Talcum Powder Lawsuit Help in West Palm Beach

A talcum powder lawsuit asks a court to decide two things. Did a talc-based powder cause a serious illness? And who should pay for the harm? Most of these cases involve ovarian cancer.

This page explains what these claims involve. It also covers what to gather and why Florida deadlines matter.

Everything here describes allegations made in lawsuits. None of it is a finding that a product caused an illness.

What a Talcum Powder Lawsuit Alleges

A talcum powder lawsuit alleges that long-term use of a talc product led to a serious illness. Most of these cases involve ovarian cancer. Some involve mesothelioma, a cancer that lawsuits link to asbestos exposure.

Women diagnosed with ovarian cancer after years of using talc-based powder may have questions about a claim. Families of women who have died from the disease may have them too. These families may include a spouse, adult children, or a parent.

What Sources Say About the Ovarian Cancer Question

Lawsuits allege that asbestos-contaminated talc raised the risk of ovarian cancer. The science on that question is not settled.

The U.S. Food and Drug Administration says some scientific literature has suggested a possible link between genital talc use and ovarian cancer. It also says the evidence has not conclusively established a link.

The American Cancer Society says the evidence on talc and ovarian cancer is limited. Lawsuits over talc-containing products allege that possible asbestos contamination is a serious concern. A critical review of perineal talc use concludes the evidence does not establish that cosmetic talc causes ovarian cancer.

Johnson & Johnson is one of the companies named in many of these lawsuits. Allegations in a lawsuit are different from court findings. Case results also change over time. A past result does not predict the outcome of any individual claim.

Some talc cases are handled in federal court as a multidistrict litigation (MDL). An MDL is one combined proceeding that groups related cases together. Other cases are filed in state court. CHG Personal Injury Lawyers is not lead counsel in any MDL.

Florida Deadlines Come First

Florida sets time limits for filing. The limits depend on the type of claim.

Under Fla. Stat. § 95.031, a products liability action must be begun within the filing period, and that period runs from the date the facts giving rise to the claim were discovered, or should have been discovered with the exercise of due diligence.

This is why the date a family learned of a connection can matter as much as the date of use.

Florida also sets an outer limit called a repose period.

Under the same statute, claims over products conclusively presumed to have an expected useful life of 10 years or less are generally barred when the harm arises from exposure to or use of the product more than 12 years after delivery to the first purchaser or lessee who was not engaged in the business of selling or leasing the product or of using the product as a component in the manufacture of another product. The statute also provides that the repose period is tolled for any period during which the manufacturer, through its officers, directors, partners, or managing agents, had actual knowledge that the product was defective in the manner alleged by the claimant and took affirmative steps to conceal the defect (Fla. Stat. § 95.031). That purchaser or lessee must not have been engaged in the business of selling or leasing the product, or of using the product as a component in the manufacture of another product. The statute also says this limit does not apply when a person was exposed to or used the product within that period, but the injury did not appear until after it expired.

These rules are technical, and deadlines apply. Contact our team promptly so we can review the dates in your situation.

Who May Be Able to Bring a Wrongful Death Claim

When a death results from another person’s wrongful act or negligence, Florida law allows a claim. Under Fla. Stat. § 768.16, sections 768.16 through 768.26 may be cited as the “Florida Wrongful Death Act.” Section 768.26 separately provides that attorneys’ fees and other litigation expenses are paid by the personal representative and deducted from the awards to the survivors and the estate in proportion to the amounts awarded to them, but expenses incurred for the benefit of a particular survivor or the estate are paid from their awards.

Under Fla. Stat. § 768.20, the action is brought by the decedent’s personal representative. The decedent is the person who died. The personal representative is the person legally in charge of the decedent’s estate. That person recovers for the benefit of the decedent’s survivors and estate.

Survivors may recover certain medical or funeral expenses they paid. Fla. Stat. § 768.21, describes these.

Florida’s Comparative Fault Rule, in Plain Terms

Comparative fault means each person’s share of blame can affect what they recover (Fla. Stat. § 768.81(6)).

Under Fla. Stat. § 768.81, in a negligence action to which the statute applies, a party found to be more than 50 percent at fault for his or her own harm may not recover any damages. Fla. Stat. § 768.81 reads: “This subsection does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766.”

The same statute says this rule does not apply to personal injury or wrongful death claims arising out of medical negligence under chapter 766.

Fault questions can shape a case. Bring your records and questions to the first consultation.

What to Gather Before You Call

The most useful papers show three things. They show what product was used, when it was used, and what illness followed. Gathering them helps. But do not delay your call while you search.

  • Medical records: diagnosis reports, pathology results (lab findings on tissue), treatment summaries, and surgery or oncology notes.
  • Family claims: a death certificate and any autopsy report.
  • Purchase history: receipts, bank or card statements, online order confirmations, and photos of bottles or packaging that show the product name.
  • Usage timeline: the years of use, how often it was used, who else in the home used it, and when symptoms or the diagnosis came.
  • Contact details: names of close relatives, the patient’s or decedent’s date of birth, and the treating hospital or clinic.

Keep any remaining product and packaging. Medical questions belong with your doctors. Keep following their care plan.
