Stat. \u00a7 768.81<\/a>, a court enters judgment against each liable party. The judgment is based on that party&#8217;s percentage of fault.<\/p>\n<p>Each party is judged on its own percentage of fault. So Montgomery&#8217;s negligent-hiring claim falls within the FAAAA&#8217;s safety exception, which saves it from preemption (<a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/608us1r32_g3bi.pdf\">Montgomery v. Caribe Transport II<\/a>).<\/p>\n<p>That ruling answers a legal question. Each crash still turns on its own facts.<\/p>\n<p>That is why the company name on the vehicle and the driver&#8217;s paperwork matter early. They help sort out who employed the driver.<\/p>\n<h2>Florida Rules and Deadlines That Apply to These Crashes<\/h2>\n<p>Florida gives injured people a limited time to file most negligence claims. Under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0095\/Sections\/0095.11.html\">Fla. Stat. \u00a7 95.11<\/a>, the deadline for an action based on negligence is two years.<\/p>\n<p>Deadlines apply. Do not wait to get answers.<\/p>\n<p>Florida also uses a rule called modified comparative negligence. This is a shared-fault rule. Under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.81.html\">Fla. Stat. \u00a7 768.81<\/a>, a party found more than 50 percent at fault for their own harm may not recover any damages.<\/p>\n<p>In plain words, if the injured person is more than half to blame, they cannot recover. Shared fault is often argued after a crash, so records matter.<\/p>\n<p>Federal trucking rules also set limits. Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-395.3\">49 C.F.R. \u00a7 395.3<\/a>, a driver of a property-carrying commercial motor vehicle must take 10 consecutive hours off duty before driving. The driver may not drive after 14 consecutive hours that follow that break. Total driving time in that window is capped at 11 hours.<\/p>\n<p>The same rule, except for drivers who qualify for either of the short-haul exceptions in <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-395.1\">\u00a7 395.1(e)(1)<\/a> or (2), bars driving after more than 8 hours of driving time without at least a consecutive 30-minute interruption in driving status. It also limits total on-duty time. The limit is 60 hours in 7 consecutive days, or 70 hours in 8 consecutive days. Carriers operating commercial motor vehicles must install and require each driver to use an electronic logging device (ELD). A manual grid is allowed only in limited cases, such as for a driver operating a vehicle manufactured before model year 2000.<\/p>\n<p>The record must show the carrier&#8217;s assigned number. Or it must show the vehicle&#8217;s license number and licensing state.<\/p>\n<p>A written preservation request asks the trucking companies to keep this evidence. That includes electronic logging device data, GPS and telematics information, and dashcam video. The statute covers crashes that resulted in death, personal injury, or any indication of complaints of pain or discomfort; that involved a violation of s. 316.061(1) or s. 316.193; that rendered a vehicle inoperable to a degree that required a wrecker to remove it from the scene of the crash; or that involved a commercial motor vehicle.<\/p>\n<p>To get a copy, you must present a valid driver license or other photographic identification, proof of status, or identification that demonstrates your qualifications to access that information. You must also file a written sworn statement for each report you request, stating that information from the crash report will not be used for any commercial solicitation of accident victims or knowingly disclosed to any third party for the purpose of such solicitation.<\/p>\n<p>The statute says crash reports may be made available to the parties involved. It also covers their legal representatives and their insurers.<\/p>\n<p>The report lists the vehicles and people involved. It is one piece of evidence.
