If an Amazon Flex or delivery partner driver hit you or someone you love, you may have a claim. This is called an Amazon Flex driver accident claim. The claim can seek money from the driver. Depending on the facts, it may also seek money from the company behind the delivery.

This guide explains who may be responsible. It also covers which insurance may apply. It lists the Florida deadlines to watch.

What an Amazon Flex Driver Accident Claim Is

An Amazon Flex driver accident claim asks for money damages after a crash. The crash involves a driver making Amazon deliveries. “Damages” means money paid for losses the crash caused.

Some Flex drivers use their own vehicles. Others drive for a delivery service partner (DSP). A DSP is a separate company that runs delivery routes for Amazon.

Who was driving for whom can change who may be responsible.

Claims can come from drivers, passengers, pedestrians, cyclists, other motorists, and families of people who died. These cases can be harder than an ordinary car crash. More than one company and more than one insurance policy may be involved.

The harm can range widely. It can be a sprain that heals in weeks. It can be a spinal cord injury, a brain injury, an amputation, or a death. Every level of harm deserves the same careful attention.

Who Can Be Held Responsible After an Amazon Delivery Crash

More than one party may be responsible. The facts decide which ones.

Speeding, distracted driving, fatigue, and rushing a delivery window can all be negligence.

The delivery company may also answer for the crash.

These claims ask whether the company checked, trained, and monitored the driver.

Whether a driver is an employee or an independent contractor also matters. That question is examined on the facts of each claim.

In a 2026 case about a freight broker, Montgomery v. Caribe Transport II, the U.S. Supreme Court held that a negligent-hiring claim against a broker for choosing an unsafe carrier falls within a federal safety exception.

Insurance: Which Coverage May Apply

Several insurance policies may apply. The policy in force at the time of the crash matters most. Check these layers:

  • The driver’s personal auto policy, if a personal vehicle was used. Some personal policies exclude delivery work.
  • Coverage through Amazon or the DSP, such as commercial auto or occupational accident coverage. Its terms and limits control what is available.
  • Florida personal injury protection (PIP). Florida requires required motor vehicle security for registered vehicles. This is insurance that covers injuries.
  • PIP is “no-fault” coverage, a concept addressed in § 627.736, not in § 627.733, which only requires owners to maintain security.
  • This applies when initial care starts within 14 days of the crash (§ 627.736).
  • Uninsured or underinsured motorist coverage on your own policy. This may matter when the at-fault driver’s coverage is too low.

Insurers can dispute which policy applies. Under § 627.4137, an insurer must provide a sworn statement of its policy information. A sworn statement is a signed statement made under oath. The insurer must provide it within 30 days of a written request. Keep every letter and record.

What an Amazon Flex Driver Accident Claim Can Cover

A claim can seek money for the losses the crash caused. The value depends on the injuries and the facts.

  • Medical costs, past and future. These include emergency care, surgery, therapy, and equipment.
  • Lost income and lost ability to earn. This includes gig and self-employed workers.
  • Pain and suffering. Some insurance types limit these damages (§ 627.727).
  • Vehicle and property damage.
  • Long-term care after paralysis, amputation, or brain injury. This can include home changes and adaptive equipment, which are tools and devices that help with daily tasks.

When a crash causes a death, Florida’s Wrongful Death Act allows a claim for the family.

Under § 768.21:

  • A surviving spouse may recover for lost companionship and mental pain and suffering.
  • Each parent of a deceased minor child may recover for mental pain and suffering.

Each claim is different. No one can promise a specific amount.

How the Claim Process Works, Step by Step

The process usually starts with medical care and evidence. Then it moves to insurance claims. If needed, it moves to a lawsuit.

  1. Get medical care and follow your doctors’ plan. Your treatment record also documents the injury.
  2. Report the crash to police. Ask for the report number.
  3. Gather identifying details. Note the driver’s name, license plate, and insurance information. Also note any company name or DOT number. A DOT number is a federal number that some commercial companies use.
  4. Preserve evidence. Save photos, dashcam or phone video, witness names, and delivery records you can reach.
  5. Handle insurers carefully. Think before giving a recorded statement or accepting a quick offer.
  6. Investigate every party and policy. A delivery crash can involve several companies and insurers.
  7. Negotiate, then file suit if needed. If talks do not resolve the claim, a lawsuit may be filed in the proper Florida court.

Complex multi-party claims often take longer than standard car claims. The timeline depends on medical recovery and how insurers respond.

Reporting a Crash or a Reckless Amazon Delivery Driver

If a driver is dangerous right now, call 911. Give the location, direction of travel, and vehicle description. Writing details down early protects your claim.

  • Record the vehicle. Note the plate, make, color, and any company name, logo, or DOT number. Many Flex drivers use personal cars with no Amazon branding. So also record the time and route.
  • Get the crash report. Florida requires the investigating officer to submit a Florida Traffic Crash Report within 10 days after the investigation is completed for a crash that causes injury, death, or pain complaints, that involves a violation of s. 316.061(1) or s. 316.193, that renders a vehicle inoperable to a degree that required a wrecker to remove it from the scene of the crash, or that involves a commercial motor vehicle (§ 316.066). This applies when a crash causes injury, death, or pain complaints (§ 316.066).
  • Stay at the scene if someone died. Florida law requires a driver in a fatal crash to stop at the scene (§ 316.027).
  • Keep a written record. Use the contact details on the vehicle or in the app. Save every report you make.

Florida Deadlines and Rules That Matter Now

Florida generally gives two years to file a negligence lawsuit (Fla. Stat. § 95.11(5)(a)). Wrongful death is one of the actions listed with filing deadlines in Fla. Stat. § 95.11, so families should contact the firm promptly.

  • Two years for negligence. § 95.11 sets two years for an action founded on negligence and for an action for wrongful death. Under Fla. Stat. § 95.11(5)(b), which addresses professional malpractice claims other than medical malpractice, the period of limitations runs from the time the cause of action is discovered or should have been discovered with the exercise of due diligence.
  • The 50 percent rule. Under § 768.81, a person found greater than 50 percent at fault for their own harm may not recover damages. Partial fault does not automatically end a claim.
  • The 30-day PIP payment rule. Under § 627.736, personal injury protection benefits are overdue if not paid within 30 days after the insurer is furnished written notice of the fact of a covered loss and of the amount of same. However, payment is not overdue if the insurer has reasonable proof that it is not responsible for the payment.
  • Releases can be narrow. A “release” is a signed paper that ends a claim. A release given in good faith to one of two or more persons liable in tort does not discharge the others from liability unless its terms say so, but it reduces the claim against the others by the amount stipulated or paid for it, whichever is greater (§ 768.31). Read every paper before you sign.

Missing a deadline can end the right to sue. Contact our team promptly. Do not wait on insurers.
