Carriers must require drivers to record their duty status for each 24-hour period (49 C.F.R. \u00a7 395.8<\/a>). Inspection reports and repair certifications must be kept for three months (49 C.F.R. \u00a7 396.11<\/a>). That clock is short, so early requests matter.<\/p>\n

A motor carrier keeps a driver qualification file while the driver works for it, and keeps that file for three years after the driver leaves, except that certain records may be removed from the file three years after the date they were executed (49 C.F.R. \u00a7 391.51<\/a>). Separately, 49 C.F.R. \u00a7 396.11<\/a> reads: “Every motor carrier shall require its drivers to report, and every driver shall prepare a report in writing at the completion of each day’s work on each vehicle operated, except for intermodal equipment tendered by an intermodal equipment provider.” The carrier must keep each driver vehicle inspection report, the certification of repairs, and the certification of the driver’s review for three months from the date the written report was prepared. Federal rules also make the carrier responsible for requiring drivers to follow these duties (49 C.F.R. \u00a7 390.11<\/a>).<\/p>\n
