What a FedEx Truck Accident Settlement Is and Who It Is For
A FedEx truck accident settlement is an agreement that ends an injury claim without a trial. The at-fault party’s insurer, or the at-fault party, pays an agreed amount. Then the claim closes.
No two settlements look alike. Each claim is valued on its own facts. No single number fits every crash.
This guide is for people who need to understand this process after a crash involving a FedEx vehicle:
- Drivers and passengers in a car hit by a FedEx truck or van
- Pedestrians and cyclists struck by a FedEx vehicle
- Families handling a wrongful death claim after a fatal FedEx truck crash
FedEx vehicles range from large tractor-trailers to smaller delivery vans. The claim path can differ between them. That is why the vehicle type matters early.
If a FedEx truck left you or someone you love facing medical bills and insurance calls, you may have a claim, and you don't have to sort it out alone. Talk with us. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

What Drives the Value of a FedEx Truck Accident Settlement
Three big factors shape the value. They are how badly you were hurt, what the injuries cost you, and how clearly the evidence shows who caused the crash.
- Severity and permanency. Spinal cord injuries, traumatic brain injuries (injuries to the brain), amputations, severe burns and serious back or neck injuries that last usually mean larger, longer-term losses.
- Lost income. This includes time away from work now. It also includes any lasting drop in what you can earn later.
- Pain and suffering. Florida limits these damages in many car and truck claims. The limits do not apply if the injury meets certain serious tests under § 627.737.
- Liability evidence. Driver logs, dispatch records, dash camera video, maintenance records and the crash report all matter.
- Insurance limits. Coverage caps can limit how much money is collectible.
- Your share of fault. Any blame assigned to you reduces what you can recover.
Florida also sets rules for proving medical bills. Under § 768.0427, amounts already paid are limited to what was actually paid. This applies no matter where the money came from.
Which Companies and Drivers Can Be Responsible
The driver, the company tied to the vehicle, and sometimes other parties can all be responsible. It depends on the facts.
- The driver may be responsible for distraction, fatigue, speeding or an unsafe lane change.
- The employer or vehicle owner may be responsible in some cases. This depends on who employed the driver and who owned the truck.
- FedEx’s business structure matters. FedEx operates through several units, including FedEx Express, FedEx Ground and FedEx Freight. Many delivery routes are run by independent contractors. Who is named depends on who owned, operated and controlled the vehicle.
- Other parties can share responsibility if the evidence supports it. Examples include a maintenance provider or a maker of a defective part.
Federal rules set minimum insurance for for-hire carriers in interstate commerce. For nonhazardous property carried by for-hire carriers in interstate or foreign commerce with a gross vehicle weight rating of 10,001 or more pounds, the federal minimum is $750,000 under 49 CFR § 387.9. These are minimums. They are not the coverage every carrier carries.
How Florida Law Shapes a FedEx Truck Accident Settlement
Florida’s fault rules can lower what you collect. In some cases, they can block recovery entirely.
- Comparative fault. Under § 768.81, a person found more than 50 percent at fault for their own harm may not recover any damages. A lower percentage reduces the award.
- Each party’s share. The same statute says the court enters judgment against each liable party. That judgment is based on that party’s percentage of fault. It is not based on the whole amount.
- Filing deadlines. Florida sets filing deadlines in § 95.11. Deadlines can differ by claim type. Act promptly.
- Personal injury protection. Florida’s no-fault rules in § 627.736 can pay some early benefits. These benefits may not cover all the losses from a serious truck crash.
How a FedEx Truck Accident Claim Moves Toward Settlement
Most claims move through four stages. They are medical care, evidence gathering, a demand to the insurer, and negotiation. Many claims end without a trial.
- Get medical care. Follow your doctors’ treatment plan. Keep every bill, record and work note.
- Know the crash report rules. Florida requires the Florida Traffic Crash Report, Long Form, to be submitted within 10 days after the investigating officer finishes, for crashes that resulted in death of, personal injury to, or any indication of complaints of pain or discomfort by any of the parties or passengers involved in the crash, or that involved a commercial motor vehicle. Parties and their insurers can access it under § 316.066.
- Preserve evidence early. Save photos, witness names and the crash report number. Logs and video can be lost, so act early.
- Pause before recorded statements. Talk with a lawyer before giving a recorded statement to an insurance adjuster.
- Demand and negotiate. Our team gathers liability and damages evidence and sends a demand. The timing depends on whether your treatment has stabilized. It also depends on how many parties are involved.
- Consider a lawsuit. If a fair resolution is not reached, a lawsuit may be filed. Court usually takes longer than negotiation.
Your Questions About FedEx Truck Accident Settlements, Answered
There is no standard payout. Each settlement depends on injuries, losses, evidence and insurance.
How much money do you get if you are hit by a FedEx truck?
There is no standard amount. The value depends on your injuries, losses, evidence and insurance limits.
How much of a $25,000 settlement will I keep?
Medical bills and any liens are reviewed with you before you accept a settlement.
How much are most truck accident settlements?
Every case stands on its own injuries and evidence. No single typical figure applies.
How long does a trucking settlement take?
Timing depends on when treatment ends, how fast records arrive, and whether a lawsuit is needed.
Can my family file if a crash was fatal?
Yes. Florida’s wrongful death law, § 768.19, allows a claim when a death is caused by a wrongful act, negligence, default, or breach of contract or warranty, and the event would have entitled the person injured to maintain an action and recover damages if death had not ensued. § 768.21 lists what survivors may recover.
