A diagnosis often brings medical questions. It also brings questions about past work and money.

Often, all of these questions arrive at once.

This page explains the disease. It also explains Florida legal options. A family may want to review these options with a lawyer.

Miami families know how fast a hard week can change. It can feel like the final minutes of a Heat game. The clock is loud. Every choice feels urgent.

Taking on an insurance company alone can feel like guarding the whole court by yourself. No one should have to do that.

CHG Lawyers is a Florida personal injury firm. It represents people across Florida, including families in Miami-Dade and Broward. Igor Hernandez is admitted in Florida as a member of The Florida Bar. He works from the firm’s Coral Gables office.

This page is general education. It is not medical advice. Your treating doctors should guide every medical decision.

What Mesothelioma Is and Why It Is Often Found Late

Mesothelioma is a cancer. It forms in the membranes around the lungs, chest, or abdominal cavity. Membranes are the thin linings that cover those organs.

The ATSDR asbestos health effects page calls it a rare asbestos-related cancer. According to that same page, signs of the disease may appear 30 to 40 years after asbestos exposure.

That long gap is called the latency period. Latency means the hidden time between exposure and signs of disease.

Because of this gap, families often struggle to link a diagnosis to a job or home from decades ago. The timeline is so long. A family may need to rebuild a work and home history. They may have to rely on memory and old records.

Is mesothelioma a rare disease?

Yes. ATSDR describes it as a rare cancer.

The gap between exposure and signs is not always the same. A PubMed Central article on short latency discusses mesothelioma cases with shorter gaps. So timing alone does not settle the question.

Signs and Symptoms of Peritoneal and Pleural Mesothelioma

Symptoms depend on where the cancer starts. Your doctor is the right person to explain what you are feeling.

Pleural mesothelioma begins in the lining around the lungs and chest. Peritoneal mesothelioma begins in the lining of the abdomen.

What are the signs and symptoms of peritoneal mesothelioma?

Peritoneal mesothelioma affects the lining of the abdominal cavity. Symptoms can differ from person to person. Ask your doctor what to watch for in your case.

Any new or changing symptom deserves a prompt visit to your doctor. Follow the care plan your medical team gives you.

Keep a simple written log. Note what you notice, when it started, and whether it changes. Bring that log to every appointment.

A family member can help keep it up to date. This keeps the timeline clear.

Asbestos Exposure: How Miami Families Connect the Past to the Diagnosis

Asbestos exposure is the starting point for any mesothelioma legal question.

OSHA asbestos hazards says occupational asbestos exposure increases the risk of mesothelioma. It also says these diseases have a delayed onset.

ATSDR asbestos exposure information adds that exposure to amphibole asbestos is associated with an increased risk of mesothelioma.

Exposure may come from a job. It may come from military service. It may also come from household contact with work materials or clothing.

Where and how exposure happened is central. Each case differs.

Start a written exposure history now. List every employer, job site, and trade. Include the years you worked there. Add every address where you lived or spent time in South Florida.

Pay stubs, old addresses, and family memories can all help fill gaps.

Is Mesothelioma Terminal? Outlook and Next Steps

Outlook varies from person to person. Your medical team is the right source for it.

ATSDR describes mesothelioma as a cancer. Questions about survival and prognosis belong with your own doctors.

Is mesothelioma a terminal illness?

Your doctors can explain what the diagnosis means for you. Outcomes vary. Your medical team can speak to yours.

Write your questions down before each visit. Ask the care team to repeat anything you don’t understand. Ask them to use plain words.

The person living with this illness deserves care that keeps them at the center. Families can also ask the care team what support is available.

Caregivers carry real weight. Their questions matter too.

Legal Options in Florida: Lawsuits, Asbestos Trusts, Workers’ Compensation, and Wrongful Death

A person with mesothelioma may have legal options under Florida law. So may the family of someone who died from it. The options depend on who was involved.

Possible routes include:

Lawsuits against companies or property owners tied to the exposure

Claims through asbestos bankruptcy trusts

Workers’ compensation

Wrongful death claims

Asbestos bankruptcy trusts may pay claims separately from a lawsuit. Three things shape whether a trust pays, and how. These are the company involved, the exposure, and the trust’s own rules.

Workplace illness

Workplace illness follows a different path. Workers’ compensation is the system that handles work-related injuries and illnesses.

Under Fla. Stat. § 440.151, a work-related disease is generally handled under the workers’ compensation law.

The statute requires that the employment was the major contributing cause of the disease. Medical evidence must show this.

Causation and exposure must also be proven by clear and convincing evidence. This is a high standard of proof.

Under Fla. Stat. § 440.11, an employer’s workers’ compensation liability is generally exclusive, with listed exceptions. “Exclusive” means it is generally the main remedy against the employer. That can limit a lawsuit against the employer itself.

Wrongful death

If a person dies, Florida allows a wrongful death claim. Under Fla. Stat. § 768.20, the decedent’s personal representative brings the action for the survivors and the estate.

The decedent is the person who died. The personal representative is the person who manages the estate. The Florida Wrongful Death Act begins at section 768.16 of the Florida Statutes.

Fault

Fault can change the outcome. Under Fla. Stat. § 768.81, for negligence actions filed after March 24, 2023 (ch. 2023-15, Laws of Fla.), a party found more than 50 percent at fault for their own harm generally may not recover damages. This rule does not apply to medical-negligence actions, and how it applies in any case depends on the facts and on applicable Florida law.

This rule has exceptions. Under Fla. Stat. § 95.11, actions other than for recovery of real property are subject to time limits that depend on the type of action. For example, the section lists a twenty-year period for an action on a judgment or decree of a court of record in this state.

Deadlines to Know: Florida Filing Time Limits for Asbestos Claims

Florida sets time limits for filing lawsuits. These are called statutes of limitations. The general rules appear in Fla. Stat. § 95.11.

Asbestos claims can follow special rules. So timing questions need a careful review.

Under Fla. Stat. § 774.206, this part applies to asbestos claims that were not barred as of that law’s effective date. Under Fla. Stat. § 774.206, the time period for these claims generally runs from when the exposed person discovers, or through reasonable diligence should have discovered, a physical impairment from an asbestos-related condition. The statute has conditions and exceptions, so how it applies depends on the facts of each case and on applicable Florida law.

The same statute treats a nonmalignant asbestos condition as a separate claim from asbestos-related cancer. It also bars damages for fear or risk of cancer in an asbestos claim.

Deadlines turn on the dates in each case and on Florida law. Missing a deadline may affect a claim. Deadlines apply. Contact CHG Lawyers promptly to review the dates in your family’s situation.

How CHG Lawyers Serves Miami and Florida Families

CHG Lawyers is a Florida-based personal injury firm.
