That decision awarded large damages for lost income.

Headlines are short. They often skip the injury, the evidence, and the court’s reasoning. No specific ruling is named here. Search results also mix in unrelated cases. These include tax rulings and wage disputes over unpaid pay. Those cases have nothing to do with injury damages.

To read a ruling, look at four parts:

The court and the date. Start here.

The background. This is what happened.

The issue. This is what was disputed.

The holding. This is what the court actually decided.

Appeals matter too. So the number in a headline may not be the final number. Read the full opinion when you can. Check the case history.

Why a Headline Figure Does Not Predict the Value of Your Claim

A headline award does not predict what your claim is worth. Every case turns on its own facts. It also turns on its own medical records and on Florida law.

One reported award reflects one injury, one body of evidence, and one court’s decision. Your medical records, your work history, and any fault question are unique to your case. No result can be promised.

You may ask, “Can I get a million dollar settlement?” Some reported cases do involve large sums. But no dollar estimate, range, or multiplier is offered here for any claim.

Florida law also shapes how an award is reviewed:

Under § 768.74, when a party files a proper motion, the court reviews whether an award is excessive (too high) or inadequate (too low).

The court may order a remittitur (a reduction) or an additur (an increase).

How Lost Wages Fit Into a Florida Personal Injury Claim

Florida generally treats lost wages as an economic damage. Economic damages are money losses you can count, such as lost pay and bills.

Under § 768.81, economic damages include:

Past lost income

Future lost income, reduced to present value

Present value means future money is adjusted to what it is worth today. The same definition also includes medical and funeral expenses. It includes lost support and services.

Lost earning capacity describes a reduced ability to earn in the future. It matters most when an injury affects long-term work. Whether it applies to you depends on your medical records and your work history.

Records can help document a loss. Useful papers include:

Pay stubs and W-2 forms

Tax returns

Employer statements about hours, leave, or pay

Work schedules

Physician notes that set work restrictions

Documented loss may be relevant to a claim. Causation, meaning what caused the loss, is tied to the medical records in each case. Whether any loss can be recovered depends on Florida law and the specific facts.

Why the Type of Work Changes the Rules

Lost-wage rules are not the same everywhere. The same paycheck can be treated differently. It depends on the kind of work and the legal system that applies. The table below compares three systems described in the official sources cited.

Feature

Railroad workers (federal law)

Longshore and harbor workers

Florida personal injury claim

What the law provides

A railroad is liable in damages to an employee injured through its negligence (§ 51)

Weekly compensation is set by formula, tied to the national average weekly wage

Economic damages include past and future lost income, reduced to present value (§ 768.81)

Effect of employee’s own negligence

Damages are diminished in proportion to the employee’s negligence; they are not barred (§ 53)

Not addressed in the sources used for this table

Not addressed in the sources used for this table

Time limit

Action must be commenced within three years from the day the cause of action accrued (§ 56)

Not addressed in the sources used for this table

Florida time limits depend on the type of claim (see Deadlines below)

Weekly figures for fiscal year beginning October 1, 2026

No weekly figure in this table; damages are decided case by case

Weekly benefit amounts are not stated on this page

No weekly figure; damages are decided case by case

The longshore figures are statutory weekly benefit rates. They are set by law. They are not a measure of what any lawsuit is worth. They also do not show how a jury would value lost income in a negligence case.

The point of the comparison is simple. The legal system, not just the size of a paycheck, shapes what can be recovered.

Catastrophic Injuries and Long-Term Income Loss

Some injuries can change a person’s ability to work for a long time. These include spinal cord injuries, paralysis, traumatic brain injuries, amputations, and severe burns. For some people, the change is lasting. How work is affected differs from person to person.

Each person’s medical care sets the path of recovery. This guide does not predict how any injury will progress. It does not predict how long work will be affected. Your doctors can answer those questions.

Follow your doctors’ care. Ask them to put work limits in writing.

