Mesothelioma Lawyer Hialeah: Claims for Families Throughout Florida
CHG Personal Injury Lawyers helps people diagnosed with mesothelioma. Mesothelioma is a rare cancer linked to asbestos. Hialeah families can contact the firm. The firm also helps families of people who died from it.
The firm works to learn whether a claim may exist.
The firm is based in Florida. Igor Hernandez is the responsible attorney. He is a licensed attorney admitted to The Florida Bar.
A mesothelioma diagnosis changes a family’s whole world. Many Hialeah families also ask a hard question. Where did the asbestos come from? Could past work or a home project support a claim?
This page explains how that question is reviewed.
The firm focuses on personal injury cases of every severity. That includes catastrophic injuries, wrongful death, and asbestos-related mass-tort claims. A mass-tort claim is a lawsuit brought by many people harmed by the same product or company.
The firm also publishes educational content in Spanish and English. Families can ask questions in either language.
The first consultation is free and confidential. There is no obligation to continue.
What Mesothelioma Is and Why It Can Appear Decades Later
Mesothelioma is a rare cancer. It affects the thin membranes that surround the lungs, chest, or abdominal cavity. The abdominal cavity is the space that holds the stomach and intestines.
The Agency for Toxic Substances and Disease Registry (ATSDR) links it to asbestos exposure.
The timing surprises most families. ATSDR states that signs of mesothelioma may appear 30 to 40 years after asbestos exposure. A diagnosis today can point back to a job or a building from a generation ago.
The Occupational Safety and Health Administration (OSHA) also notes that asbestos-related diseases have a delayed onset. Some cases appear sooner. The gap between exposure and illness varies.
Follow your doctors’ care and treatment plans. A claim is a separate question from medical treatment.
Asbestos Exposure in Hialeah: Jobs, Buildings and Renovations
A claim usually turns on where and how a person was exposed. Asbestos is a fiber. It was once used in many building materials. In Hialeah, families most often describe situations involving work and older buildings.
- Construction and demolition work. Crews often disturb old materials when they cut, tear out, or haul debris.
- Trades. Insulation, roofing, plumbing, and electrical work can bring workers into contact with asbestos-containing materials.
- Older commercial and industrial buildings. Maintenance, repair, and remodeling in aging structures can release fibers.
- Home renovations. Removing old floor tiles, drywall, pipe insulation, siding, or roofing from an older home can disturb asbestos.
Families also face take-home exposure. This happens when asbestos fibers cling to work clothing, shoes, or tools. A spouse, child, or other relative who washed or handled those items may have been exposed too.
Renovation rules matter. One fact a review may examine is whether the property was thoroughly inspected for asbestos before demolition or renovation began.
How a Claim Is Reviewed: Past Jobs and Renovations
A diagnosis alone does not decide a claim. The review focuses on the exposure history. This is the story of where and how the person came into contact with asbestos.
The review usually includes these steps:
- A consultation in Spanish or English. The family describes the illness and the work history.
- A written timeline of jobs, employers, job sites, and dates.
- A residence history, including homes and buildings that were renovated or repaired.
- Renovation details, such as when work happened and what materials were removed.
- Names of co-workers or family members who can describe the exposure.
- Medical records and pathology reports (lab reports that document the diagnosis), gathered with the client’s permission.
Once the facts are gathered, the firm explains what the records and history support. The firm does not promise a particular result. Every case depends on its own facts.

Lawsuits and Asbestos Bankruptcy Trusts: How Claims Can Proceed
Some asbestos claims are filed as lawsuits. These lawsuits name the companies whose products or work sites are alleged to have caused the exposure.
Florida law also limits some of these claims. For example, Fla. Stat. § 774.004 caps the successor asbestos-related liabilities of a corporation. In plain terms, a successor liability is a debt that passes to a company that took over another company.
Under that section, the total successor asbestos-related liabilities of a corporation are limited. The limit equals the fair market value of the transferor’s total gross assets. That value is measured at the time of the merger or consolidation (when companies combine). The corporation has no responsibility for liabilities above that limit. A further limit applies in some situations involving an earlier merger.
Many companies that made asbestos products have gone through bankruptcy. Some set up asbestos bankruptcy trusts. These trusts are funds that may pay claims separately from a lawsuit.
Federal bankruptcy law explains what a discharge does to debts. A discharge is the court order that clears certain debts in bankruptcy. The rule is described in 11 U.S.C. § 524.
The right path depends on the exposure history and the companies involved.
Some mesothelioma cases may be referred to, or handled together with, another law firm. The firm will explain any referral before work begins.
What to Expect: Steps After You Call
Here is how the process usually works.
- Free, confidential first consultation. You can speak in Spanish or English. There is no obligation to continue.
- Review of exposure history. The firm reviews work and residence history, renovation dates, medical records, and possible companies or trusts.
- Your options. Every case is different. The details of your situation matter. The firm also explains the filing deadlines that apply.
- Pursuit of the claim. The firm keeps the family informed. Settlements and verdicts are described only as of the date and source reported.
CHG charges no attorney’s fees and no case costs unless there is a recovery.
Florida sets filing deadlines in its statutes. They can be shorter than many families expect.
Under Fla. Stat. § 774.206, a limitations period (the time limit for filing) applies to an asbestos claim not barred as of that act’s effective date. That period does not begin to run until the exposed person discovers, or with reasonable diligence should have discovered, that he or she is physically impaired by an asbestos-related or silica-related condition.
The general timing rules are in Fla. Stat. § 95.11. Early contact helps protect evidence and options.

Frequently Asked Questions
Can I still file if the exposure happened 40 years ago?
Florida deadlines apply. Timing depends on when the illness was discovered, or should have been discovered. Contact the firm promptly so the facts can be reviewed.
Can a spouse or child make a claim for exposure from a worker’s clothing?
Take-home exposure can happen when asbestos fibers ride home on work clothing, shoes, or tools. Whether a claim exists depends on the facts of each family’s situation.
What if the company that made the product no longer exists?
Some companies have set up asbestos bankruptcy trusts. These may pay claims separately from a lawsuit. The review considers the companies and trusts involved.
Can a family bring a claim after a loved one’s death?
Florida’s wrongful death law can allow a family to pursue a claim when a death is caused by a wrongful act or negligence. The right of action is stated in Fla. Stat. § 768.19. The damages a family may recover are set out in Fla. Stat. § 768.21.
A surviving spouse may recover for the loss of the person’s companionship and protection. A spouse may also recover for mental pain and suffering. Minor children may recover for lost parental companionship, instruction, and guidance.

Where Asbestos Exposure Can Happen
Workplace Exposure
Many people were exposed on the job in shipyards, construction sites, plants, refineries, and other workplaces where asbestos materials were common.
Military Service
Veterans may have been exposed aboard ships, in engine rooms, or at bases where asbestos-containing materials were used.
Take-Home Exposure
Asbestos fibers can ride home on a worker's clothing, shoes, or tools. Spouses and children may have been exposed without ever setting foot at the job site.
Home and Property Exposure
Exposure can also occur during renovations, repairs, or contact with older building materials, which is why a full history matters.
