For families in Doral, a talcum powder lawsuit is a claim brought by women diagnosed with ovarian cancer after using talc-based powder in the genital area. The lawsuits allege that the powder played a role in the illness and that some talc contained asbestos. These are allegations, not proven facts. This guide explains what the lawsuits say, what a claim can cover, and what to expect after a free case review.
What a Talcum Powder Lawsuit Is and Who It Is For
A talcum powder lawsuit is a claim by people who were diagnosed with ovarian cancer and used talc-based baby or body powder. Some people call these talc cancer lawsuits.
Who may consider a claim?
- A woman diagnosed with ovarian cancer who used talc-based powder over a period of time.
- A family member of a woman who died from the disease. Florida law lets certain family members bring a wrongful death claim.
- A spouse, daughter, or other relative who is researching this for someone they love.
You don’t need every document to ask questions. The firm represents people throughout Florida, including Doral and Miami-Dade County. Talc cases may be referred to, or handled together with, another law firm.

What the Lawsuits Allege About Talc and Ovarian Cancer
The lawsuits allege that long-term genital use of talc-based powder may be linked to ovarian cancer. They also allege that some talc contained asbestos fibers. These are claims made in lawsuits, not findings a court has made.
The science is still debated. The FDA on talc in cosmetics says scientific literature has suggested a possible link between genital talc use and ovarian cancer. It also says the evidence has not conclusively established one. The American Cancer Society describes the evidence as limited. It calls possible asbestos contamination a major concern. A PubMed Central review concludes that the evidence does not establish that cosmetic talc causes ovarian cancer.
Testing is part of the debate too. The USP comments to FDA discuss the methods used to test talc for asbestos.
Johnson & Johnson is named in these lawsuits. Its response to the allegations is separate from what the lawsuits claim.

What a Talcum Powder Claim Can Cover
A talcum powder claim seeks payment for losses that can be documented. Common categories include:
- Medical costs. Florida law sets rules for proving medical bills. Under Fla. Stat. § 768.0427, evidence of paid treatment is limited to the amount actually paid.
- Lost income. Time away from work and a reduced ability to earn, where the records support it.
- Pain and suffering. The physical and emotional toll of the illness and its treatment.
Under Fla. Stat. § 768.21, a surviving spouse may recover for loss of companionship and protection and for mental pain and suffering. Survivors may also recover lost support and services. A survivor who paid medical or funeral expenses may recover those too.
How a Talc Claim Is Proven
A talc claim is built from three things: medical records, a record of product use, and a timeline that connects them.
- Medical records. Pathology reports and oncology notes that confirm the ovarian cancer diagnosis.
- Product history. Which powder was used, for how long, and how often. Receipts, packaging, and family memories can help fill gaps.
- A timeline. A dated summary of product use and diagnosis, built with your lawyer.
- Family records. For a death claim, death certificates and estate paperwork.
Gather what you have now. Records are easier to collect while they’re fresh, and a complete file makes the timeline clearer.
Florida also sets time limits on product claims. Under Fla. Stat. § 95.031, a products liability claim for harm caused by a product with an expected useful life of 10 years or less cannot be brought if that harm was caused by exposure to or use of the product more than 12 years after its delivery to the first purchaser or lessee who was not in the business of selling or leasing the product, or of using it as a component in another product; however, the statute’s repose period does not apply if the person was exposed to or used the product within that 12-year period but the resulting injury did not manifest until after the period expired. Under Fla. Stat. § 95.031(2)(b), all products, except those included within subparagraph 1. or subparagraph 2., are conclusively presumed to have an expected useful life of 10 years or less. The statute lists aircraft used in commercial or contract carrying of passengers or freight, vessels of more than 100 gross tons, railroad equipment used in commercial or contract carrying of passengers or freight, and improvements to real property, including elevators and escalators, as not subject to the statute of repose in that subsection. This applies to products with an expected useful life of 10 years or less, and most products are presumed to fall in that group. Whether this affects a particular claim depends on the facts.
Where the Talc Litigation Stands Now
Talc litigation has moved through many courts, and rulings keep shaping it. Related cases can be grouped in federal court in a process called a multidistrict litigation (MDL).
Court developments change over time. A ruling in one case does not decide another person’s claim. Because the picture keeps changing, each claim needs a current review of its own records and court activity.
Settlement Amounts, Timing, and Deadlines
No specific settlement amount can be promised. The value of a claim turns on its own record.
Several factors affect value:
- The diagnosis details and the quality of medical records.
- The length and nature of the product use, and how well it is documented.
- The treatment history and the losses the family can show.
Verdicts and settlements in other cases do not decide your claim.
Claims take time. The schedule follows the court’s calendar and the steps each case needs.
Florida’s time limits for filing suit are set out in Fla. Stat. § 95.11. Deadlines apply, and they can run out. In a death case, the decedent’s personal representative brings the claim for the survivors and estate, under Fla. Stat. § 768.20.
