Federal rules bar driving a commercial truck when fatigue, illness, or any other cause has impaired the driver&#8217;s ability or alertness, or is so likely to, as to make it unsafe, except that in a grave emergency where compliance would increase the hazard, the driver may continue to the nearest place where the hazard is removed (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-392.3\">49 CFR 392.3<\/a>).<\/p>\n<p>Motor carriers have their own duties. A motor carrier is the company that operates the trucks. Federal rules require a motor carrier to make sure drivers follow the driving duties and prohibitions that apply to them (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-390.11\">49 CFR 390.11<\/a>). Trucks must also be kept in safe operating condition, including brakes, tires, and steering (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-396.3\">49 CFR 396.3<\/a>).<\/p>\n<p>Other parties can matter too. A maintenance provider, a vehicle owner, or another driver may have contributed to the crash. Florida&#8217;s rules on fault explain how responsibility is divided. We cover those rules later in this guide.<\/p>\n<h2>Why Company Driver vs. Independent Contractor Status Matters<\/h2>\n<p>Whether the driver worked for FedEx or for an independent contractor can change who may be named in a claim. An independent contractor is a driver who works under a contract rather than as a direct employee. This question often shapes the whole case, so it deserves early attention.<\/p>\n<p>FedEx delivery routes can be run by company employees or by independent contractor operators. These logs show when a driver was on duty and driving. The same rule bars false reports about duty status. That means these records can be central to a fatigue question.<\/p>\n<p>Maintenance records matter as well. Under federal rules, motor carriers must keep these records for 1 year where the vehicle is housed or maintained, and for 6 months after the vehicle leaves the motor carrier&#8217;s control (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-396.3\">49 CFR 396.3<\/a>). That window is limited. A written request to preserve evidence should go out early.<\/p>\n<p>Federal rules require motor carriers, except private motor carriers of passengers (nonbusiness), to keep inspection, repair, and maintenance records for each motor vehicle they control for 30 consecutive days, and to keep those records where the vehicle is housed or maintained for 1 year and for 6 months after the vehicle leaves the carrier&#8217;s control (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-396.3\">49 CFR 396.3<\/a>). Records may be preserved by any technology that accurately reflects all of the information and can be accurately reproduced later (<a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-06\/title-49\/section-379.7\">49 CFR 379.7<\/a>). Dashcam video, GPS data, and telematics (data the truck&#8217;s systems send and store) may fit that description. Save copies of anything you have.<\/p>\n<p>Keep the official crash report, your photos, witness names, and the insurance details on the report. Florida crash reports list the names of the parties and their insurance companies. The parties and their legal representatives can get them (<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0316\/Sections\/0316.066.html\">Fla. Stat. \u00a7 316.066<\/a>).<\/p>\n<h2>Florida Deadlines and Fault Rules to Know<\/h2>\n<p>Florida generally allows two years to file a negligence lawsuit. The clock matters from the day of the crash. Florida&#8217;s statute of limitations (the law that sets the filing deadline) requires a negligence action to start within two years (<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0095\/Sections\/0095.11.html\">Fla. Stat. \u00a7 95.11<\/a>). Deadlines apply to the actions listed in <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0095\/Sections\/0095.11.html\">\u00a7 95.11<\/a>, other than actions for recovery of real property. Under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.81.html\">Fla. Stat. \u00a7 768.81<\/a>, in a negligence action the court enters judgment against each party liable based on that party&#8217;s percentage of fault, your own share of fault reduces your damages, and a person found more than 50 percent at fault for their own harm may not recover any damages. The judgment is based on that party&#8217;s percentage of fault. It is not based on a shared-everything approach. Insurers may argue that you share some of the blame. A careful record of the scene matters.<\/p>\n<p>Filing an insurance claim is not the same as suing the insurer. Under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0600-0699\/0627\/Sections\/0627.4136.html\">Fla. Stat. \u00a7 627.4136<\/a>, a person who is not an insured must first obtain a settlement or verdict against the insured for a cause of action covered by the policy, as a condition precedent to suing the liability insurer. Each parent of a deceased minor child may recover for mental pain and suffering. A survivor who has paid medical or funeral expenses may recover them.
