When a FedEx Truck Crash Happens in Miami Gardens
If a FedEx truck hurts you in Miami Gardens, you may have a claim for your losses. Florida law lets injured people and families seek compensation from those responsible for the crash.
FedEx truck accidents in Miami Gardens often happen on busy roads. Delivery trucks share lanes with commuters, fans heading to Hard Rock Stadium, home of the Miami Dolphins, and drivers on I-95, Florida’s Turnpike, NW 27th Avenue, and NW 183rd Street. One bad moment on any of them can change a family’s life.
In June 2025, Local10 news reported that one person died and roads closed after a truck overturned in Miami Gardens. Local10 news coverage shows how fast a crash can shut down a neighborhood.
A crash can happen to anyone who drives, walks, or rides nearby. The first hours are confusing. Pain, shock, and calls from insurance adjusters can crowd out the questions you need to ask. This guide explains your options in plain language.
How FedEx Truck Crashes Cause Serious Injuries
Large trucks are heavy, so a collision can cause severe harm to people in smaller vehicles. Pedestrians and motorcyclists are also at risk. Serious injuries can include spinal cord injuries, paralysis, traumatic brain injuries, amputations, severe burns, and serious back and neck injuries.
Fires and rollovers add more danger. Burns and smoke inhalation can follow a fiery crash. Some serious injuries don’t show up for days or weeks. Tell every doctor about every symptom, and follow your doctors’ care. Those medical records also form the core of any injury claim.
Florida has a clear rule about medical bills. For bills already paid, Fla. Stat. § 768.0427 limits the evidence to the amount actually paid, regardless of who paid it. Keep every bill, receipt, and insurance statement.

Who May Be Responsible After a FedEx Truck Accident
Several parties can share responsibility for a truck crash. The driver is one. The company that employed or contracted the driver, a subcontracted carrier, the truck’s owner, and a maintenance provider may also be involved. Who is responsible depends on the facts of each crash.
Records often show what happened before a crash. Federal rules require motor carriers, except for a private motor carrier of passengers (nonbusiness), to make drivers record their duty status for each 24-hour period, under 49 C.F.R. § 395.8. The same rule bars any false report about duty status. Logs can show when a driver was on duty and driving.
See 49 C.F.R. § 382.303. Ask for these records early.
Federal law also shapes who can be sued. In plain terms, federal law does not block that kind of claim.
Other drivers can share fault, too. Your claim may involve more than one party.

Florida Deadlines, Fault Rules, and Evidence to Preserve
Florida sets time limits for filing a lawsuit, and those deadlines apply to your claim. Contact a lawyer promptly so no deadline slips by.
Florida also uses comparative fault, or shared fault (Fla. Stat. § 768.81(6)).
Evidence matters early. Under Fla. Stat. § 316.066, a Florida Traffic Crash Report, Long Form, must be completed and submitted to the department within 10 days after the investigating officer completes the investigation of a crash that meets the statute’s criteria, such as one involving injury or a commercial motor vehicle. Under Fla. Stat. § 316.066(2)(b), crash reports held by the investigating agency may be made immediately available to the parties involved in the crash and their legal representatives, along with other persons and entities listed in the statute. Under § 316.066(2)(f), those reports may also be made available 60 days after the date the report is filed, to persons and entities eligible under paragraph (b) or under the federal permissible uses listed in that subsection.
Gather what you can. Save photos of the scene and vehicles, dashcam or nearby video, witness names and phone numbers, medical records, and records of lost wages and out-of-pocket costs. Speak with a lawyer before giving a recorded statement to an insurance company.
When a FedEx Truck Crash Is Fatal: Support for Miami Gardens Families
We are sorry for your loss. When a crash causes a death, Florida’s wrongful death law lets certain family members seek compensation. Under Fla. Stat. § 768.20, the decedent’s personal representative brings the action for the survivors and the estate.
Florida defines “survivors” in Fla. Stat. § 768.18. They include the decedent’s spouse, children, and parents, and certain blood relatives who depended on the decedent. “Minor children” means children under 25.
Under Fla. Stat. § 768.21, survivors may recover lost support and services. A surviving spouse may recover loss of companionship and mental pain and suffering. Minor children, and all children if there is no surviving spouse, may recover for lost parental companionship, instruction, and guidance and for mental pain and suffering. A survivor who paid medical or funeral bills may recover them.
Families often face funeral costs, lost income, and hard decisions while grieving. You don’t have to make those decisions alone. Keep the crash report, hospital or medical examiner records, funeral bills, and a written list of your family’s losses. Bring them to your first consultation.
