What Mesothelioma Is and Who an Asbestos Claim May Help

Mesothelioma is a cancer. It forms in the thin lining that covers the lungs, the abdomen, or the heart.

The disease is linked to asbestos. Asbestos is a group of minerals. People once used it in insulation, building materials, and many industrial products. The Agency for Toxic Substances and Disease Registry describes the link between asbestos and this disease.

The disease usually shows up long after the exposure. The gap can be 30 to 40 years. Shorter gaps do happen. Published research on short-latency mesothelioma explains this. Because the wait is so long, families often trace work and home history back many years.

This page is for patients, spouses, adult children, and other relatives. It is also for anyone asking whether a past exposure may support a claim.

This page is general information. It is not medical advice. Please follow the care plan set by your own doctors.

What a Mesothelioma Claim Can Include

A claim may seek compensation from the parties whose conduct led to the exposure. The source of the exposure and Florida law decide which paths apply. Several paths may exist for the same family.

  • Lawsuits. A lawsuit may name companies whose products or job sites exposed a worker. Florida law says punitive damages may not be awarded in a civil action alleging an asbestos claim. Punitive damages are extra damages meant to punish the wrongdoer.
  • Asbestos bankruptcy trusts. Some companies facing asbestos claims set up trusts to pay them. A trust is a fund set aside for this purpose. Federal bankruptcy law addresses asbestos-related debtors and claim payments.
  • Take-home exposure. Family members can breathe in asbestos fibers. The fibers can be carried home on a worker’s clothing or tools. Each case turns on how the exposure happened.
  • Wrongful death. When a loved one has died, a Florida wrongful-death action is brought by the decedent’s personal representative for the benefit of the survivors and estate. This is a case brought after a death caused by someone else’s wrongdoing. Sections 768.16-768.26 may be cited as the Florida Wrongful Death Act.

How Asbestos Exposure Is Traced: Where and How

A claim turns on the details of the exposure. The job, the work site, the products used, and the dates all matter. Who else was present matters too.

Memory alone often isn’t enough. Records help fill the gaps.

Common exposure settings include:

  • Shipyards
  • Construction and building trades
  • Industrial plants
  • Military service

The Occupational Safety and Health Administration states that occupational asbestos exposure increases the risk of mesothelioma. It also states that these diseases have a delayed onset. In other words, they appear long after exposure.

Veterans should know that federal veterans’ benefits claims are a separate process from the firm’s personal injury work. Under one federal provision, compensation may be available for a disease contracted in line of duty during a period of war, to a veteran discharged or released under conditions other than dishonorable. However, the law excludes disability from willful misconduct or abuse of alcohol or drugs.

Household exposure can happen in two main ways. One is washing a worker’s clothing. The other is renovating older buildings.

Before a consultation, gather these details:

  • Jobs and employers, with approximate dates
  • Work sites and the type of work done there
  • Names of coworkers or supervisors who may recall conditions
  • Military records, if any
  • Medical records and pathology reports (lab reports from tissue testing)

Don’t wait until your research is finished to call. The firm can help identify which records are needed.

How the Process Works, Step by Step

Most matters begin with a free, confidential consultation. The timeline depends on the facts, the records, and the number of possible sources. Here is what to expect.

  1. Initial consultation. You share your diagnosis history and your exposure history. You can do this by phone or, if you prefer, in person at the firm’s Coral Gables office.
  2. Record review. The firm reviews medical reports, work history, and exposure details. The goal is to find possible sources.
  3. Claim paths. The firm explains your options. These may include a lawsuit, a trust claim, or both. In asbestos or silica lawsuits, Florida requires a verified report of collateral source payments filed when the complaint is filed. The report must disclose the total collateral source payments received, including payments the plaintiff will receive in the future, and be updated during the case. This is a sworn report.
  4. Filing or negotiation. Depending on the matter, the firm may file, negotiate, or prepare for court, or may work with co-counsel on a referred case.

Florida has its own timing rules for asbestos claims. Under Florida law, for asbestos claims not barred as of the effective date of the act, the clock generally starts when the person discovers, or should have discovered, a physical impairment from an asbestos-related condition. Florida also treats a nonmalignant asbestos condition and an asbestos cancer as separate claims.

Deadlines still apply. Contact the firm promptly.

Where Asbestos Exposure Can Happen

Workplace Exposure

Many people worked around asbestos-containing materials in construction, shipyards, plants, and other industrial settings. Exposure may have happened years or decades earlier.

Military Service

Asbestos was once common in military ships, barracks, and equipment. Veterans and their families often ask how past service may relate to a diagnosis.

Take-Home Exposure

Family members can be exposed through asbestos fibers carried home on work clothing or tools. Each family's facts are different, and we review how the exposure happened.

Asbestos Bankruptcy Trusts

Some companies that used asbestos have set up bankruptcy trusts that may pay claims separately from a lawsuit. Whether a trust claim is available depends on the facts of each case.

Act Promptly

Deadlines apply to asbestos and mesothelioma claims, and records about past jobs, locations, and medical care can be hard to find over time. Contact our firm promptly so we can review your situation while the details are still fresh. Follow your doctors' care at all times.
