A car accident back injury settlement is money an injured person may get from the at-fault driver or that driver’s insurer. It ends a claim for back harm caused by a crash. The amount depends on the medical proof. It also depends on whether the injury lasts and how much insurance is available.

We handle car accident cases for people throughout Florida.

What a Car Accident Back Injury Claim Covers

A back injury claim asks the responsible party to pay for harm a crash caused to the spine. The spine is the column of bones that runs down your back. The injury can be in the neck, the upper back, or the lower back.

This kind of claim can help drivers, passengers, pedestrians, and motorcyclists hurt in Florida crashes. Neck and back injuries often happen together. One impact can strain both areas.

Common injuries include:

  • Muscle and ligament strains. These are stretched or torn soft tissues.
  • Herniated or bulging discs. A disc is the cushion between spine bones. When its soft center pushes out, it can press on nearby nerves.
  • Fractures. Some crashes break vertebrae, the bones of the spine.
  • Nerve pain. Pain can travel into the legs or arms.

A claim generally seeks medical bills, lost wages or lost earning ability, and pain and limited activity. A back injury can be minor and short-lived. It can also last and change how someone works and lives.

How PIP and Medical Records Document a Back Injury

Medical records carry the most weight in a back injury file.

Florida drivers must carry Personal Injury Protection (PIP) coverage. PIP is often the first source for crash-related bills.

Key records include:

  • First visit notes
  • Exam findings
  • MRI or CT results
  • The treating doctor’s diagnosis

If the insurer that received the personal injury protection claim requests it, the medical providers who treated the injured person must furnish a written report of that person’s history, condition, treatment, dates, and costs of treatment. The report covers treatment, dates, and costs. It comes with a sworn statement, meaning a statement signed under oath. That statement says the care was reasonable and necessary for the injury.

Consistency helps. Records that show ongoing symptoms, follow-up visits, and recommended treatment tell a clearer story. A long gap tells a weaker one.

What Raises the Value of a Back Injury Claim

Clear medical proof that the crash caused the injury usually matters most. Lasting effects matter too.

Florida law limits pain and suffering damages after a car crash. Damages are the money a person can seek for losses. Fla. Stat. § 627.737 allows pain and suffering damages against the owner, registrant, operator, or occupant of a motor vehicle with respect to which security has been provided as required by ss. 627.730-627.7405 only if the injury meets one of these tests:

  • Significant and permanent loss of an important bodily function.
  • Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.
  • Significant and permanent scarring or disfigurement.
  • Death.

For a back injury, the permanency test often depends on medical opinion. Your doctors can explain what an injury may mean for your health over time.

Other strong factors include:

  • Ongoing treatment
  • Lost income backed by pay records
  • A doctor’s work restrictions

Clear proof of fault also helps. Examples include police reports, photos, and witness statements.

What Can Lower the Value of a Back Injury Claim

Gaps in care, older back problems, and shared fault can each reduce an insurer’s offer.

  • Gaps in treatment. A late first visit or a long pause in care can lead an insurer to argue the injury was not serious.
  • Prior back conditions. The insurer will try to separate old problems from new crash harm.
  • Shared fault. Under Fla. Stat. § 768.81, fault chargeable to the injured person reduces the award. It does not bar recovery, unless that person is found more than 50 percent at fault.
  • Policy limits. Policy limits are the most an insurer will pay. The at-fault driver’s coverage, plus your own PIP and uninsured or underinsured motorist coverage, can cap what is available. Fla. Stat. § 627.4137 requires liability insurers to provide policy details within 30 days of a written request.

Why Published Averages Can’t Predict Your Claim

No published average can tell you what your back injury claim is worth. Online averages mix different states, injury types, insurance limits, and case stages. They do not reflect any one person’s medical file.

Neck and back claims are documented in similar ways. Each one is still valued on its own medical findings.

Medical bills follow their own rules. Under Fla. Stat. § 768.0427, evidence of paid past treatment is limited to the amount actually paid.

A letter of protection is a promise to pay the provider from any settlement or judgment.

Fla. Stat. § 768.76 requires the court to reduce a damages award by amounts paid from collateral sources, but there is no reduction for collateral sources that hold a right of subrogation or reimbursement.

When an offer arrives, compare it with your bills, records, lost income, and future care needs. Do not compare it with an average.

How a Florida Back Injury Claim Usually Moves Forward

A claim usually moves in stages. It starts with medical care and paperwork. Then comes a demand, negotiation, and sometimes a lawsuit.

  1. Get evaluated and follow your doctors’ plan. Keep every appointment the treating doctors set.
  2. File PIP benefits. Keep copies of every bill, record, and insurer letter.
  3. Gather proof. Collect liability evidence, wage records, and the complete medical file.
  4. Send a settlement demand. This is a written request for payment. It goes to the at-fault driver’s insurer.
  5. Negotiate. Some claims settle here. Others need a lawsuit.
  6. Litigate if needed. This means taking the case to court. Florida court rules then apply. You decide whether to accept any settlement.

Negligence means carelessness that causes harm. For most injuries occurring after March 24, 2023, a negligence claim generally must be filed within two years under Fla. Stat. § 95.11(5)(a), and other deadlines can also apply, so contact the firm promptly. Reach out to us promptly. Do not wait.

Frequently Asked Questions

How much can I get for a back injury in a car accident?

The value depends on your medical proof. It also depends on whether the injury is permanent, your lost income, and the insurance available. No average can predict an individual claim.

How much should I settle for a lower back injury?

Settlement value is tied to your documented injury and bills. Our team can review any offer against your full file.

What is a good settlement offer for a back injury?

An offer is measured against your medical bills, lost income, future care, and the strength of your proof. Compare it with your records, not with a published average.

Does PIP cover back injury bills in Florida?

PIP can pay certain medical bills and part of lost income, up to the policy limits.

What if I already accepted an insurance check?

Under Fla. Stat. § 768.041, a release with one party does not release others who may be liable for the same injury. A release is a signed document that ends a claim. Reach out to us promptly so we can review the release and any remaining claim.
