Many families then face a second worry: how the lawyer gets paid, and whether they could end up owing money if the case does not succeed.

This guide explains how talcum powder lawsuit fees generally work in Florida and what you would and would not be asked to pay. It also explains the Florida rules that shape what a claim can recover and when it must be filed. It does not promise any amount, result, or timeline, because each case turns on its own facts.

Follow your doctors’ care while you think this through. If you want to talk about your own situation, request a free consultation and ask us to explain the fee terms first.

What a Talcum Powder Lawsuit Alleges

A talcum powder lawsuit alleges that talc products, including baby powder, were linked to ovarian cancer because the talc was contaminated with asbestos. These are allegations. A court has not decided them for any reader’s case.

Talc is a mineral used in body powders. People who file these lawsuits claim that some talc products contained asbestos and that this exposure contributed to their cancer.

The science is not settled. The U.S. Food and Drug Administration says some studies suggest a possible link between genital talc use and ovarian cancer, but the evidence has not conclusively shown a link. The American Cancer Society describes the evidence as limited and names possible asbestos contamination as a major concern.

Lawyers usually look at people diagnosed with ovarian cancer who used talc-based powder products. Family members of people affected may also be considered. Whether someone fits turns on medical records, product history, and deadlines. Talc matters are one of many case types the firm handles. They may be referred to, or handled together with, another law firm. If that happens, the written agreement will say so.

How Contingency Fees Work, Explained Simply

Under a contingency arrangement, the lawyer’s fee comes from money recovered in the case. It is not paid out of your pocket at the start.

You do not write a check to begin the work. The fee is a share of a recovery, and the written agreement states the percentage. This arrangement is common in personal injury cases.

Fees and case costs are different. Case costs are expenses such as medical records, filing charges, and testing. Your written agreement with the firm should state that you owe no attorney’s fees and no case costs unless there is a recovery.

Ask these questions about any written fee agreement:

What percentage applies, and is it figured before or after case costs?

Do I owe attorney’s fees or case costs if there is no recovery?

When are fees and costs due, and from what money?

How are medical bills and insurance payments handled from a recovery?

Will another law firm work on the case, and how would fees be divided?

Read the answers in writing before you sign anything.

What You Would Not Pay

CHG charges no attorney’s fees and no case costs unless there is a recovery. If there is no recovery, you would not owe the firm a fee or case costs.

Medical bills are a separate issue, and Florida law addresses them directly. Florida law defines a letter of protection as an arrangement in which a health care provider treats you in exchange for a promise of payment for the claimant’s medical expenses from any judgment or settlement of a personal injury or wrongful death action. That arrangement is between you and your provider. It is not the firm’s fee.

Under that same statute, before claiming medical expenses for treatment under a letter of protection, the claimant must disclose whether they were referred for that treatment and, if so, the identity of the person who made the referral. If the referral was made by the claimant’s attorney, that referral may be disclosed, and it is admissible as evidence. This is one reason to ask, early, how any treatment was arranged.

Insurance payments also affect a recovery. Under Florida’s collateral sources rule, the court reduces an award by the total of amounts paid for the claimant’s benefit or otherwise available from collateral sources. There is no reduction for collateral sources that hold a subrogation or reimbursement right. The statute also says benefits received under Medicare or Medicaid are not considered collateral sources. Your insurer’s and providers’ rights should be reviewed before any money is divided.

Talk with your own doctors and a financial advisor about your bills. Bring these questions to your first conversation with us so the fee and bill terms are explained together.

How Florida Law Affects What a Claim Can Recover

Fee terms are only part of the picture. Florida rules also shape how a recovery is calculated, and families should understand them early.

Fault can be divided among several companies. When more than one company may share responsibility, Florida law provides that in a negligence action the court “shall enter judgment against each party liable on the basis of such party’s percentage of fault and not on the basis of the doctrine of joint and several liability,” under § 768.81. Under Fla. Stat. § 768.81, a defendant that wants fault allocated to a nonparty must affirmatively plead that nonparty’s fault and, absent a showing of good cause, identify the nonparty if known or describe the nonparty as specifically as practicable. The defendant must also prove at trial, by a preponderance of the evidence, the nonparty’s fault in causing the plaintiff’s injuries before that nonparty can be included on the verdict form for apportioning damages. Talc cases often involve several parties, so this rule can matter a great deal.

The state of the art at manufacture matters. In an action based on defective design against a manufacturer, the finder of fact “shall consider the state of the art of scientific and technical knowledge and other circumstances that existed at the time of manufacture, not at the time of loss or injury,” under § 768.1257. This is a key point for how older products are judged.

Product claims face a timing rule. Florida law says an action for products liability must be begun within the period prescribed in the chapter, running from when the facts giving rise to the claim were discovered or should have been discovered with due diligence. The statute also sets an outer limit. Under § 95.031, no claimant may commence an action to recover for harm allegedly caused by a product with an expected useful life of 10 years or less if the harm was caused by exposure to or use of the product more than 12 years after delivery to its first purchaser or lessee who was not engaged in the business of selling or leasing the product or of using the product as a component in the manufacture of another product. That period is paused for any time the manufacturer, through its officers, directors, partners, or managing agents, had actual knowledge that the product was defective in the manner alleged and took affirmative steps to conceal the defect. All products, except certain listed categories, are conclusively presumed to have an expected useful life of 10 years or less. The same statute says this outer limit does not apply if the claimant was exposed or used the product within that period but the injury did not manifest until after it expired. Whether any of these rules fits a particular product depends on dates, so the timing question should be reviewed promptly.

Asbestos-framed claims follow a different clock. Talc lawsuits allege asbestos contamination. For asbestos or silica claims not barred as of the effective date of that act, Florida law provides that the limitations period “does not begin to run until the exposed person discovers, or through the exercise of reasonable diligence should have discovered, that he or she is physically impaired by an asbestos-related or silica-related condition,” under § 774.206. Which rule applies depends on how a claim is framed and when the facts were known.

Have questions about what happened?

Ask our team directly. When a loss is fatal, the family may have its own claim, separate from the patient’s injury.

Under Florida’s wrongful death statute, when a death is caused by a wrongful act, negligence, default, or breach of contract or warranty, and the event would have entitled the person injured to maintain an action and recover damages if death had not ensued, the person or watercraft that would have been liable in damages is liable for damages. The damages available to survivors are set out in § 768.21. Depending on who survived, these can include:

lost support and services for each survivor;

for a surviving spouse, loss of the decedent’s companionship and protection, and mental pain and suffering from the date of injury;

for minor children, and for all children of the decedent if there is no surviving spouse, lost parental companionship, instruction, and guidance, and mental pain and suffering;

for each parent of a deceased minor child, mental pain and suffering;

medical or funeral expenses paid by a survivor.

Florida law also requires that all potential beneficiaries be identified in the complaint. While an action under this act is pending, a settlement as to amount or apportionment among the beneficiaries that is objected to by a survivor, or affects a survivor who is a minor or incompetent, is not effective unless the court approves it, under § 768.25.

Families often ask what to do first. Gather the medical records, the product history, and any receipts or photos. Write down dates. Then contact us promptly so the timeline can be reviewed while the deadlines still apply.

Deadlines, Florida Law, and Why Timing Matters

Florida sets filing deadlines for personal injury and product claims, and those deadlines can limit when a case may be filed.

Florida’s general limitation rules are in Fla. Stat. § 95.11. Product and wrongful death timing can involve the discovery rule, the outer limit described above, and the tolling rules in § 95.051.
