If you are searching for mesothelioma information in Plantation, you may be asking one hard question. Where did the asbestos come from?

Mesothelioma is a rare cancer linked to asbestos. It can take decades to appear.

This page explains the illness. It also explains how exposure is traced. Then it covers what Florida families may be able to do next.

CHG Personal Injury Lawyers is a Florida personal injury firm. We serve families throughout Florida.

Who This Page Is For and What a Mesothelioma Claim Involves

A mesothelioma claim asks one main question. Did someone else’s conduct, a product, a workplace, or a property contribute to the person’s asbestos exposure?

This page is for adults with a mesothelioma diagnosis. It is also for the spouses, children, and relatives who help them.

Many readers are early in a frightening medical situation. They may not be ready to talk with a lawyer. That is okay.

Mesothelioma is a cancer of the thin lining that covers the lungs, abdomen, and other organs. Pleural mesothelioma affects the lining of the lungs. The ATSDR mesothelioma health effects page describes it as a rare, asbestos-related cancer.

A claim depends on where and how the person was exposed. The diagnosis alone does not decide it.

Our team reviews work history, home history, and medical records together. Each case turns on its own facts.

Families may also have a claim after a death. Florida law sets the rules for who may bring it.

If a mesothelioma diagnosis has your family asking where the asbestos came from, you don't have to sort it out alone, and our team offers a free, confidential consultation. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

What Causes Mesothelioma and Which Asbestos Is Linked to It

Mesothelioma is linked to asbestos. Asbestos is a group of mineral fibers that occur naturally.

People breathe or swallow these fibers. The fibers can lodge in the lining of the lungs or abdomen.

ATSDR asbestos exposure facts states that exposure to amphibole asbestos is linked to a higher risk of mesothelioma.

Which asbestos causes it? Medical sources point to amphibole asbestos. This type has a documented link to the disease.

An exposure history helps show which materials a person worked with or lived near.

The disease usually appears long after exposure. OSHA asbestos hazards states that workplace exposure raises the risk of mesothelioma. It also states that these diseases have a delayed onset.

ATSDR gives a latency period of 30 to 40 years for signs of the disease. Latency means the gap between exposure and the first signs of illness.

A PubMed Central short-latency article notes that shorter-latency cases also exist.

Because of this gap, a person may not connect the illness to a job or home from decades ago.

How Asbestos Exposure Happens: Trades, Take-Home Exposure, and More

Asbestos exposure often happens at work. Family members can be exposed too. The path depends on the job, the materials, and the years involved.

  • Brick masons and cement and brick workers. Their work involved mortar, cement, and building materials. Some of these may have contained asbestos.
  • Take-home exposure. Lawsuits in this area describe fibers carried home on a worker’s clothing, tools, or hair.
  • Military, shipyard, and household exposure. Some claims describe these paths. Records show whether each one is a documented history or an allegation.

Start building the history now. Gather these items:

  • A list of employers and job sites
  • The years worked and materials used
  • Military service dates
  • Every address where the person lived

Pay stubs, old union cards, and renovation records can help fill gaps.

Living With Mesothelioma: Medical Care Comes First

Daily life with mesothelioma depends on each person’s health, treatment, and stage. Decisions about care belong to the patient and their medical team.

Treatment may include surgery, chemotherapy, radiation, or other approaches. The medical team chooses these options with the patient.

Whether any procedure, including a lung transplant, is an option depends on the patient’s condition.

CHG does not give medical advice. Follow your doctors’ care. Bring questions about treatment, prognosis (the likely course of the illness), and daily life to them.

The legal and medical sides can run at the same time. A claim can help a family plan for costs while treatment continues.

Sources of Recovery: Lawsuits, Asbestos Bankruptcy Trusts, and Wrongful Death Claims

Families affected by mesothelioma sometimes look at more than one way to seek compensation, and a lawyer can explain which options may apply to their situation. The right path depends on the facts. Each path has its own rules.

Lawsuits. Lawsuits may name manufacturers, employers, property owners, or others. These lawsuits allege that the defendants’ conduct or products contributed to the exposure. These are claims made in lawsuits, not findings by a court. They are not established facts.

Bankruptcy trusts. Some asbestos makers went through bankruptcy. Some set up asbestos bankruptcy trusts. These trusts pay claims separately from a lawsuit, under their own rules.

Federal law, 11 U.S.C. § 524, governs the effect of a bankruptcy discharge. A discharge is the court order that ends certain debts. The law also addresses asbestos injury claims.

Wrongful death. When a loved one dies, the Florida Wrongful Death Act, § 768.16, applies.

  • The decedent’s personal representative (the person in charge of the estate) brings the action. They bring it for the survivors and the estate. See § 768.20.
  • Survivors and the estate recover all damages as specified in this act; a surviving spouse may recover for loss of the decedent’s companionship and protection (see § 768.21). A spouse may also recover for mental pain and suffering.
  • Minor children, and all children if there is no surviving spouse, may recover for lost parental companionship, instruction, and guidance. See § 768.21.

A mesothelioma matter may be referred to another law firm. It may also be handled together with one. CHG will tell you when either of these applies.

How Working With CHG Works, Step by Step

The process starts with a free, confidential first consultation. There is no obligation to continue. These steps show what usually follows.

  1. First consultation. The family describes the diagnosis, the work history, and the home history.
  2. Records. We help gather medical records, pathology reports (lab reports on tissue samples), employment and military records, and any trust or prior claim papers.
  3. Exposure review. We look at where and how exposure may have happened. We also look at which defendants or trusts may be involved. We explain what the review can and cannot yet show.
  4. Decision. With our guidance, the family decides whether to pursue a lawsuit, a trust claim, or both. Florida requires the plaintiff to file a verified written report with the court of collateral source payments (money received as a result of settlements or judgments based on the same claim, including payments the plaintiff will receive in the future) when an asbestos or silica claim is filed in a civil action, and to update the reports regularly until a final judgment is entered. See § 774.207(2).
  5. Updates. We keep the family informed. We explain timelines, which vary by case.

Timing matters. See § 95.11(5)(a).

For asbestos or silica claims not barred as of the effective date of the act, § 774.206(1) says the time limit does not start until the person discovers, or through reasonable diligence should have discovered, that they are physically impaired by an asbestos-related or silica-related condition.

These rules have limits. Early conversations help protect your options.

Questions Families Ask About Mesothelioma Claims in Florida

Most families ask about records, old exposure, deaths, trusts, and who handles the case. Short answers follow.

Does CHG help families with mesothelioma Plantation claims?

CHG serves families throughout Florida, including Plantation. A matter may be referred to another firm or handled together with one. The firm will say so when that applies.

Do we need a diagnosis from a specific doctor?

Medical records and pathology reports are the core records. Your medical team supplies them.

What if the exposure happened decades ago?

ATSDR gives a latency period of 30 to 40 years for signs of the disease. Old work and home records often matter for this reason.

Can a family sue after a loved one dies from mesothelioma?

Yes. Florida’s wrongful death law lets the decedent’s personal representative recover for the decedent’s estate, and lets each survivor recover damages such as lost support and services.

Is a bankruptcy trust claim the same as a lawsuit?

No. Trust claims follow their own rules. They are separate from a lawsuit.
