Stat. \u00a7 316.066(1)(b)<\/a>, crash reports held by an agency may be released immediately to the people involved in the crash, their legal representatives, their licensed insurance agents, their insurers, and other listed recipients such as law enforcement and victim services programs, but not for redistribution to any person or entity not listed in that subsection, and under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0316\/Sections\/0316.066.html\">\u00a7 316.066(1)(f)<\/a> they may be made available to eligible persons and entities 60 days after the date the report is filed.<\/p>\n<p>Commercial trucks also keep records. Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-395.8\">49 CFR 395.8<\/a>, except for a private motor carrier of passengers (nonbusiness), a motor carrier must require each driver to record the driver&#8217;s duty status for each 24-hour period, and a motor carrier operating commercial motor vehicles must install and require each of its drivers to use an electronic logging device (ELD) to do so, with manual recording permitted only in the limited cases the rule allows, such as for a vehicle manufactured before model year 2000.<\/p>\n<p>Testing rules are also strict. Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-382.303\">49 CFR 382.303<\/a>, as soon as practicable after a crash involving a commercial motor vehicle on a public road that causes a death, the employer must test each surviving driver who was performing safety-sensitive functions with respect to the vehicle. Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-382.303\">49 CFR 382.303<\/a>, after an occurrence involving a commercial motor vehicle on a public road, an employer must test for alcohol each surviving driver who was performing safety-sensitive functions if the accident involved loss of human life, or who receives a citation within 8 hours for a moving traffic violation arising from an accident involving bodily injury that requires immediate medical treatment away from the scene, or disabling tow-away damage. If an alcohol test is not given within two hours, the employer must record why. Attempts stop after eight hours for alcohol and 32 hours for controlled substances.<\/p>\n<p>Keep a simple journal of symptoms, appointments and expenses. Save every insurance letter.
