They look at how severe the fracture is. They look at what medical care you needed. They look at how long you could not work. They also look at how much pain and disruption the injury caused.

Two accidents are rarely alike. So two settlements are rarely alike.

How Severe Is the Rib Injury?

A simple fracture of one or two ribs generally supports a lower claim. Multiple fractures, or breaks with complications, usually support a higher one. The value depends on the treatment required. It also depends on the effect on daily life and the insurance available.

Flail chest is a far more serious injury. It means three or more ribs are broken in a row, in two or more places. It is disabling. A claim involving flail chest may be worth significantly more. The medical care and recovery are usually more intensive.

Injuries to the sternum (breastbone) or to internal organs can raise the value further. A punctured lung can. A collapsed lung, called a pneumothorax, can too. So can other damage inside the chest. These injuries can mean emergency surgery, longer hospital stays, and greater long-term risk.

Your imaging results and your doctor’s written description of the fracture form the starting point for your claim.

What Medical Treatment Did You Need, and How Are the Bills Counted?

Your medical care is usually the foundation of your economic damages. Economic damages are money losses, such as bills and lost pay. Emergency room visits, hospital stays, X-rays, and CT scans all add up.

Surgery for flail chest or internal injury means higher bills. It also means a longer recovery and more time away from work.

Conservative treatment means care without surgery. It includes rest, pain management, breathing exercises, and physical therapy. It often leads to lower settlements than surgery. Even so, it creates records of real expenses. The more treatment you received, and the longer your recovery lasted, the stronger the record supporting your claim.

Florida law also controls how medical bills can be proven in court. Under § 768.0427:

Bills you have already paid are limited to the amount actually paid, no matter who paid it.

Unpaid bills, when you have health coverage other than Medicare or Medicaid, are measured by the amount your coverage must pay the provider. They are also measured by your share of the cost under your policy.

Treatment under a letter of protection is measured in a separate way. A letter of protection is an agreement. A provider treats you. In return, the provider gets a promise of payment from any judgment or settlement. The statute has its own rule for this situation. It also matters whether you had coverage and chose not to use it.

If you have no health coverage, or your coverage is through Medicare or Medicaid, the statute uses a set formula. It uses 120 percent of the Medicare reimbursement rate. If no Medicare rate applies to the service, it uses 170 percent of the applicable state Medicaid rate.

The amount billed is not always the amount the court considers. Keep every bill, explanation of benefits, and letter of protection. These records help show what your care actually cost and how it was paid.

Pain and Suffering: More Than Physical Pain

Beyond medical bills, you can seek compensation for pain, discomfort, and reduced quality of life.

Broken ribs hurt when you breathe, cough, laugh, or roll over. The pain can disrupt your sleep. It can limit your work and affect daily tasks for weeks or months. A jury decides these damages based on the evidence in each case.

How Has the Injury Affected Your Income?

If you missed work, you can seek lost wages. These are the earnings you would have received if you had not been hurt.

For a salaried employee, this usually means counting the days missed and the daily pay. Self-employed people usually prove lost income with tax returns, invoices, and business records.

If the injury keeps you from returning to your old job, or permanently limits how much you can earn, you may also seek future lost income. That requires medical evidence of the long-term effects.

The Florida Threshold for Car Crash Claims

Car crash cases in Florida have an extra rule. Under § 627.737(2), you may recover damages for pain, suffering, mental anguish, and inconvenience. This applies in an action against the owner, registrant, operator, or occupant of a motor vehicle covered by the insurance Florida requires, or against any person or organization legally responsible for their acts or omissions. But only if your injury includes at least one of these:

significant and permanent loss of an important bodily function;

permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement;

significant and permanent scarring or disfigurement; or

death.

Broken ribs alone may or may not meet this requirement. What matters is the medical record. Ask whether your doctors document a significant and permanent loss of an important bodily function, or a permanent injury within a reasonable degree of medical probability (other than scarring or disfigurement). Also ask what prognosis (expected course of recovery) they give you. No outcome can be promised. But a well-documented medical record is central to this part of a claim.

What Is the Insurance Policy Limit?

