If you are a Florida veteran with mesothelioma, or you are helping one, you may have two separate paths to explore.

The first path is VA disability compensation. This is money for conditions tied to military service.

The second path is a legal claim. It may be against companies or against an asbestos bankruptcy trust. A trust is a fund set up to pay people harmed by a company’s asbestos products.

Each path has its own rules and timing. This guide explains how they differ. It also covers which records help. It covers what families should think about next.

What Mesothelioma Is and How Asbestos Leads to It

Mesothelioma is a rare cancer. It forms in the thin lining around the lungs, chest, or abdomen (belly). Asbestos exposure is the known cause.

ATSDR describes it as a rare asbestos-related cancer. It says signs may take 30 to 40 years to appear after exposure.

That long gap matters. A veteran may be diagnosed long after leaving service, and service connection may still be granted for any disease diagnosed after discharge when the evidence establishes that it was incurred in service. By then, the exposure can be hard to trace.

The type of asbestos also matters. ATSDR reports that exposure to amphibole asbestos (one type of asbestos fiber) is linked to a higher risk of mesothelioma.

A claim turns on where, when, and how the person was exposed. The diagnosis alone does not decide it.

Please follow your treating doctors’ care plan. This page does not offer medical advice.

Asbestos Exposure in Military Service

Military exposure claims depend on evidence. Records of a veteran’s service may help show where and how asbestos exposure occurred.

For many veterans, exposure came from daily work. It did not come from one single event.

Common settings include:

  • Ship work and engine rooms
  • Repair and maintenance crews
  • Construction and barracks work

Asbestos-containing materials were used in many of these places. Examples include insulation, gaskets (seals between pipe parts), and pipe coverings.

Service records show duty assignments, ship or unit names, and job roles. Unit histories can show what work a unit did and where it did it.

Family members can help too. Old photos, letters, and memories of jobs and locations may matter. Statements from former co-workers can add important detail.

Under 38 C.F.R. § 3.303, VA looks at “the places, types and circumstances” of a veteran’s service. VA uses service records, unit histories, medical records, and other evidence.

VA Disability Benefits for Veterans With Mesothelioma

VA disability compensation is a monthly payment. It is paid for a disability tied to military service.

Under 38 U.S.C. § 1110, the United States pays compensation to any veteran disabled by personal injury suffered or disease contracted in line of duty during a period of war, who was discharged or released under conditions other than dishonorable. The veteran must be disabled by an injury or disease contracted in line of duty during a period of war, and must have been discharged or released under conditions other than dishonorable. No compensation is paid if the disability is a result of the veteran’s own willful misconduct or abuse of alcohol or drugs.

The same law does not allow payment in certain cases. Payment is denied if the disability results from willful misconduct (a deliberate wrongful act). It is also denied if the disability results from alcohol or drug abuse.

Because the law ties benefits to a period of war, the veteran’s service dates matter.

VA assigns a disability rating. This is a percentage that helps set the monthly amount. VA sets its monthly rates and adjusts them over time. Check current VA figures directly.

VA also has presumption rules for certain conditions. A presumption is a rule that assumes a link unless someone proves otherwise. Whether one applies depends on the veteran’s service and medical facts.

The VA asbestos page explains eligibility, filing options, and evidence requirements.

Useful evidence includes:

  • Diagnosis records
  • Service records
  • Details of the exposure
  • Medical evidence linking the illness to service

Lawsuits and Asbestos Trust Claims Alongside VA Benefits

A lawsuit or trust claim seeks payment from companies or trusts. It does not seek payment from VA.

These claims follow Florida law or trust procedures. Those rules are separate from VA rules.

Some companies that made or used asbestos products went bankrupt. Many of them set up asbestos bankruptcy trusts.

A trust may pay eligible claims apart from a lawsuit. Each trust has its own forms, proof rules, and timing.

Florida law also shapes asbestos suits.

How VA benefits relate to a lawsuit or trust payment depends on the facts. Ask about this before accepting any payment.

A case may be referred to, or handled together with, another law firm. We will tell you if that applies to your family’s situation.

Florida Deadlines and Family Claims

Florida sets filing deadlines for injury and wrongful-death claims. These deadlines can be strict. Contact a lawyer promptly. Do not wait.

For asbestos claims, the clock may start later than many families expect. Under Fla. Stat. § 774.206, for asbestos or silica claims not barred as of the act’s effective date, the limitations period (the legal time limit to file) does not begin to run until the exposed person discovers, or through reasonable diligence should have discovered, that he or she is physically impaired by an asbestos-related or silica-related condition.

It starts when the exposed person discovers, or should have discovered with reasonable diligence, that he or she is physically impaired by an asbestos-related condition. Deadlines still apply.

When a veteran has died, Florida’s wrongful-death law may allow certain family members to bring a claim.

Under Fla. Stat. § 768.19, when a death is caused by a wrongful act, negligence, default, or breach of contract or warranty, and the event would have entitled the injured person to maintain an action and recover damages if death had not ensued, the responsible party can be liable for damages. This falls under the Florida Wrongful Death Act. The Florida Wrongful Death Act may be cited as Sections 768.16 through 768.26 of the Florida Statutes.

Families should gather:

  • The diagnosis letter
  • The veteran’s service history
  • Past and present addresses
  • Any notes about past exposure

VA survivor benefits have their own rules. Review them separately.

Frequently Asked Questions

Can a veteran file a VA claim and a lawsuit at the same time?

Yes. These are separate processes, so a veteran may pursue both. How they interact depends on the facts.

Does a veteran need proof of exposure on a ship or at a base?

Proof helps. Service records, unit histories, medical records, and statements from people who worked nearby can all show exposure.

What if the veteran has died?

Florida’s wrongful-death law may allow certain family members to bring a claim. Survivors can also ask VA about survivor benefits. Those benefits have their own rules.

Is there a deadline?

Yes. Florida deadlines and VA timelines apply. Some start dates depend on when the illness was discovered. Contact a lawyer promptly.

Will a VA claim and a trust claim be handled the same way?

No. VA claims follow federal rules. Lawsuits and trust claims follow Florida law or trust procedures.
