It is found in many body powders, including baby powder. Johnson & Johnson’s baby powder is named in many of these lawsuits.

The lawsuits allege that some talc products contained asbestos and that this contamination caused cancer. These are claims made in court filings. They are not findings a court has made. Johnson & Johnson has stated that its talc is safe and asbestos-free.

Most of these cases involve two groups:

Women diagnosed with ovarian cancer after using talc powder on the genital area over many years.

People diagnosed with mesothelioma or another asbestos disease. They say talc or asbestos exposure played a role.

Every claim turns on its own facts, and Florida filing deadlines apply.

Why Testing Matters to a Talc Claim

Whether a talc product contained asbestos is a technical question, and it is often disputed. The answer depends on how a sample was collected, which laboratory method was used to look for asbestos fibers, and how the lab identified what it found. Two tests on the same powder can give different answers.

That is why lab records matter. If you have a product, keep it sealed and unused, and bring any testing reports or paperwork to your consultation. We will look at what testing exists, when it was done, and what it shows. Please do not throw out products or packaging without talking to us first.

Who May Qualify: Ovarian Cancer Claims

You may have a claim worth reviewing if you were diagnosed with ovarian cancer after regular use of talc-based powder on the genital area.

The science is still debated. The FDA talc information says some studies suggest a possible link. The evidence has not conclusively established one.

The American Cancer Society fact sheet describes the evidence as limited. It also calls possible asbestos contamination of talc products a major concern.

A PubMed Central review concludes that the evidence does not establish that cosmetic talc causes ovarian cancer.

Facts that matter in an ovarian cancer review include:

A diagnosis of ovarian cancer confirmed in medical records.

Regular use of talc-based powder, such as baby powder or feminine hygiene powder, over time.

The dates of use and the date of diagnosis.

The brand or type of product, if it can be identified.

Who May Qualify: Mesothelioma and Other Asbestos Claims

Mesothelioma is a cancer of the thin lining that covers the lungs and other organs. It is linked to asbestos, a fiber once used in many building and industrial products.

Mesothelioma usually appears decades after the exposure. For that reason, a claim turns mainly on where and how the person was exposed, not on when symptoms began. Exposure sources worth reviewing include:

Jobs where asbestos materials were handled or present.

Military service.

Household contact. For example, washing a worker’s clothing that carried asbestos dust.

Talc or talc-containing products. The lawsuits connect these to asbestos disease.

How Florida Timing Rules Work for Asbestos Claims

The filing deadline is called the limitations period. It is the time limit to file a case. For asbestos claims, Florida law sets a special starting point. For asbestos claims not barred as of the act’s effective date, the clock does not start until the exposed person discovers, or with reasonable diligence should have discovered, that they are physically impaired by an asbestos-related condition (Fla. Stat. § 774.206).

Florida also treats a claim for a non-cancer asbestos condition as a separate cause of action from a claim for asbestos-related cancer (Fla. Stat. § 774.206). Physical impairment of the exposed person, to which asbestos exposure was a substantial contributing factor, is an essential element of an asbestos claim (Fla. Stat. § 774.204).

A Florida court may hear an asbestos claim if the person is domiciled in Florida or the exposure occurred in Florida (Fla. Stat. § 774.205).

Asbestos Bankruptcy Trusts

Some companies facing asbestos claims went through bankruptcy. Asbestos bankruptcy trusts may pay claims separately from a lawsuit. A trust claim follows its own process, separate from a lawsuit.

If you are caring for someone with mesothelioma, follow your doctors’ care first. Then review the legal questions at your own pace.

Florida Deadlines: Why Timing Can Change a Case

Florida deadlines can be strict, and several rules can affect when a clock starts or stops.

Discovery. For products liability claims, the time period runs from the date the facts giving rise to the claim were discovered, or should have been discovered with due diligence (Fla. Stat. § 95.031).

Under Fla. Stat. § 95.031, every product that is not included within subparagraph 1 or subparagraph 2 is conclusively presumed to have an expected useful life of 10 years or less. Under Fla. Stat. § 95.031, aircraft used in commercial or contract carrying of passengers or freight, vessels of more than 100 gross tons, railroad equipment used in commercial or contract carrying of passengers or freight, and improvements to real property, including elevators and escalators, are not subject to the statute of repose provided within this subsection. For products with a 10-year or shorter useful life, a claim generally cannot be started for harm caused by exposure to or use of the product more than 12 years after its delivery to the first purchaser or lessee not engaged in selling, leasing, or using the product as a component. However, this limit does not apply if the person was exposed to or used the product within that period but the injury did not show up until after it ended (Fla. Stat. § 95.031).

These rules are technical. Whether they help or limit a particular claim depends on dates, product records, and medical history. That is why we ask for your timeline early.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Florida Fault Rules Affect a Claim

Florida’s comparative fault rule affects how a case is valued. In a negligence action, a claimant’s own fault diminishes the damages awarded in proportion to that fault. Contributory fault chargeable to the claimant diminishes proportionately the amount awarded for an injury attributable to that fault, but does not bar recovery, subject to subsection (6), under which any party found greater than 50 percent at fault for his or her own harm may not recover any damages (Fla. Stat. § 768.81 reads: “This subsection does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766.” No outcome can be promised, but the rule is one reason the facts of how a person was exposed or used a product matter so much.

What Evidence Matters and How to Start

Medical records that confirm the diagnosis carry the most weight. A clear history of product use or exposure also matters. Missing items do not have to stop a review.

Useful evidence includes:

Medical records: the diagnosis, pathology reports (lab reports on tissue), and treatment notes.

Product records: bottles, receipts, photos, or store loyalty records.

A written timeline showing when the product was used, when symptoms began, and when the diagnosis came.

For asbestos claims: job history, military service records, or details about household exposure.

Statements from family members about which powders were used and for how long.

Keep original products and paperwork. Bring your timeline to your first consultation. Write it as you remember it. Some dates may be estimates, and that is okay.

How the Process Works

Consultation. We ask about your diagnosis, product use, and exposure history. This first consultation is free and confidential, with no obligation to continue.

Record review. We review medical and product records and check whether the facts fit a claim.

Decision. If a claim moves forward, it may be referred to, or handled together with, another law firm. CHG charges no attorney’s fees and no case costs unless there is a recovery.

Where the Litigation Stands

Talc litigation is ongoing, and its status changes over time.
