Talc is a soft mineral. For decades, it was used in baby powder and other body powders. Some lawsuits ask whether certain talc products were contaminated with asbestos. Asbestos is a mineral fiber. It can cause serious disease.

The lawsuits also ask whether that contamination is linked to ovarian cancer or mesothelioma. Courts are still weighing these claims. This guide explains the basics for Florida families.

What Is Talc?

Talc is a mineral. It feels soft, slippery, and absorbent. Chemically, it is a hydrated magnesium silicate. That means it is a mineral compound that contains water.

Talc is mined from the ground. Then it is processed into the fine, smooth powder used in cosmetics and household products.

Talc comes out of the earth. It can sit near other minerals. That is why questions come up later in these lawsuits. People ask what else is in the ground. They also ask what else ends up in the final product.

Mining and processing can differ from one supplier to another. So the source of a specific product often matters.

Why Talc Ended Up in Baby Powder

Talc works well in powders for three main reasons:

  • It absorbs moisture.
  • It reduces friction.
  • It leaves a smooth feel on the skin.

These qualities made talc a common ingredient in powders for decades.

For many years, talc-based powders were sold as everyday baby and adult body powders in the United States. Parents used them after bathing to keep a baby’s skin dry. Adults used them for the same kind of comfort.

Talc’s role in a product describes how it works. It does not, on its own, show that the product caused harm. The question of harm is separate. That is where the lawsuits focus.

Does Johnson’s Baby Powder Still Contain Talc?

Johnson & Johnson has said it stopped selling its talc-based Johnson’s Baby Powder in the United States and Canada in 2020. The company made that announcement itself. It is the company’s own account. It is not a finding about the product’s safety.

That statement covers only the product it names, in those markets. It does not answer what other formulas were sold. It does not cover other countries or other years. Those are separate questions.

If you have a specific product, these details can matter:

  • The packaging
  • The purchase dates
  • Where you bought it

What Lawsuits Allege About Asbestos in Talc

Asbestos is a group of naturally occurring mineral fibers. It can be found in ground where talc is mined. The main allegation in talc lawsuits is this: talc products were contaminated with asbestos fibers. The lawsuits say people were exposed to those fibers through ordinary use.

These are allegations. Plaintiffs and their lawyers made them in court filings. A court has not made findings on them.

The American Cancer Society says possible asbestos contamination of talc-containing products is a major concern. The United States Pharmacopeia has commented that electron microscopy was not required as the sole testing method for asbestos in talc. Electron microscopy is a method that uses a powerful microscope to examine tiny particles. Testing methods are part of the debate.

Mesothelioma is a cancer linked to asbestos. It usually appears decades after the exposure. A claim depends on where and how the person was exposed.

Asbestos bankruptcy trusts are funds set up by companies that went bankrupt. They may pay claims separately from a lawsuit. Whether a trust applies depends on the exposure facts. Read more on mesothelioma lawsuits.

Is Talc in Baby Powder Safe?

Lawsuits claim that talc used in the genital area caused ovarian cancer. They also claim the talc was contaminated with asbestos. The science on talc and ovarian cancer is not settled.

The U.S. Food and Drug Administration says scientific literature has suggested a possible association between genital talc use and ovarian cancer. An association means two things appear together in studies. It does not prove that one causes the other.

The FDA also says the evidence has not conclusively established a link or its risk factors. The American Cancer Society says the evidence on talc and ovarian cancer is limited.

A critical review hosted on PubMed Central summarizes reported associations and their limits. Its authors conclude that the evidence does not establish that cosmetic talc causes ovarian cancer. These are research views, not court rulings.

So the dated facts are the 2020 discontinuation and these published reviews. Together, they do not give a firm answer about current safety.

Where the Talc Lawsuits Stand

An MDL groups similar cases together in one federal court. Case status changes over time. Any update is accurate only as of its date.

A settlement or offer does not mean a particular reader will be included. It does not mean a reader will receive any amount. It also does not mean a reader has a valid claim. Those depend on individual facts. They include medical records, exposure history, and deadlines.

Talc cases may be referred to, or handled together with, another law firm. CHG Personal Injury Lawyers does not serve as lead counsel in any MDL. Lead counsel is the lawyer or firm that runs the main case for everyone involved.

What Florida Families Should Know

Florida law governs Florida claims. For most negligence and personal-injury lawsuits, Florida’s filing period is two years for causes of action that accrued after March 24, 2023. The filing period is the time limit to file a lawsuit.

Under Florida’s comparative fault rule, in a negligence action, contributory fault chargeable to the claimant diminishes proportionately the amount awarded as economic and noneconomic damages for an injury attributable to the claimant’s contributory fault, but does not bar recovery, subject to subsection (6). Comparative fault means each person’s share of blame is counted. Here is how it works:

  • If a claimant is found more than 50% at fault for his or her own harm in a negligence action, the claimant may not recover any damages. This rule does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence under chapter 766.
  • Under Florida’s comparative fault law, a claimant’s share of fault reduces the amount of damages awarded for the injury, and the statute’s limits on recovery still apply (Fla. Stat. § 768.81(6)).

The claimant is the person making the claim.

For asbestos-related claims, Florida’s asbestos statute sets a different starting point. The clock does not start until the exposed person discovers, or should have discovered, that he or she is physically impaired by an asbestos-related condition.

Families who have lost a loved one may bring a wrongful-death action. Under Florida’s Wrongful Death Act, the decedent’s personal representative brings the action. The decedent is the person who died. The personal representative is the person legally in charge of the estate. The action is brought for the survivors and the estate. Deadlines apply. Contact the firm promptly. Do not assume that time remains.
