If your child has become withdrawn, anxious, or unwell, you may be asking whether social media played a part. This guide explains what these lawsuits claim, who may bring a claim in Florida, and which deadlines may matter. Every claim described here is an allegation made in lawsuit filings, not a finding by a court.

What Social Media Addiction Lawsuits Claim

These lawsuits claim that social media platforms were built to keep young users engaged for long periods, and that this design harmed them. A parent may be the first to notice the problem at home. A teen eats alone, sleeps badly, or stops talking about school and friends. The parent then wonders whether the phone and its apps are part of the picture.

You don’t need legal words to ask that question. The lawsuits describe several kinds of harm. Filings name depression, anxiety, eating disorders, self-harm, and suicide attempts. This guide discusses those conditions only in general terms and does not describe any method of self-harm.

These are allegations. A court has not found them true. The federal case page for MDL 3047 provides a docket and orders for the litigation, and filings on that page are not findings that the allegations are true. Keep that difference in mind as you read.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Who May Bring a Social Media Addiction Claim in Florida

Whether a claim exists depends on the facts of each case. Florida law also sets rules for money awarded to children. Under Fla. Stat. § 768.23, in an action under Florida’s Wrongful Death Act (§§ 768.16–768.26), amounts awarded to a minor or an incompetent person may be subject to protection under the Florida Guardianship Law, depending on the facts of each case and applicable Florida law.

If a child has died, different rules apply. Under Fla. Stat. § 768.20, and depending on the facts of each case and applicable Florida law, a wrongful death action is brought by the decedent’s personal representative. That person recovers for the benefit of the survivors and the estate. Families who have lost a child may find this part especially important.

An adult who was harmed as a minor may ask about his or her own claim. The time limits and the facts may differ from a parent’s situation. A parent asking this question does not mean a claim exists. Whether one does turns on the child’s medical records and the law that applies.

Warning Signs Worth Raising With Your Child’s Doctors

A parent may notice changes in sleep, mood, school work, and time with friends. These changes are worth raising with your child’s doctors. The HHS report on social media and youth mental health describes an observed association between heavy social media use and higher risks of depression, anxiety, and other mental-health problems. An association is not proof that one thing caused another. The CDC youth mental health page publishes data on poor mental health among U.S. adolescents.

Watch for lasting changes. Changes that last, or that interfere with daily life, are worth describing to a doctor. Share what you see with your child’s pediatrician, counselor, or mental-health provider.

This guide is not medical advice. Please follow the care plan your child’s doctors and providers set. If your child is in crisis, call or text 988 to reach the 988 Suicide & Crisis Lifeline. If your child is in immediate danger, call 911.

How Lawsuits Describe ‘Addictive Design’

The lawsuits use the phrase “addictive design” to describe app features that allegedly keep young users scrolling. Examples include infinite scrolling, notifications, and algorithmic recommendations. Algorithmic recommendations are content choices an app makes for each user.

Plaintiffs argue that these features work together to encourage compulsive use. The JPML transfer order identifies the plaintiffs’ allegations that platforms were designed to encourage addictive behavior in adolescents. It also identifies allegations that platforms failed to warn about harm to minors. Those are allegations, not findings.

Whether a design feature supports a legal claim turns on the facts, the records, and the law a court applies. Courts decide the disputed points. A lawsuit’s description of a feature is not the same as a court’s ruling on it.

The Federal MDL 3047 and Other Lawsuits

The Judicial Panel on Multidistrict Litigation issued a transfer order that brought these cases together under that number. The formal case name is In re: Social Media Adolescent Addiction/Personal Injury Products Litigation. The federal case page lists the court as the U.S. District Court for the Northern District of California.

Other claims about youth harm may be filed in state or federal court, depending on the circumstances. CHG Personal Injury Lawyers is not lead counsel in any MDL. These matters may be referred to, or handled together with, another law firm. A filing, a consolidation, or a court update does not mean that any particular family will be included in a settlement or receive any amount.

Is Tech Addiction Being Compared to Tobacco or Gambling?

That comparison is an argument made in filings. It is not a settled legal conclusion.

Courts decide whether these theories can move forward. Rulings may differ from case to case and from court to court. This section explains the argument only. It does not predict how any court will rule.

Florida law also addresses some product design claims. Under Fla. Stat. § 768.1257, in a defective design action against a product manufacturer, the finder of fact must consider the state of scientific and technical knowledge and other circumstances at the time of manufacture, not at the time of injury. Whether that rule applies to a given social media claim turns on how the claim is pleaded.

Have questions about what happened?

Ask our team directly. When a limit applies depends on the type of claim and when it arose. Fla. Stat. § 95.11 lists time periods for different kinds of actions. Under Fla. Stat. § 95.031(1), the clock generally starts when the last element of a claim occurs. Subsection (2) of the same statute addresses product-liability actions and sets its own rules.

Whether any time limit is paused depends on the claim and applicable Florida law. Deadlines can run while a family is still gathering information. Time may be limited, so the question is worth raising early.

Records Parents May Want to Gather

Parents can start by gathering records they already have. Those may include medical and mental-health records, counselor notes, and school records. They may also include records of your child’s app or device use, if you already hold them.

Keep copies of what you have. Avoid deleting accounts, messages, or device data while you gather information. Those items may matter later in any review. It also helps to write a simple timeline of the changes you noticed, with approximate dates.

Gathering records does not commit your family to a claim. Whether any record is relevant depends on the medical records and the law that applies. Your child’s doctors can help you understand what the records show about their care.

How Mass-Tort Cases Like These Are Handled

Social media addiction lawsuits may be grouped with similar cases. They may be handled through a referral to another law firm, or together with one. Mass-tort cases bring together many similar claims that arise from the same alleged conduct.

A review may include three steps. First, the family’s account of events and the child’s records are reviewed. Second, the matter is checked for whether it fits an existing group of cases. Third, the matter may be referred to, or handled together with, another firm.

The firm’s role can differ from case to case. We would explain any referral to the family before the family decides anything. No one can promise that a family will be included in a settlement or receive any amount.

Florida Communities We Serve

CHG Personal Injury Lawyers is a Florida firm with its bona fide office in Coral Gables, Florida.