Even if your damages are large, the at-fault driver’s policy has a maximum payout. If your damages go above that limit, you may pursue more. You can file an underinsured motorist claim, if your own policy includes that coverage. You may also be able to sue the driver personally.

Your attorney will investigate the defendant’s insurance. This shows the most that can be recovered from that source. That information shapes the settlement strategy. It also helps you decide whether to accept an offer or keep going with a lawsuit.

Have questions about what happened?

Ask our team directly. Multiple fractures, flail chest, or a punctured lung each change the medical care needed. They also change the lasting effects. Those facts drive the value.

Any general figure you read online describes other cases. It is not a promise about yours.

Insurance companies often start with a low offer. A lawyer who handles personal injury cases will work to present your actual damages. The lawyer will also show the strength of your evidence.

How Much Will I Actually Receive?

CHG charges no attorney’s fees and no case costs unless there is a recovery.

Other amounts may be taken from a recovery. These should be explained to you before you decide on any offer.

Collateral sources are payments made for your benefit by other sources. Examples include health insurance or income benefits. Under § 768.76(1), the court reduces an award by amounts paid or otherwise available from these sources. The reduction does not apply to sources that have a right of subrogation (a right to be repaid from your recovery) or reimbursement.

Medical providers who treated you may also claim part of your settlement. This is called a medical lien. Your attorney will identify each one before you sign.

Will Surgery Increase My Settlement?

Most broken ribs heal with conservative treatment. Surgery may be needed for flail chest, severe displacement, or internal organ damage. When it is, surgery adds to the claim. It raises medical bills, extends hospital stays, and adds lost wages. It also adds to pain and suffering. Your surgeon’s records support that part of the claim.

Factors That Can Lower Your Settlement

Comparative fault is each person’s share of responsibility for an accident. Under § 768.81(2), if you are partly at fault, your damages are reduced in proportion to your share. Partial fault does not by itself bar recovery. The statute refers to a further limit in its subsection (6). The firm can explain how that limit applies to your facts.

Other issues can also weaken a claim:

A pre-existing rib or chest condition. Insurers may argue the accident did not cause all of your injury.

Gaps in treatment, or stopping care early. Insurers may argue your injury was less serious.

Not following your doctor’s plan. This can be used to argue your damages are smaller.

How Are Damages Presented to a Jury?

Under § 768.77(1), when the trier of fact determines that liability exists on the part of the defendant, the itemized verdict lists the amounts for each type of loss. These include economic losses, noneconomic losses, and punitive damages, if they apply.

Under § 768.81(1)(b), economic damages include:

past and future lost income;

medical and funeral expenses; and

other economic losses caused by the injury.

Noneconomic damages cover losses such as pain and suffering. These losses have no bill or pay stub attached.

Why the 30-Day Offer Deadline Matters

Florida’s offer-of-judgment statute creates deadlines that can affect your decision. An offer of judgment is a formal settlement offer made during a lawsuit.

Under § 768.79(1), a defendant may file an offer. If it is not accepted within 30 days, and the judgment is one of no liability or at least 25 percent less than that offer, the defendant may recover reasonable costs and attorney’s fees incurred pursuant to a policy of liability insurance or other contract from the date of the offer. The same statute allows a plaintiff’s demand to carry similar consequences. This applies if the judgment is at least 25 percent greater than the demand.

An offer must be in writing. It must also state that it is made under this section.

Because of these timing rules, do not let a 30-day window pass. Speak with a lawyer about what the offer means for your case.

What If the Settlement Offer Seems Too Low?

You have the right to reject an offer. Your attorney can respond with a demand. That demand is backed by your medical records, your income documents, and the severity of your injury.

If negotiations stall, filing a lawsuit can prompt the insurer to take another look. A case that goes to trial is decided by a judge or jury. That carries risk, and no result is guaranteed.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

Deadlines Apply

Florida sets deadlines for filing suit by statute. § 95.11 lists the time limits for different kinds of actions. § 95.031 explains when the time begins to run.

The deadline depends on the type of claim and the facts. Each claim is judged on its own facts. So no amount can be predicted.

Florida’s medical-bill rules, the car crash injury threshold, comparative fault, and the 30-day offer-of-judgment deadline can all change the value of an offer.
