Stat. \u00a7 768.81<\/a> reads: “(4) APPLICABILITY.\u2014This section does not apply to any action brought by any person to recover actual economic damages resulting from pollution, to any action based upon an intentional tort, or to any cause of action as to which application of the doctrine of joint and several liability is specifically provided by chapter 403, chapter 498, chapter 517, chapter 542, or chapter 895.” (Fla. Stat. \u00a7 768.81<\/a>)<\/p>\n

Some delivery routes are run by independent contractors. Every crash has its own facts, and a review of those facts is the starting point for understanding who may be responsible. In May 2026, the U.S. Supreme Court held that a state-law claim that a broker negligently hired an unsafe motor carrier is not preempted by federal law, in Montgomery v. Caribe Transport II<\/a>.<\/p>\n

After the required retention periods, a company may destroy records at its discretion, but this does not excuse compliance with other governmental requirements prescribing longer retention periods. That is why early written requests matter.<\/p>\n
