It is not the final answer.

Many FedEx Ground drivers work for independent contractor businesses rather than being contractors themselves. These businesses hold delivery contracts. They often employ the drivers themselves.

The title can change who gets named in a claim. It does not end the inquiry. If you were hurt, or a family member died, the first questions are factual:

Who was driving?

Who owned the van or truck?

Who set the route and the schedule?

Families often handle these questions while managing hospital visits, missed paychecks, and calls from insurers. That is a heavy load. You do not have to sort it out alone. A first conversation can help separate the facts that matter from the rest.

Who Can Be Held Responsible in a Florida FedEx Contractor Crash

Several parties may face claims. The driver, the contractor business, and, in some cases, FedEx entities can each be part of a case.

The driver, for careless or unlawful driving. This includes speeding, distraction, impairment, or failing to yield.

The contractor business, which often hires, trains, and assigns the driver. It may also own or operate the vehicle.

FedEx entities, reviewed on the facts of control, branding, uniforms, dispatch, routing, and vehicle markings.

Whether a driver was working for a company can be an important question. “Agency principles” are the legal rules for when one party acts on behalf of another. A contract label is only one factor.

Federal rules also place duties on the motor carrier. A motor carrier is the company that operates the commercial vehicle. The motor carrier must require its drivers to follow the driving duties and prohibitions that apply to them (49 C.F.R. § 390.11).

The Documents That Can Show Who Controlled the Truck

Paperwork can show how a delivery was set up. Each document below can matter. But none of them tells you in advance what it will show.

The written lease. Federal rules require a written lease when a carrier operates equipment it does not own. The reports may be made available to the parties involved, their legal representatives, their licensed insurance agents, their insurers, and other listed persons and agencies. The conditions in that section still apply.

Legal Claims That Often Arise From a Contractor Driver Crash

Most claims fall into a few groups:

Negligent driving: speeding, distraction, impairment, or failing to yield.

Negligent hiring, training, and supervision: whether the company checked the driver’s qualifications and safety record, and whether it acted when problems appeared.

Vehicle maintenance: whether the company kept the vehicle in safe repair.

Improper loading and securement: whether cargo was loaded and secured safely.

Some claims target the driver. Others target the company that chose, trained, or oversaw the driver. The records described above help show what a careful company was expected to do.

How Florida’s Negligent-Hiring Presumption Works, and Where It Stops

Florida has a statute on negligent hiring, Fla. Stat. § 768.096.

In a civil action for injury or damage to a third person caused by an employee’s intentional tort, this statute presumes an employer was not negligent in hiring the employee if the employer conducted a background investigation that revealed nothing showing the employee was unsuitable. That applies when the employer completed the background investigation the statute describes and the investigation did not reveal any information that reasonably demonstrated the prospective employee was unsuitable for the particular work or for employment in general.

But the statute is written for civil actions based on an employee’s intentional tort. An intentional tort is a wrong done on purpose. A claim that a driver drove carelessly is a negligence claim.

What a Recent Federal Case Shows

A recent federal case involved a state-law negligent-hiring claim against a freight broker. A freight broker arranges shipments with trucking companies.

The broker had selected an unsafe motor carrier. Federal law can sometimes block a state-law claim. Blocking a claim in this way is called preemption.

The case involved a broker, not FedEx. It shows how courts treat these claims (Montgomery v. Caribe Transport II).

Insurance Limits Are a Floor, Not a Payout

Federal law sets a minimum level of financial responsibility for motor carriers that transport property. Financial responsibility means the insurance or coverage a carrier must have.

That is a required minimum. It is not a description of what any particular policy covers. Nothing in this guide implies a specific FedEx policy or payout.

Evidence That Can Disappear After a FedEx Truck Accident

Key records can be lost. Video can be overwritten on a schedule. Early action protects what matters most.

Electronic logging device (ELD) data. An ELD is a device that records a driver’s work and rest hours. Federal ELD rules apply only to certain commercial motor vehicles, so these records may not exist in every case.

GPS and telematics, which can show speed, hours, and braking.

Dash camera and nearby video from businesses or traffic cameras.

Dispatch, delivery, driver qualification, and maintenance records.

The police crash report, described above.

Photos and witness contact information from the scene.

Two common mistakes can hurt a case:

Waiting weeks to request records.

Giving a recorded statement to an insurer before getting advice.

A written request to preserve evidence, sent early, helps protect these records. “Preserve” means keeping records from being deleted or lost.

Have questions about what happened?

Ask our team directly. Deadlines apply. That is why prompt review matters.

Filing deadlines. Deadlines apply to lawsuits. Contact the firm promptly.

Shared fault. Florida’s comparative fault statute says that fault chargeable to the injured person “diminishes proportionately the amount awarded” for the injury, but a person found more than 50 percent at fault for their own harm may not recover any damages (Fla. It “does not bar recovery, subject to subsection (6)” (Fla. Stat. § 768.81).

The same statute says the court enters judgment against each liable party based on its percentage of fault.

So how fault is divided matters.

Shared liability among defendants. Florida’s contribution statute addresses how two or more people liable for the same injury may share that liability with one another (Fla. Stat. § 768.31).

Florida’s personal injury protection (PIP) rules and other insurance terms can also affect a claim. PIP is a type of no-fault coverage. Medical records matter here. Follow your doctors’ care.

If a crash causes a death, Florida law allows the family to bring a wrongful death claim. This is a claim brought after a loss of life. The claim can be brought against the party who would have been liable had the death not occurred.

For Families Facing a Death or Catastrophic Injury

When a crash causes a death or a life-changing injury, the family’s first days can feel impossible. You do not have to make every decision at once.

Some families start by gathering the crash report. Others write down what they remember while it is fresh. Some ask the people who were there for their names and contact information. Others ask that all insurer calls go through their lawyer.

Whatever your situation, the next step is one you can take at your own pace.

What to Expect: The Process From First Call to Resolution

The process usually starts with a free, confidential consultation.
