Talcum Powder Lawsuit: Can It Be Referred to Another Firm?

Talc-related lawsuits are sometimes referred to, or handled together with, another law firm. Here is what that can mean for you, and how CHG Personal Injury Lawyers can help you understand your options.

Talcum Powder Lawsuits in Florida: Referrals, Deadlines, and Next Steps

Can a talcum powder lawsuit be referred to another firm? Yes. It can also be handled together with one. Which arrangement applies depends on the case.

If you or a family member used baby powder or another talc-based powder and were later diagnosed with ovarian cancer, you may be asking two questions. Who will handle the claim? Will that firm stay involved? This page answers both in plain language.

Can a Talcum Powder Lawsuit Be Referred to Another Firm?

Yes. A referral means one firm passes a matter to another firm. Or two firms share the work on one case.

When a matter may be referred, we say so openly, and we say it before you agree to anything. You can ask who will handle your claim at any point.

Under a referral, you should know who is responsible for your case. A local Florida firm may also stay involved, even when another firm leads the work. We will explain these arrangements to you in writing before anything moves forward.

What Talcum Powder Lawsuits Allege

Lawsuits allege that talc-based powder contained asbestos and that this caused ovarian cancer. These lawsuits include claims about Johnson & Johnson’s baby powder.

These are allegations made in lawsuits. They are not findings that a court has made.

The science is still debated, and the sources do not all say the same thing. The FDA’s talc information says studies have suggested a possible link between genital talc use and ovarian cancer. It also says the evidence has not conclusively established a link. The American Cancer Society’s ovarian cancer fact sheet notes that the evidence is limited. It also calls possible asbestos contamination of talc products a major concern. A critical review of perineal talc use concludes that the evidence does not establish that cosmetic talc causes ovarian cancer.

Whether talc played a part in one person’s illness is a medical question. If a case moves forward, evidence decides it. Medical and scientific witnesses from both sides may testify.

If You Used Baby Powder: What to Gather Now

Many readers come to this page after years of using baby powder and a later diagnosis. Others are worried about a family member who has been ill or has died. Early, simple steps help build a timeline:

  • Write down which powder was used, the brand if you know it, and roughly how many years it was used.
  • Keep receipts, old containers, and packaging.
  • Save doctors’ notes, test results, and discharge papers.
  • Note when symptoms started and when the diagnosis was made.

You do not need perfect records to call us. Start with what you have.

Why Talc Cases Are Often Referred or Handled Together

Talc cases often involve many people, long timelines, and detailed medical and scientific records. Some claims are handled in federal multidistrict litigation (MDL). An MDL groups similar cases in one court. Firms sometimes join forces to share the work of gathering records and reviewing evidence.

Testing is part of the picture. The United States Pharmacopeia’s comments on FDA asbestos testing discuss the methods used to test for asbestos in talc. Electron microscopy was not required as the only testing method.

CHG Personal Injury Lawyers does not claim to be lead counsel in any MDL. A talc case may be handled with another firm, and we will tell you who is responsible for your case.

Talc and Mesothelioma Are Separate Topics

Talc and mesothelioma are often mentioned together, but they are different matters with different facts.

The talc claims described above concern ovarian cancer that lawsuits link to talc-based powder. Mesothelioma is a cancer tied to asbestos exposure. It usually appears decades after the exposure. A mesothelioma claim turns on where and how the person was exposed, such as at work, in military service, or at home. Asbestos bankruptcy trusts may pay claims separately from a lawsuit.

A talc claim does not work the same way. Do not assume one applies to the other.

Deadlines: Why Timing Matters in Florida

Florida sets time limits for filing personal injury lawsuits. These rules appear in Florida Statutes § 95.11.

For product claims, Florida Statutes § 95.031 says a products liability action under section 95.11(3) must be begun within the period prescribed in that chapter. The period runs from the date the facts giving rise to the cause of action were discovered, or should have been discovered with the exercise of due diligence. It does not run from other dates in section 95.11(3), except as that subsection provides.

The same section also sets an outer limit. The statute states that all products, except those in its listed exceptions, are conclusively presumed to have an expected useful life of 10 years or less.

Because of this rule, when a product was first sold can matter, even if an illness is diagnosed much later. Do not assume a claim is still open because a diagnosis is recent. Whether this outer limit affects a specific claim depends on the product, its first sale, and when the exposure occurred.

These rules are detailed, so the timeline should be reviewed from the start. Deadlines apply. Contact us promptly, while your records are still fresh.

How a Referral Works, Step by Step

Here is what to expect, from first contact to evaluation:

  1. Contact us. Describe the diagnosis, the powder used, and the years of use, in your own words.
  2. We review what you share. We tell you whether we can handle the matter. We also tell you if it may be referred or handled with another firm.
  3. Terms are explained in writing. Any referral or shared work is explained before anything moves.
  4. Records are gathered. This may include medical records, product history, purchase dates, and a timeline of use and illness.
  5. The case is evaluated. Timing depends on the facts of each case and on court schedules. No result can be promised.
