If a truck crash left you or someone you love with a spinal cord injury, you may have a claim. The people responsible may be held accountable.
This guide explains how a Jacksonville spinal cord injury car accident case usually works. It also explains which Florida deadlines apply. And it explains what your family can do next.
This guide is for injured people, spouses, parents, and adult children. It is not written for lawyers.
What a Spinal Cord Injury After a Truck Crash Means for Your Family
A spinal cord injury can change how a person moves, feels, and lives each day. It often changes a whole family’s routine at once.
Picture a loaded truck crash on a Jacksonville road. One moment, a parent is driving home. The next, they cannot feel or move parts of their body.
Their spouse and adult children suddenly handle hospital visits, rehab schedules, bills, and work.
The spinal cord is the bundle of nerves that carries signals between the brain and the body. When it is damaged, those signals can be interrupted.
- Paraplegia means loss of movement or feeling in the lower body, usually the legs.
- Quadriplegia, also called tetraplegia, affects the arms, legs, and torso.
- Paralysis is the broader term for loss of movement.
Many of these injuries are permanent. Families often need a clear plan for the years ahead. That plan should cover medical care, home changes, and income.

Why Truck Crashes Cause Serious Spinal Injuries
Trucks are heavy. A crash with one can send great force into a smaller vehicle and the people inside it.
Common truck crash patterns include:
- Rollovers. The truck tips onto its side or roof.
- Jackknifes. The trailer swings out at an angle to the cab.
- Underride crashes. A car slides under the trailer.
- High-impact collisions at highway speeds.
Federal rules from the Federal Motor Carrier Safety Administration govern trucking companies. Three rules often matter in these cases:
A claim may involve more than one responsible party. That can include the driver, the trucking company, a cargo loader, or a maintenance contractor.
Delivery trucks run for companies such as Amazon and FedEx. These trucks often involve contractors and carriers. An investigation looks closely at who hired, directed, and maintained the driver and the truck.
What a Spinal Cord Injury Claim Can Cover
A claim can seek compensation for medical costs, lost income, future care, and personal losses. These losses come with a life-changing injury.
No amount can be promised. Still, these categories form the core of most claims:
- Medical costs. Past and future bills, surgeries, hospital stays, rehab, and medications.
- Lost income. Lost wages and lost earning capacity if the injury limits work.
- Life-care needs. Home modifications, wheelchairs and adaptive equipment, in-home attendant care, and transportation to appointments.
- Personal losses. Pain, suffering, mental anguish, and loss of enjoyment of life.
In Florida motor-vehicle cases, pain and suffering damages are available only when the injury meets certain thresholds. These include significant and permanent loss of an important bodily function, and permanent injury. Medical records help show the nature and extent of a specific injury.
If a crash is fatal, Florida’s wrongful-death law makes the person who would have been liable in damages if death had not ensued liable for damages, when the event would have entitled the injured person to maintain an action and recover damages if death had not ensued.
Follow Your Doctors’ Care and Document Every Part of the Injury
Following your treating doctors’ plan is the first priority. Clear records also help show how the injury affects your daily life.
- Attend follow-up visits and complete rehab as your doctors direct.
- Keep discharge papers, imaging reports, therapy notes, and prescription records.
- Save receipts and mileage for medical appointments.
- Write a daily journal of symptoms and the tasks you can no longer do.
Insurers often point to gaps in treatment. Keep your appointments. Tell your lawyer about every provider you see.
In Florida car crashes, Personal Injury Protection (PIP) benefits pay up to $10,000 in medical and disability benefits. Initial care generally must begin within 14 days of the crash for PIP coverage.
Talk with a lawyer before giving a recorded statement to any insurer or the trucking company.
Florida Deadlines and Rules That Apply to Your Claim
For most Florida negligence claims that arose after March 24, 2023, the deadline to file a lawsuit is two years. (Florida Statutes section 95.11)
Wrongful-death and medical negligence claims have their own timing rules in the same statute.
Florida also uses a shared-fault rule. Under Fla. Stat. § 768.81, in a negligence action to which this section applies, a person found greater than 50 percent at fault for their own harm may not recover any damages. This rule does not apply to an action for personal injury or wrongful death arising out of medical negligence under chapter 766.
In a negligence action, the court enters judgment against each party on the basis of that party’s percentage of fault and not on the basis of the doctrine of joint and several liability. No party pays the whole amount.
Evidence can disappear. Federal rules let carriers keep maintenance records for 1 year. They must keep them for 6 months after a vehicle leaves their control. (49 C.F.R. § 396.3)
Acting early helps protect logs, dash-camera video, and inspection files.
The facts of your case decide which rules apply. Do not wait to find out where your deadline falls.
How a Spinal Injury Claim Typically Moves Forward
Most claims move through five stages:
- Free, confidential consultation. We review the crash, your injuries, and your medical plan. You have no obligation to continue.
- Investigation. We review police reports, trucking logs, driver qualification and maintenance files, electronic data, and witness statements.
- Medical documentation and life-care planning. Medical professionals and other witnesses help estimate future care needs.
- Demand and negotiation. We present the claim to the insurers for the trucking company and any other responsible parties.
- Lawsuit, if needed. Filing protects your deadlines. The case may then move into discovery (exchanging evidence) and mediation (a settlement meeting led by a neutral mediator). It may also go to trial.
Timelines vary. Catastrophic claims often take longer. Medical conditions must settle before the full picture is clear. No specific timeline can be promised.

Common Questions About Jacksonville Truck Crash Spinal Cord Claims
Most families ask about first offers, shared fault, and who else can make a claim.
Do I need a lawyer if the insurer already made an offer?
A first offer may not account for future medical needs or lost earning capacity. A consultation can review the offer before you decide.
What if I was partly at fault?
Florida bars recovery only when a person is found more than 50 percent at fault for his or her own harm in a negligence action, and this bar does not apply to personal injury or wrongful death claims arising out of medical negligence under chapter 766. A consultation can explain how this rule applies to your facts.
Can I still make a claim if I wasn’t in the truck?
Passengers, other drivers, and pedestrians may also have claims. Each situation is different.
What if the truck belonged to a company based outside Florida?
The claim may involve more than one jurisdiction. Our team can review where a case may be filed.
What if I can’t afford to talk to a lawyer?
The first consultation is free, confidential, and carries no obligation to continue.
