Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-395.8\">federal driver log rules<\/a>, a motor carrier must require drivers to record their duty status. Carriers must install and require drivers to use an ELD that meets the requirements of subpart B of this part; a carrier may allow manual recording on a specified grid only in the limited cases the rule sets out, such as for a vehicle manufactured before model year 2000. The carrier must keep those records for at least 6 months from the date it receives them.<\/p>\n<p>Federal testing rules also run on short clocks. If an alcohol test is not given within two hours, the employer must record the reasons why.<\/p>\n<p>These timelines show why early action helps. Under this section, if an alcohol test is not administered within two hours following the accident, the employer must prepare and maintain on file a record stating the reasons it was not promptly administered; if it is not administered within eight hours, the employer must stop attempting it and keep the same record. For controlled substance tests, the limit is 32 hours. No six-month minimum for keeping records appears in this section. It does not mean everything will be easy to find later. Save what you can now.
