Amazon Truck Accidents Richmond West, FL | CHG

Amazon truck accidents Richmond West drivers and families face are often more tangled than they look. Anyone who drives in Miami-Dade knows traffic can move like a Miami Heat fast break. A delivery van or truck can hit a car, a bicycle, or a person on foot in seconds, and the harm can last for years. This page explains what to do first, why more than one company may be involved, and the Florida rules that matter.

If an Amazon delivery truck or van hit you in Richmond West, what should you do first?

Your first steps are safety, medical care, and facts. Move out of traffic if you can do so safely. Call 911 and ask for police and medical help.

Get checked by a doctor even if your injuries seem minor. Some injuries don’t show up until hours or days later. Follow your doctor’s care and keep every appointment.

Write down what you can while it’s fresh. Note the company name on the vehicle, any USDOT number, and the license plate. Get the driver’s name and insurance details, plus names and phone numbers of witnesses.

Take photos and video of the vehicles, the scene, traffic signals, and any visible injuries. Do this as soon as it’s safe.

Be careful with recorded statements and quick settlement offers. An adjuster may call soon after a crash, before anyone knows the full extent of your injuries. You can take time before you say more than your name and basic facts.

Why an Amazon delivery crash can involve more than one company

More than one company can be involved because the driver, the vehicle, and the route may belong to different businesses. Many Amazon deliveries are run by outside delivery companies. The driver’s employer, the vehicle’s owner, and the company that assigned the route may each be part of the picture.

Federal rules show why the paperwork matters. Federal law lets regulators require a motor carrier that uses motor vehicles not owned by it to transport property under an arrangement with another party to control and be responsible for operating them. The carrier must treat them as if it owned them. The same rules require written arrangements to say who loads and unloads the cargo. See 49 U.S.C. § 14102.

Who is responsible depends on the facts. Lawyers review who hired the driver, who owned and maintained the vehicle, and how the delivery was assigned.

Florida rules and deadlines that shape a truck or van injury claim

Florida generally gives two years to file a lawsuit based on negligence (Fla. Stat. § 95.11(5)(a)). Wrongful-death claims fall in the same two-year group. Contact our team to learn which time limits may apply to your situation. Deadlines apply to every claim, so don’t wait to act.

Florida also uses comparative fault, which means shared fault. Under Fla. Stat. § 768.81, in a negligence action, a party found greater than 50 percent at fault for their own harm may not recover any damages, but this does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766. The same statute says Florida courts divide responsibility by each party’s percentage of fault.

Crash reports matter too. Under Fla. Stat. § 316.066, a Florida Traffic Crash Report, Long Form, must be completed and submitted to the department within 10 days after the investigating officer completes the investigation of a motor vehicle crash that resulted in death, personal injury, or any indication of complaints of pain or discomfort, or that involved a commercial motor vehicle. That applies when someone is hurt or complains of pain, and also when a crash involves a violation of s. 316.061(1) or s. 316.193, or renders a vehicle inoperable to a degree that required a wrecker to remove it from the scene of the crash. Parties to the crash, their legal representatives, and their insurers can access the report, subject to privacy limits.

Florida’s personal injury protection rules are set out in Fla. Stat. § 627.736. Ask about your PIP coverage early.

Serious and life-altering injuries from delivery truck crashes

A large vehicle crash can cause injuries that change daily life. These include spinal cord injuries and paralysis, traumatic brain injuries, amputation, severe burns, and serious back and neck injuries. Some people need months or years of rehabilitation, special equipment, and changes at home. Some effects take time to show, so the full picture may not be clear right away.

When a crash causes a death, Florida’s wrongful-death law lets the family bring a claim. Under Fla. Stat. § 768.19, when a death is caused by someone’s wrongful act or negligence, and the injured person could have sued and recovered damages if they had lived, the party who would have been liable can still be liable for damages. The law focuses on the family left behind.

Families who lose someone in these crashes carry grief and hard decisions at the same time. You don’t have to decide everything this week. Take the time you need, and lean on people you trust.

What evidence matters in an Amazon truck or van crash

The most useful records often sit in company files, so early requests matter. Federal rules require a motor carrier to keep a driver qualification file for each driver it employs. That file includes the driver’s application and motor vehicle records. The carrier keeps it while the driver works for it and for three years after. See 49 C.F.R. § 391.51.

Post-accident testing rules matter too. See 49 C.F.R. § 382.303.

Other evidence includes dashcam footage, skid marks, debris, and nearby business video. Footage can be overwritten, so ask early that these records be preserved. Your medical records also tie the crash to your injuries. That’s why following your doctor’s care matters.

Why delivery traffic on Richmond West roads raises the stakes

Delivery vehicles share neighborhood streets and busy Miami-Dade corridors with pedestrians, cyclists, and people driving cars. Heavy vehicles need more room to stop and turn. A single mistake can cause serious harm.

Good records help. Write down the time, the exact location, and nearby landmarks such as the street, intersection, or business. Make sure police come to the scene, and ask for the report number.

Keep your own notes about how the crash affects sleep, work, and daily chores. These details show the full impact on your life.
