If a FedEx truck or box truck hurt you or someone you love in Doral, Florida law may give you a path to recover what the crash cost you. Responsibility can reach more than one person or company, and filing deadlines apply. This guide explains the basics in plain language. It is general legal information, not medical advice, so please follow your doctors’ care.

A FedEx Truck Crash in Doral Can Change a Family’s Life in One Moment

A FedEx truck crash can turn a normal week upside down in seconds. Picture a commuter on NW 41st Street who changes lanes and is clipped by a large delivery truck. Within days, she has hospital bills, missed paychecks and insurance calls she doesn’t know how to answer. Nobody has told her who is responsible.

This page is for injured people and their families in Doral and nearby Miami-Dade communities. It explains the options that Florida law may open up, using everyday words instead of legal jargon.

Why Doral’s Roads Carry So Much Delivery Traffic

Doral carries heavy delivery traffic because it is a busy commercial hub in Miami-Dade County. Warehouses, logistics centers, shopping areas and offices all sit close to the main roads. That means large trucks share lanes with commuters, school traffic and shoppers all day long.

Drivers in and around Doral often use the Dolphin Expressway (SR 836), the Palmetto Expressway (SR 826), the Florida Turnpike, NW 41st Street and NW 25th Street. Anyone who has sat through Dolphin Expressway rush hour knows how quickly a lane can stop moving. Merges, exit ramps and sudden backups raise the risk for everyone on the road.

Weather adds another layer. Sudden South Florida downpours and standing water can reduce visibility and make stopping much harder for a heavy truck.

How Crashes Involving FedEx Trucks and Box Trucks Typically Happen

Most of these crashes follow a few familiar patterns. A large truck may rear-end a car that stopped in heavy traffic. A driver may sideswipe a vehicle during a lane change. A truck may roll over on a curve or ramp. A box truck may turn into the path of a car. Sometimes one impact sets off a multi-vehicle pileup.

Trucks need far more distance to stop and turn than passenger cars do. A shifting cargo load can also change how a truck handles. These facts matter because they affect who had time to react and who had a fair chance to avoid the crash.

The people hurt are not always the truck driver. Occupants of a pickup or car, pedestrians and bicyclists can all suffer serious injuries when a delivery truck is involved.

Who Might Be Responsible When a FedEx Truck Is Involved

Responsibility can reach beyond the driver. Depending on the facts, it may include the driver’s own careless driving, the company that employed or assigned the driver, and the owner or maintenance provider of the truck.

Florida’s comparative fault statute, Fla. Stat. § 768.81, says the court enters judgment against each liable party based on that party’s percentage of fault. It does not use joint and several liability in that way. Fla. Stat. § 768.81 reads: “(4) APPLICABILITY.—This section does not apply to any action brought by any person to recover actual economic damages resulting from pollution, to any action based upon an intentional tort, or to any cause of action as to which application of the doctrine of joint and several liability is specifically provided by chapter 403, chapter 498, chapter 517, chapter 542, or chapter 895.” (Fla. Stat. § 768.81)

Some delivery routes are run by independent contractors. Every crash has its own facts, and a review of those facts is the starting point for understanding who may be responsible. In May 2026, the U.S. Supreme Court held that a state-law claim that a broker negligently hired an unsafe motor carrier is not preempted by federal law, in Montgomery v. Caribe Transport II.

You do not need to sort out every responsible party on your own. The claim process is built to find out who is responsible.

Evidence That Can Disappear After a Crash in Doral

The records that matter most are often the ones that go missing first. Save the crash report, photos of the scene and vehicle damage, and the names and phone numbers of witnesses. Ask about dashcam or nearby security camera footage early, because some recordings are overwritten quickly. Keep your own medical records and bills.

Federal trucking rules also create records. Except for a private motor carrier of passengers (nonbusiness), a motor carrier subject to the requirements of this part must require each driver to record the driver’s duty status for each 24-hour period, under 49 CFR § 395.8. Each carrier must keep a driver qualification file for each driver. Except for records listed in paragraph (d), that file stays on record while the driver works for the carrier and for three years after, under 49 CFR § 391.51. Other records follow retention periods in 49 CFR § 379.3. After the required retention periods, a company may destroy records at its discretion, but this does not excuse compliance with other governmental requirements prescribing longer retention periods. That is why early written requests matter.

Start a simple journal. Note your pain, missed work and daily limits. Save every letter from an insurance company before you sign anything.

Florida Deadlines and Fault Rules Every Injured Person Should Know

Florida sets filing deadlines for injury claims, and they apply to every case. Deadlines apply to injury claims in Florida, so contact a lawyer promptly.

Florida also uses a fault rule. Under § 768.81, in a negligence action to which this section applies, any party found greater than 50 percent at fault for their own harm may not recover any damages. That rule does not apply to medical negligence claims under chapter 766. How the rule plays out depends on the facts.

Crash reports also follow a clock. Under Fla. Stat. § 316.066, a Florida Traffic Crash Report, Long Form must be submitted within 10 days after the investigating officer finishes the investigation.

When a FedEx Truck Crash in Doral Is Fatal: Support for Families

Florida’s wrongful death law lets certain family members and the estate bring a claim after a loved one dies. The law is known as the Florida Wrongful Death Act, Fla. Stat. § 768.16.

Under § 768.21, a surviving spouse may recover for the loss of the decedent’s companionship and protection, along with mental pain and suffering. Minor children may recover for lost parental companionship, instruction and guidance. Each parent of a deceased minor child may recover for mental pain and suffering. A survivor who has paid medical or funeral expenses may also recover them.

Families often feel overwhelmed. Start by requesting the crash report and gathering your loved one’s records. Keep receipts for funeral and household costs. Speak with a lawyer before giving a recorded statement to any insurance company.

Quick Answers

How long do I have to file?

Florida sets filing deadlines for injury claims, and they apply to every case. Contact a lawyer promptly.

Can I be blamed partly?

Florida’s fault rule can reduce recovery based on your share of fault. In a negligence action, anyone found more than 50 percent at fault for their own harm may not recover any damages, but this does not apply to personal injury or wrongful death claims arising out of medical negligence under chapter 766.

Who gets the crash report?

Under Florida law, the people the statute lists (including those involved in the crash, their legal representatives, their licensed insurance agents and their insurers) may receive a crash report without waiting. Sixty days after the report is filed, it may also be released for certain uses that federal law permits. Release and further sharing of the report are subject to the conditions in § 316.066(2)(f)-(g) and to federal redisclosure requirements under 18 U.S.C. § 2721(c).
