If you used talcum powder for years and were later diagnosed with ovarian cancer, you may be asking about the talcum powder lawsuit deadline in Florida. Florida sets time limits for lawsuits, and the clock doesn’t always start on the day you first used the product. This page explains how those limits work, what talc lawsuits allege, and what a deadline review looks at. CHG Personal Injury Lawyers is a Florida personal injury firm serving clients throughout Florida, and it offers a free, confidential first consultation with no obligation to continue.

What Talcum Powder Lawsuits Allege

Lawsuits allege that ovarian cancer was caused by talcum powder contaminated with asbestos, including some Johnson & Johnson baby powder. These are claims made by the people who file suit, not findings a court has made. The science is still debated. The U.S. Food and Drug Administration says some research has suggested a possible link between genital talc use and ovarian cancer, but the evidence has not conclusively established one. The American Cancer Society describes the evidence as limited and calls possible asbestos contamination of talc products a major concern. A critical review of perineal talc use reports associations found in the research but notes methodological limitations.

Johnson & Johnson announced in 2020 that it would stop selling talc-based baby powder in the United States. Talc claims are filed in state and federal courts. Claims like these may be referred to, or handled together with, another law firm.

How Florida Deadlines and the Discovery Rule Work

Florida’s time limits for lawsuits are set in its statutes, and they apply to talc claims. Florida’s limitations statute, § 95.11, sets the periods for filing suit. For products, § 95.031 says the time runs from when the facts behind the claim were discovered, or should have been discovered with reasonable diligence. In plain terms, the clock may start when a person learned, or reasonably should have learned, that a product was connected to the harm. That question turns on the facts of each case.

Florida also sets an outer limit. Under § 95.031, most products are presumed to have a useful life of 10 years or less. For those products, a claim cannot be brought for harm from use more than 12 years after the product was first delivered to a buyer who was not in the business of selling it. There is an exception. Under Fla. Stat. § 95.031, the repose period does not apply if the claimant was exposed to or used the product within the repose period, but an injury caused by such exposure or use did not manifest itself until after the repose period expired.

Don’t assume time is still left. Deadlines apply, so the timing should be reviewed early, while records are still available.

Current Status of the Talc Litigation

The current status of talc litigation changes over time, so any status update needs a date and a source. Verdicts and settlements in other cases do not decide what your claim will bring. Each claim depends on its own medical, product, and timeline facts. Where talc companies have tried to resolve claims through bankruptcy court, those efforts are matters of court record, each with its own dates. Ask about the current status as of the day you call.

Florida also has a rule on how a product design claim is judged. Under § 768.1257, in an action based upon defective design, brought against the manufacturer of a product, the finder of fact considers the state of the art of scientific and technical knowledge and other circumstances that existed at the time of manufacture, not at the time of loss or injury. That rule shapes how science from different years is weighed. It is a legal rule, not a finding about any company.

What a Deadline Review Looks At

A deadline review starts with dates: the diagnosis, the first symptoms, and when the talc link first came up. Gather these records if you can:

  • Medical records: the diagnosis date, the pathology report, treatment dates, and early symptom notes.
  • Product history: brand names used, how many years, and how often. Receipts, old containers, or photos help.
  • Timeline: when you first learned or suspected talc was connected, and what prompted it, such as a news story or a doctor’s question.
  • Family records: for a loss, the date of death, the death certificate, and when the family learned the cause.

Keep following your doctors’ care. You don’t need to stop or change treatment to gather paperwork.

  1. First call. You share the basic timeline: the diagnosis, the product use, and any loss in the family.
  2. Records. We help you collect medical and product records. Timing depends on how quickly providers respond.
  3. Review. Igor Hernandez, the responsible lawyer on this page, and our team review the timing question and how strongly the facts link the product to the illness.
  4. Decision. You learn whether the claim moves forward. A claim may be referred to, or handled together with, another law firm, and we explain that before you decide.

Questions Florida Families Ask About Talc Deadlines

What is the typical settlement for a talcum powder lawsuit?

No amount can be promised for any claim. Each case turns on its own facts, so no typical figure applies to any one person.

How long do you have to file a talcum powder lawsuit in Florida?

Florida’s general time limits are in § 95.11, and the discovery rule for products is in § 95.031. Deadlines apply, so an early review is important.

Is talcum powder still sold?

Johnson & Johnson announced in 2020 that it would stop selling talc-based baby powder in the United States.

How do you prove a talcum powder lawsuit?

Proof usually rests on medical records, product history, and a dated timeline. The link between talc and ovarian cancer remains debated in the research.

Can a family file after a death from this cancer?

Florida’s survival statute, § 46.021, says no cause of action dies with the person. Florida’s wrongful death law, § 768.19, covers cases where a death is caused by the wrongful act, negligence, default, or breach of contract or warranty of any person, and the event would have entitled the person injured to maintain an action and recover damages if death had not ensued.
