If an Amazon delivery truck or van crashed into you or someone you love on a Miami Lakes road, you may have legal options under Florida law. This guide explains who may be responsible, the time limits that apply, and what to protect in the first days. It is general information, and every crash turns on its own facts.

Why Amazon Delivery Vehicles Are Part of Daily Traffic in Miami Lakes

Amazon delivery trucks and vans are a common sight on Miami Lakes roads. A crash with one can happen to any driver. Busy routes like the Palmetto Expressway and Okeechobee Road carry commuters, school traffic, and delivery vehicles in the same lanes.

Delivery schedules are tight, and routes are dense. That pressure can be one reason residents notice these vehicles on their daily drives.

A crash may involve a large box truck or a smaller delivery van. Many injured people don’t know who employs the driver. The driver may wear Amazon branding but work for a separate company. That confusion is common. Knowing the basics early helps families make informed choices.

Who May Be Responsible When an Amazon-Contracted Driver Causes a Crash?

More than one party may be responsible. That can include the driver, the driver’s employer, and the company that owns or controls the vehicle.

Many Amazon deliveries are made by drivers who work for delivery service partners. These are independent companies that contract with Amazon. Because of that structure, several parties may each play a role in a claim.

The word “negligence” comes up often in injury claims, but its legal meaning depends on the facts of each case, so it is worth discussing your specific situation with a lawyer. A driver or company that acts carelessly and hurts someone may be liable for the injuries that follow. Florida divides damages by fault. Under Fla. Stat. § 768.81, a court enters judgment against each liable party based on its percentage of fault. Each party pays its own share.

Federal law also matters.

In 2026, the U.S. Supreme Court held in Montgomery v. Caribe Transport II, LLC that a state-law claim about hiring an unsafe carrier falls within a federal safety exception. In plain words, federal law does not block that kind of claim. The Montgomery opinion explains the holding.

Responsibility depends on who owned the vehicle, who set the route and schedule, and how the driver was trained and supervised. Don’t assume who is responsible until someone reviews the details.

What Florida Deadlines and Fault Rules Apply After a Crash?

Florida sets a limited time to file a lawsuit, and the time depends on the type of claim. Waiting is the biggest risk you can control. Fla. Stat. § 95.11 sets the filing time limits for many civil actions.

Wrongful death claims fall under the Florida Wrongful Death Act. These claims can raise their own timing questions, so review them promptly.

Florida also uses a fault-share rule. Under Fla. Stat. § 768.81, in a negligence action to which this section applies, a person found more than 50 percent at fault for their own harm may not recover any damages; this does not apply to personal injury or wrongful death claims arising out of medical negligence under chapter 766. Think of fault as a share.

Don’t let fault questions slow you down. Contact the firm promptly, because deadlines apply and waiting can limit your options.

What Evidence Should You Protect in the First Days After an Amazon Truck Crash?

The most useful evidence is usually what you can gather right away. That includes the crash report, photos, witness names, and medical records. Save it before it’s lost.

Florida requires a Traffic Crash Report, Long Form, for crashes involving death, personal injury, or any indication of complaints of pain or discomfort, for crashes involving a violation of s. 316.061(1) or s. 316.193, for crashes that rendered a vehicle inoperable to a degree that required a wrecker to remove it from the scene of the crash, and for crashes involving a commercial motor vehicle. It must be completed within 10 days after the investigation ends. Fla. Stat. § 316.066 also sets who may access the report.

Federal rules add records that only the company holds. 49 C.F.R. § 382.303 sets time limits for those tests. Drivers must also record their duty status. 49 C.F.R. § 395.8 requires the city and State abbreviation for each change of status. Records may be kept in many formats under 49 C.F.R. § 379.7, so an early written request to preserve them can matter.

Practical steps help:

  • Take photos of the vehicles, the scene, and any injuries.
  • Write down names and phone numbers of witnesses.
  • Save any dashcam or nearby surveillance footage you can access.
  • Keep a simple journal of pain, missed work, and daily limits.
  • Hold off on posting about the crash on social media.

Follow the care plan your treating doctors set. Your health comes first.

When a Crash Causes Catastrophic Injury or a Family Loss, What Comes Next?

Some crashes cause life-changing injuries. These include spinal cord injuries, paralysis, traumatic brain injuries, amputations, and severe burns. Recovery may involve long-term medical care, therapy, and equipment. Families often face these changes all at once.

Some crashes end in death. Florida law allows a claim when a death is caused by a wrongful act or negligence. Under Fla. Stat. § 768.19, the party who would have been liable if the injured person had lived remains liable.

Under Fla. Stat. § 768.21, a surviving spouse may recover for lost companionship and for mental pain and suffering. Minor children of the decedent, and all children of the decedent if there is no surviving spouse, may recover for lost parental companionship, instruction, and guidance. Parents of a deceased minor child may recover for mental pain and suffering. A survivor who paid medical or funeral expenses may recover them.

You can ask about next steps, medical coordination, and paperwork while you focus on care and grief.
