report, Long Form, for crashes that result in death, personal injury, or any indication of complaints of pain or discomfort, and for other crashes listed in the statute. The report must be completed and submitted to the department within 10 days after the investigating officer finishes the investigation. This rule comes from Florida Statutes § 316.066. The law also makes these reports available to the parties in the crash and to their legal representatives.

Commercial trucks also follow federal safety rules. For a for-hire carrier in interstate commerce, the rules apply to vehicles with a gross vehicle weight rating of 10,001 pounds or more. (Gross vehicle weight rating is the maximum total weight the manufacturer says the vehicle can safely carry.) For these carriers, the federal minimum public liability is $750,000 for nonhazardous property. This comes from 49 CFR § 387.9.

Several records often matter in a truck claim:

  • Vehicle maintenance records. Carriers must keep them for one year. They must also keep them for six months after the vehicle leaves their control. See 49 CFR § 396.3.
  • Driver qualification files. Carriers keep these while the driver works for them and for three years after. See 49 CFR § 391.51.
  • Duty-status logs. Drivers must record their work time for each 24-hour period. See 49 CFR § 395.8.
  • Post-accident testing records. Testing windows are short. The employer must document any test not given on time. See 49 CFR § 382.303.

Some records are kept only for set periods. That is why early action matters.

What to Do If an Amazon Truck Hits Your Car in Coral Springs

Get medical care right away, and report the crash. Then write down what happened. Do this before you agree to any long talks with insurers.

Start with a short checklist:

  • Call 911 if anyone is hurt. Move to a safe spot if you can.
  • See a doctor, even if your injuries seem minor. Some injuries show up days later.
  • Ask the responding agency for the report number.
  • Take photos of your vehicle, the scene from several angles, and the truck. Note the company name, the DOT number, and any trailer markings.
  • Keep a simple journal of your symptoms, treatment, medication, and missed work.

Amazon delivery drivers, their employers, and their insurers may contact you quickly. Anything you say in a recorded statement can be used later. It’s fine to ask for time before you give one.

Florida Rules That Shape Coral Springs Delivery Truck Claims

Florida’s general deadline for a negligence lawsuit is two years. This comes from Florida Statutes § 95.11. Other deadlines can apply, depending on the claim and the parties. Deadlines apply, so contact a lawyer promptly.

Florida also uses comparative fault. Comparative fault means fault is shared among everyone who contributed to a crash. Under Florida Statutes § 768.81, any party found greater than 50 percent at fault for their own harm may not recover any damages. In a products liability action alleging that injuries were enhanced by a defective product, fault is divided among all persons who contributed to the accident.

Florida’s required personal injury protection (PIP) coverage works differently. PIP is the no-fault coverage in your own auto policy. Under Florida Statutes § 627.736, a provider’s statement of charges for treatment or services generally may not include charges for services rendered more than 35 days before the postmark date or electronic transmission date of the statement, with an exception allowing charges for services rendered up to 75 days before the postmark date if the provider submits a notice of initiation of treatment within 21 days after its first examination or treatment of the claimant.

  • $10,000 in medical and disability benefits.
  • $5,000 in death benefits.

Under Florida Statutes § 627.736, a required personal injury protection policy provides medical benefits of eighty percent of all reasonable expenses for medically necessary services, when initial care is received within 14 days after the motor vehicle accident. This applies when initial care starts within 14 days of the crash. How your PIP and your own auto policy affect medical bills depends on the facts.

Who Can Be Held Responsible in a Delivery Truck Crash

Several parties may share responsibility. These can include:

  • The driver.
  • The delivery company.
  • The owner or lessor of the truck.
  • A maintenance contractor.

Records must identify the person who furnished a vehicle that the carrier does not own. That detail can point a claim toward the right party. See 49 CFR § 396.3.

Sometimes the cause is a trailer, brake, or tire problem. These causes often take an investigation to identify. A crash alone does not prove that any particular company caused it.

When an Amazon Truck Crash Causes Catastrophic Injury or Death

Some truck crashes cause life-changing injuries or death. Families then face long recovery, new daily needs, and hard decisions.

Catastrophic injuries can include:

  • Spinal cord injury with paralysis.
  • Traumatic brain injury.
  • Amputation.
  • Severe burns.
  • Serious back and neck injuries.

Many of these injuries need long-term care, equipment, and rehabilitation. The full picture can take months to understand.

When a loved one dies, Florida has a specific set of rules for family claims. These rules are known as the Florida Wrongful Death Act.

Families can take several steps now:

  • Keep every bill and letter.
  • Ask doctors for written summaries of care.
  • Log care costs and daily needs.
  • Talk with a lawyer before you speak at length with any insurer.
