How to Choose a Truck Accident Attorney for Serious Spine Injuries?

If a truck crash left you or someone you love with a spinal cord injury, paralysis, or a serious back or neck injury, choosing a lawyer is a big decision. This guide explains how to choose a truck accident attorney for serious spine injuries. It covers what the lawyer should do. It also covers which questions to ask, how fees work, and Florida’s deadlines.

What Does a Truck Accident Attorney Do After a Serious Spine Injury?

A truck accident attorney investigates the crash. The attorney works out who may be responsible. Then the attorney pursues compensation, which means money to repay the injured person’s losses.

For a spine injury, those losses can include medical care, lost income, and long-term changes to daily life.

Who this guide is for. This guide is written for the injured person. It is also written for family members. These may include a spouse, parent, or adult child who acts for someone who cannot manage a claim alone. It covers spinal cord injury, paralysis (paraplegia and quadriplegia), and serious back and neck injuries.

Why a truck crash is different. A car crash often involves two drivers. A truck crash can involve many parties. These may include the driver, the trucking company, the employer, a cargo loader, a maintenance contractor, and several insurers. Records held by these parties can disappear. This can happen if no one asks for them early.

Keep following your doctors’ care. Keep every record you receive. Your lawyer builds the legal claim while you get medical care. The claim does not replace that care.

What Should You Ask a Truck Accident Lawyer About Spinal Injury Cases?

A strong lawyer should answer your questions clearly. The lawyer should also tell you who will handle your file. Contact our team to talk through your situation before you decide anything.

  • How many truck crash cases involving spinal cord injury, paralysis, or catastrophic back and neck injury has the firm handled, and over what period?
  • Who is the lawyer responsible for my case, and how will I stay in direct contact with that lawyer?
  • How does the firm work with medical professionals, life-care planners (people who estimate future care needs), and accident reconstruction professionals (people who rebuild how a crash happened) when an injury is permanent?
  • What happens in the first 30 days? Ask whether evidence preservation letters (formal requests to keep records) go to the trucking company right away.

CHG will not promise a specific dollar amount, because no lawyer can know the result in advance. You should not feel pressured to sign on the spot.

What Should a Truck Crash Investigation Cover?

A thorough investigation looks at the truck’s records. It also looks at the driver’s hours and testing, the maintenance history, and the crash scene. This must happen before evidence is lost.

  • Driver logs. Hours-of-service rules generally limit how long a driver may drive, subject to exceptions. A driver of a property-carrying commercial motor vehicle may drive a total of 11 hours within the 14 consecutive hours after coming on duty following 10 consecutive hours off duty (49 C.F.R. § 395.3).
  • Federal regulation 49 C.F.R. § 382.303 provides that, as soon as practicable, each employer shall test each of its surviving drivers for alcohol if the driver was performing safety-sensitive functions and the accident involved the loss of human life. For certain other accidents the regulation lists, the same testing applies to a surviving driver who receives a citation under State or local law for a moving traffic violation arising from the accident. As soon as practicable following an occurrence involving a commercial motor vehicle operating on a public road in commerce, each employer shall test for alcohol for each of its surviving drivers who was performing safety-sensitive functions with respect to the vehicle, if the accident involved the loss of human life (text). Attempts to give the alcohol test stop after eight hours. Drug tests have a 32-hour window (49 C.F.R. § 382.303).
  • Crash report. Under Florida law (Fla. Stat. § 316.066), the investigating law enforcement officer prepares the long-form crash report and submits it to the department. This applies to crashes that result in death, personal injury, or any indication of complaints of pain or discomfort, and to other crashes the statute lists (Fla. Stat. § 316.066).
  • Medical documentation. Imaging, surgical records, and treating doctors’ notes connect the crash to the spinal injury.

How Do Fees and Costs Work in a Truck Accident Claim?

A recovery is money won or settled for your claim.

CHG Personal Injury Lawyers charges no attorney’s fees and no case costs unless there is a recovery.

When you speak with our team, request these answers in writing:

  • What percentage applies at settlement, at mediation (a meeting with a neutral helper who tries to help both sides agree), and at trial?
  • How are case costs handled, given that the firm charges no case costs unless there is a recovery?
  • Is any medical care given under a letter of protection? Florida defines this as any arrangement by which a health care provider renders treatment in exchange for a promise of payment for the claimant’s medical expenses from any judgment or settlement of a personal injury or wrongful death action, regardless of whether it is referred to as a letter of protection (Fla. Stat. § 768.0427).

Some benefits you already receive may affect a claim. Bring a list of them to your first consultation.

What a spine injury claim is worth depends on the facts. The facts include how severe and permanent the injury is. They also include medical costs, lost earning capacity (the ability to earn money in the future), and who may be liable. No lawyer can promise a specific amount.

What Are the Steps and Deadlines in a Florida Truck Accident Claim?

A Florida truck accident claim usually moves through four stages. They are consultation, investigation, claim development, and resolution.

  1. Consultation. The firm offers a free, confidential initial consultation with no obligation to continue. Bring the crash report, medical records, insurance letters, and a written timeline of events.
  2. Investigation. Evidence preservation should start quickly. Some records and testing windows are short.
  3. Claim development. Medical costs, lost income, and daily-life changes are documented. A demand, which is a formal request for payment, is sent to the insurers.
  4. Resolution. This may be negotiation, mediation, or, if needed, a lawsuit in Florida court.

Florida’s general negligence filing deadline is two years under Fla. Stat. § 95.11 for causes of action accruing after March 24, 2023. It is important to contact the firm promptly.

Florida also limits recovery based on fault. Under Florida’s comparative fault statute, in a negligence action to which the statute applies, any party found to be greater than 50 percent at fault for his or her own harm may not recover any damages, but this rule does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766 (Fla. Stat. § 768.81).

Common Questions About Choosing a Truck Accident Attorney

Most questions families ask come down to fees, deadlines, and what to say to insurers.

What percentage do accident lawyers take?

Ask our team for the percentage in writing. Ask how it changes at each stage of the case.

What should I say to an insurance adjuster?

An adjuster is the insurance company’s claim reviewer. Talk with your lawyer before you give a recorded statement or sign any release. A release is a document that ends your claim. Tell your lawyer everything, including prior injuries.

Fault still matters. Talk with a lawyer about the facts early.

Do I need to decide right away?

No. But Florida deadlines apply. Contacting a lawyer promptly protects your options.

What if my loved one cannot speak for themselves?

A family member can contact a lawyer for a free consultation on the injured person’s behalf.

What to Look for in a Truck Accident Attorney

Experience with truck crash cases

Truck collisions often involve federal trucking rules, company records and several insurance companies.

Clear, written fee terms

Ask for the fee arrangement in writing. CHG charges no attorney's fees and no case costs unless there is a recovery.

Understanding of spine injuries

Spinal cord injuries can affect movement, feeling and independence for life.

Clear communication

You should know who is handling your case and how to reach them. Ask how often you will receive updates and who will answer your questions when you call.

Before You Speak With an Insurance Company

An insurance adjuster works for the insurance company, not for you. Talk with your lawyer before giving a recorded statement or signing any release. Follow your doctors' care plan, and keep copies of every bill, report and letter you receive.

Who will work on my case?

Ask which attorneys will handle your claim, what their role is, and whether the firm's support staff will be involved day to day.

How are fees handled?

Ask for the percentage and how it is calculated.

How will my medical needs be addressed?

Ask how the firm works with your treating doctors, therapists and rehabilitation team so that your records support your claim.

What happens at the first meeting?

A good first meeting explains the claim process in plain terms, answers your questions and gives you time to decide without pressure.
