This guide covers the FedEx truck accidents South Miami families face, from first steps to Florida law. If a FedEx truck hit you or someone you love, you may have a claim against the people responsible. Florida law looks at who was driving, who employed or controlled that driver, and how the crash happened. Acting early matters, because Florida’s deadlines apply.
South Miami drivers share busy roads with delivery trucks every day. Going up against a trucking company’s insurer alone can feel like playing the Miami Heat one-on-one. You don’t have to face it alone.
What Should You Do First After a FedEx Truck Crash?
Get to safety, get medical care, and write down what you remember. If you can move safely, get out of traffic. Call 911 if anyone is hurt.
Follow your doctors’ care closely. Tell them about every symptom, even ones that seem minor after a collision. Some injuries show up hours or days later.
Gather what you can at the scene:
- The truck’s company name and markings
- The driver’s name and any badge or ID details
- The exact location and time
- Names and phone numbers of witnesses
Keep a written record of medical visits, bills, missed work, and insurance calls. Many people accept an early insurance offer before they know the full cost of their injuries. Take time to understand your injuries first.

Why Are FedEx Truck Crashes in Miami-Dade So Serious?
Large trucks are heavy, so a crash with one can cause more serious harm than a crash between two cars. Injuries can include spinal cord injuries, traumatic brain injuries, and broken bones.
Miami-Dade traffic adds to that risk. Delivery trucks stop and start on busy roads, and they share lanes with cars, motorcycles, and bicycles. A single lane change by a large truck can leave little room to react. Federal motor carrier rules set general standards for the commercial motor vehicles on these roads.
Who Can Be Responsible When a FedEx Driver Causes a Crash?
The driver, the driver’s employer, and sometimes others may share responsibility. Which parties fit depends on how the driver was working when the crash happened.
When the driver is a FedEx employee. Who is responsible for a crash involving a delivery vehicle depends on the facts of each case.
When the driver is an independent contractor. Some drivers work under contract and drive their own trucks. Responsibility can turn on how the work was arranged, what the contracts say, and who controlled the driving. These questions often make a claim more complicated.
Other parties. Another driver, a company that maintained the truck, or a business that loaded or dispatched it may also share fault.
A person who willfully violates that duty commits a second-degree felony under § 316.027. Serious bodily injury means a condition that creates a substantial risk of death, serious disfigurement, or long-lasting loss of a body part’s function. Report the crash to police right away.
What Florida Deadlines and Fault Rules Apply to Your Claim?
Florida generally allows two years to file a lawsuit for most negligence claims. Under § 95.11, the two-year limit covers actions founded on negligence. Deadlines apply to most lawsuits, other than actions for recovery of real property, so talk with a lawyer promptly.
Florida also divides fault among the people who contributed to a crash. Under § 768.81, in a negligence action, a party found more than 50 percent at fault for their own harm may not recover any damages, though this does not apply to medical negligence actions under chapter 766. That is why the details of how the crash happened matter so much.
The crash report also matters. The Long Form report is required for crashes involving death, personal injury, or any indication of complaints of pain or discomfort, for crashes involving a violation of s. 316.061(1) or s. 316.193, for crashes involving a commercial motor vehicle, and for crashes that render a vehicle inoperable to a degree that required a wrecker to remove it from the scene. It lists the date, time, location, witness names, and insurance companies. The parties and their legal representatives can access it.

What Shapes the Value of a Truck Crash Claim?
Value depends on the injury, its lasting effects, and the proof. No single formula decides a claim, and figures from other cases don’t predict yours.
Factors that usually matter include:
- How severe the injuries are, and whether they’re permanent
- Ongoing medical care and its cost
- Lost income and any reduced ability to earn
- How the injury changes daily life
- Insurance limits and how many parties are responsible
- The strength of the evidence
Medical bills follow their own rule. Under § 768.0427, evidence of past medical treatment that has already been paid is limited to the amount actually paid, regardless of the source of payment.
If a crash killed someone you love, Florida’s Wrongful Death Act lets certain family members bring a claim. Under § 768.21, a surviving spouse may recover for lost companionship and for mental pain and suffering. Each parent of a deceased minor child may recover for mental pain and suffering.

Five Steps to Take After a FedEx Truck Crash
1. Get medical care right away
Some serious injuries, including back, neck, and brain injuries, may not show symptoms for hours or days. Seek care from a doctor and follow the treatment plan you are given.
2. Document the scene
If you are able, take photos of the vehicles, the road, traffic signs, skid marks, and your injuries. Write down the time, weather, and the names and contact details of any witnesses.
3. Keep a record of everything
Save the police report, insurance correspondence, receipts, and a written log of pain, missed work, and daily limits caused by your injuries.
4. Be careful with recorded statements
Insurance representatives may contact you quickly. Before giving a statement or signing any papers, talk with a lawyer so your words are not taken out of context.
5. Contact a Florida personal injury firm
Commercial trucking cases can involve several parties and detailed records. An early review helps preserve evidence while it is still available.
