Talc bankruptcy ovarian cancer claims are court fights over whether a company can resolve many lawsuits through bankruptcy. These fights can change how and when individual claims move forward. This guide explains the basics in plain language for Florida women and their families.
What the Talc Bankruptcy Fight Is About
A talc bankruptcy fight is a dispute over whether a company can use bankruptcy court to resolve lawsuits claiming its talc products caused ovarian cancer. Talc is a soft mineral. It is a main ingredient in many baby powders and some other personal-care products.
Lawsuits allege that some talc products were contaminated with asbestos, and that this exposure led to ovarian cancer in some women. These are allegations made in lawsuits. They are not findings of fact. Johnson & Johnson has said it disputes these claims.
The science is still unsettled. The U.S. Food and Drug Administration says some studies suggest a possible link between genital talc use and ovarian cancer. It says that evidence has not conclusively established a link.
The American Cancer Society calls the evidence on talc and ovarian cancer limited. It also calls possible asbestos contamination a major concern.
Bankruptcy matters because it is a court process that can change how many claims get resolved, and when. Two questions sit at the center. Who is responsible for these claims? And is bankruptcy court the right place to resolve them?

How Johnson & Johnson’s Talc Bankruptcy Filings Developed
The talc bankruptcy history started with a subsidiary filing in 2021. It has involved more than one case.
In October 2021, a subsidiary called LTL Management LLC filed for Chapter 11 bankruptcy. Chapter 11 is a court process for reorganizing debts. The filing moved the talc claims into bankruptcy court.
In 2023, the Third Circuit Court of Appeals dismissed that first case. The dismissal ended that bankruptcy, and the talc claims went back to other courts.
In September 2024, a different subsidiary, Red River Talc LLC, filed a Chapter 11 case in Texas. Its filing proposed a plan to resolve talc claims.
A proposal is not a final payment plan. Court approval and the plan’s terms would still control what happens.
How the Courts Have Ruled on the Talc Bankruptcy Disputes
A bankruptcy judge dismissed the Red River Talc case in March 2025. That ruling sent talc claims back to the civil court system.
After a dismissal, claims can proceed in ordinary lawsuits. Appeals and later rulings may follow, and they can change the picture. Juries have also reached different results in individual talc trials.
Many talc cases are also grouped in federal court in New Jersey. This is called a multidistrict litigation, or MDL. An MDL places similar federal cases before one judge for early pretrial steps. Individual cases can still move separately, and each one has its own facts and timeline.
CHG is not lead counsel in any MDL. These cases may be referred to, or handled together with, another law firm.
What a Bankruptcy Filing Can Do to an Individual Ovarian Cancer Claim
If a company involved in your case has filed for bankruptcy, that can affect how claims against it are handled, and a lawyer can explain how it may apply to your situation. It can also change how claims are resolved and paid.
That pause can last a long time. The pause is one reason timelines can be hard to predict.
A bankruptcy plan may propose a trust or a separate claims process. Terms vary from plan to plan. A plan may resolve claims outside a lawsuit, so the details matter.
Federal law also addresses what a bankruptcy discharge does. 11 U.S.C. § 524 describes the effect of a discharge, including an injunction against certain actions to collect debts.
Delays can affect when a claim is resolved. Keep your records in one place. Follow your doctors’ care and treatment plan.

What Settlement Proposals Do and Do Not Mean for You
A settlement proposal is an offer or a court filing. It is not an automatic payment to every person with a claim.
Eligibility, paperwork, and amounts depend on the plan’s terms and on each person’s facts. No one can promise a payment or an amount. Some settlements also set deadlines for submitting proof. Do not wait to learn your status.
Families of a woman who has died have additional protections. Florida’s wrongful death statute, Fla. Stat. § 768.19, makes a person who causes a death through wrongful act or negligence liable for damages. Under § 768.25, while a wrongful death action is pending, a settlement as to amount or apportionment among the beneficiaries is not effective unless the court approves it if a survivor objects to it or if it affects a survivor who is a minor or incompetent.
Florida Deadlines and Steps to Protect a Talc Claim
Florida sets filing deadlines, and the general deadline for negligence claims is two years under § 95.11.
Product claims follow their own timing rules. Under § 95.031, a products liability action runs from when the facts were discovered, or should have been discovered with reasonable diligence. Florida also sets outer limits for certain products, so timing should be reviewed early. Florida’s § 768.1257 directs the finder of fact, in an action based upon defective design brought against the manufacturer of a product, to consider the state of the art of scientific and technical knowledge and other circumstances that existed at the time of manufacture, not at the time of loss or injury.

Frequently Asked Questions
What is a talc bankruptcy, and how does it affect ovarian cancer claims?
A talc bankruptcy is a court process in which a company that faces talcum powder lawsuits asks the court to resolve those claims together, often through a trust that could pay claimants. The lawsuits allege that talc contaminated with asbestos caused ovarian cancer, and those allegations have not been proven in court.
Does a company’s bankruptcy filing end my right to bring a talc claim?
A bankruptcy filing does not automatically end your claim, but it can change how and where claims are handled, and it can affect how long you have to act. Florida deadlines still apply, so you should speak with a lawyer promptly to learn your options.
Can I still pursue a talc ovarian cancer claim if the company has filed for bankruptcy?
Possibly. Whether and how you can pursue a claim depends on your medical history, how and when you used talc products, and the current status of the bankruptcy case, which can change over time. A free, confidential consultation with no obligation to continue can help you understand your situation.
What should I do now if I believe talcum powder use may have caused my ovarian cancer?
Follow your doctors’ care first, then keep records of the products you used, how long you used them, and your medical reports. Contact our team as soon as possible, because deadlines apply, and our lawyers do not charge attorney’s fees or case costs unless there is a recovery.
