If an Amazon Delivery Truck Hit You in Country Club, Start Here

If an Amazon delivery truck or van hit you in Country Club, you may have a claim. You may be able to seek payment for your injuries and losses. Responsibility may reach the driver, the company that runs the route, and the insurance that applies.

Miami Dolphins fans know one play can change a whole game. After a crash, a few early details can shape a claim. Insurance companies often move quickly.

Crashes like this bring doctor visits, insurance calls, and lost paychecks. They also raise one hard question: who is responsible? You don’t have to answer that alone.

CHG Personal Injury Lawyers is a Florida-based personal injury firm. It serves people throughout Florida, including Miami-Dade communities such as Country Club. Igor Hernandez, one of the firm’s lawyers, is responsible for this page. Our goal is to help you understand your options and your next steps.

Can You Sue Amazon If a Delivery Driver Hits You?

Yes. A claim may involve more than the driver. It can reach the company that runs the delivery route.

In some cases, Amazon itself can be named. The answer depends on who controlled the vehicle and the route.

Many Amazon routes are run by delivery service partners, often called DSPs. A DSP is a separate company that contracts with Amazon. Its drivers often work for the DSP, not for Amazon. That is why confirming the driver’s employer and insurer early matters.

Companies that choose carriers can face claims too. See Montgomery v. Caribe Transport II, LLC.

See Clooney v. Geeting.

Why Do Delivery Trucks and Vans Crash on Local Streets?

Delivery vehicles crash in many of the same ways other vehicles do. Their routes and schedules can add pressure.

Common patterns include:

  • Red-light and intersection crashes
  • Unsafe lane changes
  • Backing or turning in busy neighborhoods

Tight drop-off windows can make these moments more risky.

Larger commercial trucks follow federal driving-hour limits. A driver may not drive after 14 consecutive hours on duty. That period must follow 10 consecutive hours off duty. A driver also may not keep driving after 8 hours of driving time without a 30-minute break, except for drivers who qualify for either of the short-haul exceptions in § 395.1(e)(1) or (2). See 49 C.F.R. § 395.3. See 49 C.F.R. § 395.3.

Federal law also sets minimum insurance levels for motor carriers that transport property. See 49 U.S.C. § 31139. Whether these rules apply to a particular van depends on the vehicle and the trip.

What Florida Deadlines and Rules Apply to a Delivery Truck Crash?

See Fla. Stat. § 95.11.

Deadlines apply. The sooner the review starts, the better.

Florida car insurance includes personal injury protection, called PIP. PIP pays for medical and disability benefits. Under § 627.736, a policy must provide $10,000 in medical and disability benefits. It must also provide $5,000 in death benefits.

Under Fla. Stat. § 627.736, personal injury protection covers eighty percent of all reasonable expenses for medically necessary medical, surgical, X-ray, dental, and rehabilitative services, subject to the statute’s limits. This applies when initial services start within 14 days after the crash.

Florida car insurance policies must provide personal injury protection benefits under § 627.736, and the serious-injury requirement for pain and suffering is in § 627.737. Section 627.737 lists qualifying injuries. They include:

  • Significant and permanent loss of an important bodily function
  • Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.
  • Significant and permanent scarring
  • Death

Florida also uses comparative fault, which means shared fault. Under § 768.81, in a negligence action to which this section applies, a party found greater than 50 percent at fault for his or her own harm may not recover any damages, but this does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766. Details matter early.

What Evidence Should You Protect After an Amazon Truck Crash?

Start with evidence that can disappear. Photos, witness names, and video come first.

  • Photos of both vehicles, the intersection, road conditions, and any damage.
  • The license plate and any delivery company name or logo on the vehicle.
  • Names and phone numbers of anyone who saw the crash.
  • Video from nearby homes or businesses. It may be overwritten over time.

The police report matters too. Florida requires a Florida Traffic Crash Report. For crashes that result in death, personal injury, or any indication of complaints of pain or discomfort by any of the parties or passengers involved in the crash, or that involve a commercial motor vehicle, the Florida Traffic Crash Report, Long Form must be submitted within 10 days after the investigating officer completes the investigation. The report lists the parties’ names, addresses, and insurance companies. Parties and their legal representatives may access it. See § 316.066.

Medical records and bills document your injuries. Follow your doctors’ care. Keep copies of every bill and treatment note. This article is not medical advice.

The delivery company may hold route, GPS, and vehicle data. A lawyer can ask that this evidence be preserved. That is one more reason to act early.

When an Amazon Truck Crash Is Fatal: What Families Can Do Next

Florida law allows families of a person killed in a crash to bring a wrongful death claim. A fatal crash is a deep loss. You don’t have to sort through it alone.

Under Florida law, a death caused by a wrongful act or negligence can make the at-fault party liable for damages. That liability continues even though the injured person died. See § 768.19.

See § 768.20.

Families often take these steps in the first weeks:

  • Request the crash report and keep a copy.
  • Keep records of funeral, medical, and other costs.
  • Write down what you remember and what witnesses said.
  • Ask about deadlines and which evidence to protect.
