An Amazon Flex crash claim in Florida depends on three things. They are who was at fault, which insurance applies, and when you must file. If an Amazon Flex driver hurt you or someone you love, the steps you take in the first days matter. This guide explains each part in plain language.

What Amazon Flex Is and Who Can Be Involved in a Crash

Amazon Flex is a delivery program. Independent drivers use their own vehicles to deliver Amazon packages.

Because the driver uses a personal vehicle, three things can matter. These are the driver, the vehicle and the delivery arrangement. Reviewers look at each one when they review a claim.

Several people can be hurt in these crashes:

  • The Flex driver
  • Other drivers and their passengers
  • Passengers in the Flex vehicle
  • Pedestrians and cyclists

A crash involving an Amazon-branded van or truck can raise different questions. This is different from a crash between two personal cars. A company logo or a delivery route can tie the vehicle to a larger business. That link can affect who is asked to answer for the harm.

If a delivery driver's crash left you or someone you love hurt, you don't have to sort out insurance and deadlines alone. Our team can talk through your options with you. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Steps to Take Right After an Amazon Flex Crash

Florida law requires a driver in a crash that causes injury to stop immediately at the scene. If that is not possible, the driver must stop as close as possible. The driver must stay until the statute’s requirements are met. Florida Statutes § 316.027 requires the driver to remain at the scene until he or she has fulfilled the requirements of s. 316.062. A driver who willfully leaves commits a third-degree felony if the crash causes injury other than serious bodily injury. It is a second-degree felony if the crash causes serious bodily injury.

If you are hurt, take these steps when you can:

  • Call 911 and ask for police. A police report creates an official record of the scene.
  • Get medical care right away. Some injuries take time to show up. Follow your doctors’ care.
  • Record the other driver’s details. Write down the name, insurance information, license plate and any company name or logo on the vehicle.
  • Note the scene. Write down the time, location, weather and road conditions.
  • Be careful with statements. Avoid recorded statements to insurers or company representatives. Talk with a lawyer about your rights first.

For crashes involving injury, a Florida Traffic Crash Report, Long Form must be submitted. It is due within 10 days after the investigating officer completes the investigation.

Documenting the Crash and Preserving Evidence

The most useful evidence is what you record at the scene. It is also what you keep afterward. Gather it early. Memories fade, and digital records can be lost.

  • Photograph vehicle damage, the scene, traffic signals, skid marks and debris.
  • Collect names and phone numbers of witnesses. Write down what each one saw.
  • Keep every medical record, bill, prescription receipt and note about missed work.
  • Save texts, emails, app notifications and delivery messages tied to the trip.
  • Ask quickly about dashcam footage and vehicle data. These records are time-sensitive.

Keep one folder, paper or digital, with every document in date order. Organized records make it easier to answer insurer requests. They also make it easier to explain what happened.

Who May Be Responsible for an Amazon Flex Crash

Responsibility depends on who failed to use reasonable care. A claim can name more than one party.

Negligence means acting carelessly in a way that causes harm. Examples include speeding, distracted driving or running a stop sign.

Florida compares fault. Under Florida Statutes § 768.81, damages are split by each party’s percentage of fault. A party found more than 50 percent at fault for their own harm may not recover damages in a negligence action, except an action for personal injury or wrongful death arising out of medical negligence under chapter 766.

Possible responsible parties include the Flex driver. They may also include entities tied to the delivery, depending on the facts.

In 2026, the U.S. Supreme Court decided Montgomery v. Caribe Transport II, LLC. The Court held that a state-law claim that a broker negligently hired an unsafe motor carrier falls within a federal safety exception. That ruling concerns trucking brokers. It is a point to review with a lawyer. It is not a rule for every crash.

Some commercial vehicles on Florida roads must follow federal safety rules. For larger delivery vehicles, see our Amazon truck accident guide.

Insurance and the Claims Process

Several insurance policies may apply after an Amazon Flex crash. These can include your own policy, the at-fault driver’s policy and any coverage tied to the delivery.

Each policy has its own rules. Sort them out early.

Under Fla. Stat. § 627.736, only insurers writing motor vehicle liability insurance in Florida may provide the benefits of this section, and such an insurer may not require the purchase of any other motor vehicle coverage, other than property damage liability coverage under s. 627.7275, as a condition for providing those benefits. PIP is coverage that pays for medical and related costs after a crash.

Florida law also limits pain-and-suffering claims from motor vehicle crashes. Under Florida Statutes § 627.737, those claims require a listed injury. Examples include significant and permanent loss of an important bodily function, or death.

You can ask an insurer for policy details in writing. Under Florida Statutes § 627.4137, an insurer must provide a sworn statement of each known policy. It must do so within 30 days of a written request.

An adjuster may call early with a settlement offer. An early offer is not the same as the full value of a claim. Review it carefully before you agree to anything.

Florida Deadlines and What to Expect Over Time

Florida generally gives two years to file most negligence lawsuits. Early action matters. Florida Statutes § 95.11 sets these time limits. A missed deadline can bar a lawsuit.

When a crash causes death, Florida Statutes § 768.19 allows a wrongful death claim if the event would have entitled the injured person to maintain an action and recover damages had death not ensued. The claim can be brought against the party who would have been liable had the injured person lived. Families should speak with a lawyer early, since time limits can apply.

A typical claim moves through these stages:

  1. Initial review of the crash, the police report and the insurance policies.
  2. Evidence gathering, including video, vehicle data and witness statements.
  3. Medical treatment, with records collected over time.
  4. Insurance negotiations.
  5. A lawsuit, if the claim cannot be resolved.

Timelines vary. They depend on the injuries, the number of insurers and how fault is disputed. Some claims resolve in months. Others take longer.

Frequently Asked Questions About Amazon Flex Crashes

What happens if an Amazon driver hits my car?

Police may create a crash report. The claim usually starts with the at-fault driver’s insurer and your own insurer.

Is there a lawsuit for Amazon Flex drivers?

Claims can be brought against the parties responsible for a crash. The Flex driver may be one of them.

How do I report a crash involving a delivery driver?

Call 911 for police. The crash report and the other driver’s information are the key records to gather.

Can I still make a claim if the driver fled?

Florida Statutes § 627.727 sets the minimum limits for uninsured motorist coverage: they must be not less than the bodily injury liability limits purchased by the named insured, or a lower limit the named insured selects under the insurer’s rating plan. Whether a particular policy responds after a hit-and-run or fleeing driver depends on the policy language and the facts of the crash, so please contact our team for a free, confidential consultation.

Who pays my medical bills after the crash?

PIP benefits, your health insurance and any recovery from a claim can all play a part. Keep every bill and record organized.
