Amazon Truck Accidents | Key Biscayne, Florida

Hurt in a Crash With an Amazon Delivery Truck?

Delivery trucks share the causeways and neighborhood streets of Key Biscayne with families, commuters and cyclists.

By CHG Lawyers · Published October 26, 2026

If an Amazon delivery truck or van hurt you on Key Biscayne, you may have a claim, and your first steps matter. Amazon truck accidents on Key Biscayne often turn on three questions: who employed the driver, who owned or maintained the vehicle, and what the driver was doing at the time. This guide explains those questions in plain language, along with Florida’s rules on fault and deadlines. CHG Personal Injury Lawyers is a Florida personal injury firm, and Igor Hernandez is the responsible lawyer for this page.

An Amazon Delivery Truck Hit You on Key Biscayne. What Happens Next?

Your first priorities are your health, the police report, and the evidence at the scene. Those steps come before any question about who pays.

Picture a weekday morning on Crandon Boulevard. A delivery van pulls to the curb to drop off a package, then pulls back into traffic without warning. You brake hard, and your car is struck from behind. Or you swerve to miss it and hit a median. Either way, you’re hurt, and there’s a lot to sort out.

Start with medical care, and follow your doctors’ instructions. Tell every provider exactly how the crash happened. Some injuries, especially to the head and neck, can show up days later. New symptoms still matter, even if they appear after the first day.

Next, report the crash to police. Photograph the scene, the vehicles, and the license plates. Keep every bill, receipt, and work note. Write down what you remember while it’s fresh.

Florida law requires a written crash report after an investigation of a crash that causes injury or complaints of pain. The officer must submit it within 10 days after the investigation is complete (Fla. Stat. § 316.066). You may have a claim if another party’s carelessness caused your harm.

Why Amazon Delivery Vehicles Are on Key Biscayne Roads

Amazon packages reach Key Biscayne the way they reach much of Miami-Dade: in delivery vans and box trucks that run planned routes with many stops. The island has one main road corridor, the Rickenbacker Causeway link to the mainland, and a mix of condos, single-family homes, and businesses. Every delivery adds one more vehicle to these roads.

Drivers heading toward the far end of the island pass Bill Baggs Cape Florida State Park and its historic lighthouse. Residents, visitors, cyclists, and drivers all share these roads, and the mix of traffic makes careful driving important.

Multi-stop routes mean frequent stops. Drivers back up, turn into driveways, and change lanes on narrow residential streets. Each of these moves creates a chance for a collision. A van that slows near a driveway can surprise a driver behind it, and a van that backs out can strike someone on foot or on a bike.

Who May Be Responsible When an Amazon Package Truck Crashes?

Whether you can sue Amazon depends on the facts of your crash. Many Amazon routes are run by delivery companies, so the driver’s employer, the vehicle owner, and anyone who maintained the vehicle may all be part of the picture.

Three questions help sort this out. Who employed the driver? Who owned or maintained the vehicle? What was the driver doing at the moment of the crash? The driver’s activity can matter, such as whether the driver was following a route, rushing, or using a phone.

Federal rules require many motor carriers to record each driver’s duty status for every 24-hour period. Drivers can record it electronically or on a paper grid. These records can show how long a driver had been working (49 C.F.R. § 395.8).

Other evidence can matter too. Dashcam video, GPS data, delivery-app records, and vehicle maintenance logs may help show what happened. Records can be lost or overwritten, so the sooner they are requested and saved, the better.

What Injuries Are Common After a Large-Vehicle Crash?

Crashes with large vans and box trucks often cause traumatic brain injuries, back and neck injuries, and broken bones. Some crashes cause spinal cord injuries or injuries to a limb that need long-term care.

Some injuries take weeks or months to fully understand. The full picture may not be clear right after the crash, so it helps to keep a simple daily journal. Write down pain, sleep, and what you can no longer do at work or at home.

Follow your doctors’ care plan, even when you feel better for a while. Tell each provider exactly how the crash happened, using the same clear account every time. Your medical records and your journal can then tell the same story.

How Florida’s Fault and Deadline Rules Shape a Key Biscayne Claim

Florida uses a modified comparative fault rule: in a negligence action, a party found greater than 50 percent at fault for his or her own harm may not recover any damages, but this rule does not apply to actions for personal injury or wrongful death arising out of medical negligence (Fla. Stat. § 768.81). Under the statute, in a negligence action to which this section applies, any party found greater than 50 percent at fault for his or her own harm may not recover any damages, but this does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence under chapter 766 (Fla. Stat. § 768.81).

Fault can also be shared. The court enters judgment against each liable party based on that party’s percentage of fault, not on joint and several liability. In plain terms, each party is judged by its own share.

Florida’s limitations statute says actions other than for recovery of real property must be commenced within the period set for each type of action, such as 20 years for an action on a judgment (Fla. Stat. § 95.11). Deadlines apply to every claim, and the clock keeps running while paperwork is gathered. Contact a lawyer promptly.

Florida’s Motor Vehicle No-Fault Law is the name given to sections 627.730 through 627.7405 (Fla. Stat. § 627.730). Personal injury protection (PIP) benefits are governed by § 627.736, so ask about PIP early.

When a Crash Takes a Life: Wrongful Death Claims in Florida

A wrongful death claim is brought by the decedent’s personal representative, for the benefit of the survivors and the estate. Under Florida’s wrongful death law, the action must be brought by the decedent’s personal representative, who recovers damages for the benefit of the decedent’s survivors and estate (Fla. Stat. § 768.20).

Florida law makes a person liable for a death caused by their wrongful act, negligence, default, or breach of contract or warranty, if the injured person would have been entitled to sue and recover damages had death not ensued, and that person then faces damages just as if the death had not occurred (Fla. Stat. § 768.19). The damages statute describes what survivors may recover. Under Florida law, the liable person pays damages as specified in the wrongful death act, and a surviving spouse may recover for loss of the decedent’s companionship and protection and for mental pain and suffering from the date of injury (Fla. Stat. § 768.21). Minor children may recover for lost parental guidance. Each parent of a deceased minor child may recover for mental pain and suffering. Survivors who paid medical or funeral bills may also recover those costs (Fla. Stat. § 768.21).

These legal words can feel cold. Behind them is a family that lost a parent, a partner, or a child. Families often need help with funeral arrangements, household questions, and keeping evidence safe. Speaking with a lawyer early can help with those questions, but deadlines apply, and no result is promised.
