Mesothelioma is a rare cancer. It is most often linked to asbestos. Families in Miami Beach and across Florida often ask the same questions. What caused this? Could an old job or home be the reason? What can we do now?
This page is for families searching for mesothelioma information in Miami Beach and clear next steps. It answers these questions in plain language.
What Is Mesothelioma, and Who Is This Page For?
Mesothelioma is a rare cancer. It forms in the thin membranes around the lungs, chest, or abdomen. The ATSDR mesothelioma health effects page describes it as an asbestos-related cancer.
When it starts in the lining of the lungs, doctors call it pleural mesothelioma. When it starts in the lining of the abdomen, it is called peritoneal mesothelioma.
This page is written for patients and their families. That includes a spouse, an adult child, a sibling, or another relative who wants to know if a claim may exist. It explains the options without pressure.
This page is not medical advice. Please follow the care plan your doctors recommend. Bring questions about the diagnosis to them. If a family member has died, the FAQ below covers the basics of wrongful death claims.

How Does Asbestos Exposure Lead to Mesothelioma?
Asbestos exposure raises the risk of mesothelioma. Workplace exposure is a recognized cause, according to OSHA asbestos hazards.
The illness is also slow to appear. ATSDR notes that signs may have a latency period of 30 to 40 years. A latency period is the time between exposure and the first signs of illness. Some cases show up sooner, as research on short-latency mesothelioma explains.
That long gap is why many families struggle to connect the illness to the past. Most people do not think of asbestos as an event. They remember a job, a ship, a building, or a renovation.
Common places of exposure include:
- Shipyards and maritime work
- Construction and renovation
- Power plants, refineries, and factories
- Military service
Family members can be exposed at home, too. This is called take-home exposure. It happens when fibers arrive on a worker’s clothing or belongings.
Who May Have a Claim, and What Does It Turn On?
A claim may be possible when a person’s asbestos exposure can be traced to a workplace, product, or property. The party responsible for that workplace, product, or property may be a target of the claim.
The claim depends on where and how the person was exposed. It also depends on how long the exposure lasted and which companies or products were involved.
Florida law has rules that matter here. Under Fla. Stat. § 774.206, for asbestos claims not barred as of the effective date of this act, the time limit does not start until the exposed person discovers, or through reasonable diligence should have discovered, that he or she is physically impaired by an asbestos-related condition. The law also covers when that person should have discovered it with reasonable diligence, meaning the care a reasonable person would take.
The same statute treats a nonmalignant asbestos condition (a condition that is not cancer) as a separate claim from asbestos-related cancer. Damages may not be awarded for fear or risk of cancer in that claim. Florida also does not allow punitive damages in asbestos claims, under Fla. Stat. § 774.207.
Filing deadlines still apply. Families should not wait to see what happens.
Writing down every job, ship, plant, and building you remember is a useful start. Fuzzy details are fine. This step helps families in Plantation, Davie, Miami Beach, and across South Florida.
Lawsuits and Asbestos Trust Funds: How Each Path Works
The right choice depends on the facts.
- Lawsuits. A lawsuit is filed in court against companies that may be responsible for the exposure. In Florida, in a lawsuit alleging an asbestos or silica claim, the plaintiff (the person bringing the case) must file a verified report when the complaint is filed. The report lists collateral source payments, which are the total amounts received, including payments the plaintiff will receive in the future, from other settlements or judgments on the same claim. The plaintiff must update the report during the case.
- Asbestos trust claims. Some companies went through bankruptcy and set up asbestos trusts. These trusts may pay claims separately from a lawsuit. Each trust has its own forms, evidence requirements, and timing.
Some families pursue both paths together. Others start with one. Trust claims can take time to process. It helps to review both paths early.
These matters may be referred to, or handled together with, another law firm. If that happens in your family’s case, we will explain the arrangement at the first call.
What a Free Case Evaluation Covers
A free case evaluation is a confidential first review. It looks at the patient’s exposure history, medical records, and possible claim paths. You can ask any question during it.
Our team’s review includes:
- Review of work, military, and home history to find possible asbestos exposure.
- Review of diagnosis records the family chooses to share, with the family’s permission.
- A look at possible defendants and whether an asbestos trust may apply.
- A summary of Florida filing deadlines that may apply, and why acting promptly matters.
- Plain-language answers about lawsuits, trust claims, and what comes next.
CHG Personal Injury Lawyers charges no attorney’s fees and no case costs unless there is a recovery.

Frequently Asked Questions
Can a family file a claim after a loved one dies from mesothelioma?
A family may have a wrongful death claim. Under Fla. Stat. § 768.20, the decedent’s personal representative (the person who manages the deceased person’s estate) brings the claim for the survivors and estate.
How long after exposure does mesothelioma appear?
Signs often appear 30 to 40 years after exposure, according to ATSDR. Some cases appear sooner.
What if I only remember a job site from decades ago?
Old job records, military paperwork, and coworker memories can help. The first consultation looks at what you do remember.
Do I have to choose between a lawsuit and a trust claim?
No. Some families pursue both. The first review helps sort out which paths fit.
Will another firm handle my case?
It may. These matters may be referred to, or handled together with, another law firm. We explain any arrangement at the start.

What Families Often Ask Us
Why does it take decades to appear?
Mesothelioma usually appears decades after asbestos exposure, which is why many families do not connect the illness to a past job, military service, or home environment until a diagnosis is made.
Where and how was the exposure?
A mesothelioma claim turns on where and how the person was exposed to asbestos. Our team looks at work history, locations, and the products or sites involved.
Can a family act after a loss?
When a loved one has died, families may have options, and we can explain how a claim is handled and who may bring it under Florida law.
Are there other ways to seek compensation?
Some asbestos bankruptcy trusts pay claims separately from a lawsuit. We can review whether a trust claim may apply alongside any lawsuit.