Families face more than the injured person’s lost paycheck. A spouse or parent may need to leave work to provide care. Household help may become necessary. These losses are reviewed case by case, using the family’s records and the medical facts.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When a Loss Is Fatal: Wrongful Death Damages for Families

When a crash, fall, or attack causes a death, the family’s loss is at the center of the claim. Florida law sets out who may recover and what each person may recover.

Under § 768.21, all possible beneficiaries of a wrongful death recovery must be named in the complaint. (The complaint is the document that starts a lawsuit.) Their relationships to the person who died, called the decedent, must also be stated.

Survivors’ lost support and services. Each survivor may recover the value of lost support and services. This runs from the date of injury to the date of death, with interest (extra money for the delay). Future loss from the date of death is reduced to present value. The survivor’s relationship to the decedent may be considered. So may the decedent’s probable net income available to that survivor. The replacement value of the decedent’s services to that survivor may also be considered.

Surviving spouse. A surviving spouse may also recover for loss of the decedent’s companionship and protection. A spouse may also recover for mental pain and suffering from the date of injury.

Children. Minor children may recover for lost parental companionship, instruction, and guidance. They may also recover for mental pain and suffering. If there is no surviving spouse, all children may recover these damages.

Parents. Each parent of a deceased minor child may recover for mental pain and suffering.

Medical and funeral expenses. A survivor who has paid these costs may recover them.

The decedent’s estate. The personal representative (the person appointed to handle the estate) may recover the decedent’s lost earnings. This runs from the date of injury to the date of death. Lost support of survivors is subtracted. Interest may be added.

For medical negligence claims, the statute says certain damages are not recoverable by adult children. The same rule applies to parents of an adult child, as defined in the statute. Families should ask how this applies to their facts.

Under the federal railroad law, a death claim is brought for the benefit of a surviving spouse and children. If there are none, the claim passes to parents. Then it passes to next of kin who depended on the worker (45 U.S.C. § 51). Under the same law, an action must be started within three years from the day the cause of action accrued, meaning the day the claim began (§ 56).

Florida Limits That May Affect Lost-Income Recovery

Several Florida rules can limit what a person recovers. They apply differently in each case.

Comparative fault (shared fault). In a negligence action, Florida law has the court enter judgment against each party on the basis of that party’s percentage of fault. Fault is decided based on the facts of each case. Under Florida law, a person found more than 50 percent at fault for their own injuries may not recover any damages, but this rule does not apply to personal injury or wrongful death cases arising out of medical negligence under chapter 766 (Fla. Stat. § 768.81(6)).

Collateral sources. Under § 768.76, the court reduces an award by amounts paid or otherwise available to the claimant from collateral sources. Collateral sources are other payments the injured person receives, such as certain benefits. Subrogation or reimbursement means a collateral source provider that has complied with this section can seek its money back from the claimant, limited to the amount the claimant actually recovered from the at-fault party, minus the provider’s pro rata share of costs and attorney’s fees. This includes contractual or voluntary wage continuation plans that employers provide during a period of disability.

Deadlines. Florida sets time limits for filing lawsuits. The limit that applies depends on the type of claim and when it began. These limits can be shorter than people expect. Exceptions may apply. Acting promptly helps protect your options.

Workplace Injuries and Workers’ Compensation

Injuries on the job are generally handled through Florida’s workers’ compensation system. This system pays benefits for work injuries. It has its own rules for wage benefits. It also has rules for when an employer can be sued.

A claim against someone other than the employer may be possible in some cases. Whether any claim exists depends on the facts, the records, and Florida law.

Steps to Take Now to Protect Your Lost-Income Documentation

Gather your pay and work records now. They show what income you lost. Start with these steps:

Keep every pay stub, schedule, and message from your employer about hours or pay.

Save any letters about leave, light duty, or termination.

Write down the dates you missed work and the reason for each.

Keep copies of work-restriction notes from your doctors.

Follow your doctors’ care. Medical decisions belong to your doctors.

If a family member has died, keep the same records for the survivors. Save funeral and medical bills. Save proof of who paid them. Save records showing the decedent’s earnings and the support the family relied on.

Deadlines apply under Florida law. Acting promptly helps preserve your options. Results depend on the facts of your case.
