Who a Mesothelioma Claim Is For
A mesothelioma claim may belong to the person who was diagnosed. It may also belong to the family of someone who has died from it.
Mesothelioma is a rare cancer. It affects the thin lining around the lungs, chest, or abdominal cavity (the belly area). ATSDR links it to asbestos.
Most cases trace back to asbestos fibers. The person breathed in or swallowed these tiny fibers years earlier.
Several people may have a claim:
- The patient, for harm caused by asbestos exposure.
- Surviving family members, when the patient has died. Florida’s rules for these cases are part of the Florida Wrongful Death Act.
- People exposed secondhand, such as a spouse or child. They came into contact with asbestos dust carried home on a worker’s clothing.
Under Florida law, the decedent’s personal representative (the person authorized to manage the deceased person’s estate) brings the wrongful death case. The case is for the survivors and the estate (§ 768.20).
Each parent of a deceased minor child may also recover for mental pain and suffering (§ 768.21).
Grief and fear often come first. Take this guide one section at a time. Keep your doctors’ care at the center of every decision.

How Asbestos Exposure Happens in Palm Beach County
Exposure usually happens at work. It can also happen during military service or at home, through a worker’s clothing.
A claim depends on where, when, and how the person was exposed.
The Occupational Safety and Health Administration states that occupational asbestos exposure increases the risk of lung cancer and mesothelioma. These diseases have a delayed onset. They can take years to appear.
Trades often tied to asbestos claims include construction, insulation, shipyards, and refineries.
Timing is a big part of these cases. ATSDR reports that signs of asbestos-related disease may have a latency period (the time between exposure and the first signs of illness) of 30 to 40 years. That gap is why a diagnosis can come decades after exposure.
ATSDR also notes that exposure to amphibole asbestos (a type of asbestos with needle-like fibers) is associated with an increased risk of mesothelioma.
Key questions help build the timeline:
- Where did the person work, and for which employers?
- What job sites, products, or tasks involved asbestos?
- Who controlled the worksite or the product?
- Did a family member bring dust home on work clothes or tools?
Take-home exposure (asbestos dust carried home on work clothing or tools) is its own kind of claim. A spouse or child exposed at home may have a claim of their own. The facts decide whether it applies.
Florida Claim Deadlines: When the Clock Starts
Florida sets filing deadlines by statute. Missing one can bar a claim.
Treat every deadline as urgent. Contact a lawyer promptly.
Florida’s general time limits for filing (called limitations periods) are set out in § 95.11.
Asbestos cases follow a special rule. The person’s health must also be physically impaired (harmed) by it. For asbestos claims, the time limit does not start until the person discovers, or with reasonable diligence should have discovered, that they are physically impaired by an asbestos-related condition (§ 774.206).
This rule fits a disease that appears decades after exposure.
Florida also treats a nonmalignant asbestos claim (one not involving cancer) as separate from a claim for asbestos-related cancer. Damages cannot be awarded for fear or risk of cancer in an asbestos claim (§ 774.206(2)).
Florida also has a repose period. This is an outer time limit that starts from a set date, not from discovery. It does not apply if the person was exposed within that period and the injury showed up only after it ended (§ 95.031(2)(c)).
Wrongful death claims have their own timing. A family’s deadline can differ from the patient’s. Ask for a review as soon as possible.
Asbestos Bankruptcy Trusts and Other Ways to Recover
Some companies that made asbestos products went through bankruptcy. Some of these companies set up trusts to pay asbestos injury claims. A trust claim can run separately from a lawsuit.
Federal bankruptcy law contains separate rules for companies in reorganization that face asbestos injury claims.
Trust claims have their own forms, documents, and deadlines. A lawsuit and a trust claim can both be part of the picture.
Lawsuits follow their own rules. Florida bars punitive damages (extra damages meant to punish a defendant) in asbestos claims (§ 774.207(1)).
The plaintiff (the person bringing the case) must also file a verified written report. This is a sworn report. It discloses the total amount of collateral source payments received, including future payments, as a result of settlements or judgments on the same claim (§ 774.207).
Veterans may have a separate path. Military records often matter for proving exposure.
Some asbestos cases may be referred to, or handled together with, another law firm. If your matter fits that pattern, we will tell you clearly.

What a Strong Claim File Usually Includes
A strong file starts with the diagnosis, a clear work history, and a written account of exposure. Gather what you can now. Let your doctors guide your medical care.
- Medical records and the pathology report (the lab report on tissue samples). Ask your doctors’ offices for copies.
- Work history, including employers, job sites, dates, and job roles.
- Military service records, where they relate to exposure.
- Household details for take-home claims: the family member’s job, years living together, and contact with work clothing or tools.
- Witnesses, such as coworkers or family members who remember the job site.
- Photos, union or pension records, and product labels or invoices the family still has.
Write down what you remember today. Include names, years, places, and tasks. Memories fade. These details often help build the timeline.
Next Steps: How the Process Works
The process starts with a first consultation. Next comes a records review and a filing decision. Then comes negotiation or a lawsuit.
Each step depends on the diagnosis, the exposure history, and the deadlines involved.
- First consultation. You share the diagnosis, your work and home history, and any documents you have.
- Records review and exposure investigation. The team identifies employers, products, job sites, and any trust claims that may apply.
- Filing decision. The decision reflects Florida deadlines and your facts. A lawsuit, a trust claim, or both may be considered.
- Negotiation or litigation. Timelines vary from case to case. We explain each stage as it happens.
