If a truck crash hurt you or someone you love, you may have a claim against more than the driver. Trucking companies, vehicle owners and others can share responsibility. This guide explains the basics in plain words, so you can decide your next step with a clear head.

If you have ever walked out to the Dania Beach Pier, you know how much traffic moves through this part of Broward County. Truck accidents Dania Beach families face often start on those same busy roads.

When a Truck Crash Happens on Dania Beach Roads

A truck crash on a Dania Beach road can leave you hurt, shaken and fielding calls from insurers before you know who is at fault.

Federal Highway (US-1), Stirling Road, Griffin Road and Interstate 95 all carry cars and commercial trucks side by side. Lane changes, turns at busy intersections and sudden stops can turn into serious collisions.

Many people feel lost after a crash. The paperwork is confusing, medical bills start arriving, and it’s hard to know whether you have any rights at all. You don’t need legal training to ask questions. A plain-language conversation can show you what your options look like.

Why a Truck Crash Is Different From a Car Crash

A truck crash usually causes more harm than a car crash, and it often leaves a longer trail of records.

A loaded commercial truck weighs far more than a passenger car. That weight changes how a crash unfolds. Injuries from truck crashes are often more severe, including spinal, head and crush injuries. Federal rules define the term “accident” for commercial motor vehicles as an occurrence involving a commercial motor vehicle operating on a highway in interstate or intrastate commerce that results in specified harms, including disabling damage that requires one or more motor vehicles to be transported away from the scene by a tow truck or other motor vehicle (49 CFR § 390.5T).

Federal trucking rules also require records. Drivers must record their duty status, and no driver or motor carrier may tamper with an electronic logging device so that it does not accurately record and retain required data (49 CFR § 395.8). Drivers must write reports on vehicle defects, and carriers must keep those reports for three months (49 CFR § 396.11). Maintenance records follow their own schedule (49 CFR § 396.3).

Waiting can mean losing records you need. A truck crash also often involves more than one driver or company. That usually means the investigation takes longer than a typical car accident.

Who May Be Responsible After a Dania Beach Truck Crash

Responsibility after a truck crash can reach beyond the driver, depending on what caused the crash. Several parties may have a role.

Possible responsible parties include:

  • The truck driver, if the driver was careless, overtired or impaired.
  • The trucking company that employed or dispatched the driver.
  • The owner of the truck, if it is not the carrier.
  • A maintenance contractor that repaired or inspected the truck.
  • A company that loaded the cargo in an unsafe way.
  • In some cases, a parts maker.

A claim depends on the facts. Logs, inspection reports and maintenance files often show who had a role. Those records may need to be reviewed before anyone can say who is responsible.

Federal law can also matter when a company selects a carrier.

The trucking company’s insurer may contact you early. Speaking with a lawyer before giving a recorded statement can help protect your position.

Steps to Take After a Crash in Dania Beach

Get medical care right away, then protect the records that show what happened.

Call 911 if anyone is hurt. See a doctor even if you feel okay after the crash. Follow your doctors’ care plan and keep every follow-up visit.

Next, gather what you can:

  • Photos of the scene, both vehicles and the truck’s markings or license plate.
  • Names and phone numbers of witnesses.
  • Medical bills, pay stubs and records of missed work.
  • Any messages with insurers.
  • Where the truck was and which direction it was headed.

Florida crash reports matter too. A Florida Traffic Crash Report, Long Form, must be submitted within 10 days after the investigation is complete for crashes involving death, injury or a commercial motor vehicle (Fla. Stat. § 316.066). The statute also says the parties involved in the crash, their legal representatives, their licensed insurance agents and their insurers may be given immediate access to the report, but not for redistribution to any person or entity the statute does not list. Ask which agency investigated the crash, since that agency holds the report.

Federal rules also set testing steps.

Florida Deadlines and Fault Rules to Know

Florida sets time limits for filing injury lawsuits, and it divides fault among everyone involved in a crash.

Florida’s limitations statute, Fla. Stat. § 95.11, sets deadlines for filing lawsuits. Deadlines apply to injury claims and to wrongful death claims. Missing one can stop a claim from moving forward.

Florida also uses comparative fault. In a negligence action, a court enters judgment against each liable party based on that party’s percentage of fault (Fla. Stat. § 768.81).

How these rules apply depends on the facts of your case. Because deadlines apply, contact a lawyer promptly.

When a Truck Crash Is Fatal: Support for Families

Florida’s Wrongful Death Act allows certain family members to bring a claim when a truck crash causes a death.

Losing someone in a truck crash brings grief, funeral arrangements and sudden money worries. A family can face all of that at once. You do not have to sort it out alone.

The Act is known as the Florida Wrongful Death Act (Fla. Stat. § 768.16). When a death is caused by someone’s wrongful act, negligence, default, or breach of contract or warranty, and the event would have entitled the injured person to maintain an action and recover damages if death had not ensued, that person or watercraft shall be liable for damages even though the person died (Fla. Stat. § 768.19).

Florida law lists what survivors may recover. These include lost support and services, and a surviving spouse may recover for lost companionship and mental pain and suffering. Minor children may recover for lost parental guidance, and each parent of a deceased minor child may recover for mental pain and suffering. A survivor who paid medical or funeral expenses may recover them (Fla. Stat. § 768.21).

First steps can help. Get the crash report, keep records of funeral bills and lost income, and write down what your family remembers. Then ask a lawyer about the time limits that apply.

Catastrophic Injuries From Truck Crashes

Truck crashes can cause life-changing injuries, including spinal cord injuries, paralysis, brain injuries, amputations and severe burns.

Recovery from these injuries can take a long time. These injuries can change work, daily tasks and family life. The cost of ongoing care may be part of a claim. Florida law also sets rules on how medical expenses are proven in court (Fla. Stat. § 768.0427).
