This is called a contingency fee. It means the fee is paid only if money is recovered for you.

Injured people are often already dealing with medical bills and missed paychecks. Paying a lawyer by the hour while a case moves through insurance talks or the courts can be out of reach. A contingency arrangement lets people pursue a claim without that upfront burden.

At CHG Personal Injury Lawyers, we charge no attorney’s fees and no case costs unless there is a recovery. We are a Florida firm serving people in Miami, Orlando, Tampa, Jacksonville, and communities throughout the state. Our practice focuses on catastrophic injury cases.

What Percentage Can a Lawyer Take From a Settlement?

The percentage depends on the fee agreement you sign. There is no single rate that fits every case, and some agreements change the rate depending on when a case resolves. Read the number and every condition attached to it before you sign.

Ask whether your agreement applies one rate from start to finish or uses different rates for early resolution, a lawsuit, or trial. If it uses different rates, ask for each one in writing.

The Deductions Between a Settlement and Your Check

Four items can reduce what you keep:

The attorney fee, the agreed percentage in your written agreement.

Case costs, the expenses of building and proving your claim.

Medical bills, including any that are paid from the settlement under a letter of protection.

Liens, claims by someone owed money from the settlement, such as a provider or health plan.

Your final check is what remains after all four are paid. Ask for that math in writing before you agree to any offer.

Attorney Fees vs. Case Costs: What’s the Difference?

Attorney fees pay the lawyer for legal work. Case costs pay for the expenses of proving the claim. The two are separate, and people often mix them up.

Case costs can include medical records and imaging copies, court filing fees, deposition transcripts (written copies of sworn testimony), investigation, site inspections, and fees for third-party expert witnesses who give opinions about how the injury happened or what care is needed.

Ask whether your percentage is figured before or after costs are subtracted. That single answer can change your final number by a meaningful amount. Ask for each cost line by line.

Medical Bills and Letters of Protection

Some injured people treat under a letter of protection. This is an arrangement where a provider treats you now and is paid from a later settlement or judgment. Florida law defines that arrangement in § 768.0427.

Because these bills are paid from the recovery, they belong on your accounting. Under § 768.25, while an action is pending, a settlement as to amount or apportionment among the beneficiaries is not effective unless the court approves it if any survivor objects to it or if it affects a survivor who is a minor or an incompetent.

This matters for how money is divided among family members. If one survivor objects, or a minor or incapacitated person is involved, the court must review the settlement before it takes effect.

Claims Against Government Entities

If a state agency, county, city, or other government body may be responsible, different rules apply. Under § 768.28, the state and its agencies and subdivisions are liable for tort claims in the same manner and to the same extent as a private individual under like circumstances, but liability does not include punitive damages or interest for the period before judgment. Several points in that statute affect how money is paid:

Failure to make final disposition of a claim within 6 months after it is filed is deemed a final denial.

In medical malpractice and wrongful death actions, failure to make final disposition within 90 days is deemed a final denial.

The statute of limitations for medical malpractice and wrongful death actions is tolled for the period the agency takes to deny the claim.

A setoff applies only against the part of the settlement or judgment payable to the claimant, minus the claimant’s reasonable attorney’s fees and costs.

Claims files kept by a state risk management program are confidential until all litigation and settlement of claims from the same incident are finished.

Because these deadlines and setoff rules are technical, a government claim should be reviewed as early as possible.

Federal Longshore Claims: Fees Must Be Approved

Some injuries to workers on or near navigable waters fall under the federal longshore compensation system.

Settlements with a third party also have strict steps. Under federal law, the employer shall be liable for compensation as determined under subsection (f) only if written approval of the settlement is obtained from the employer and the employer’s carrier before the settlement is executed. That approval must be filed within thirty days after the settlement is entered into. If it is not, all rights to compensation and medical benefits under this chapter can be terminated. Payments from the special fund or a trust fund also create liens on the settlement proceeds.

Offers Have Deadlines

A settlement offer or demand can carry a clock. Under § 768.79, an offer of judgment that is not accepted within 30 days can lead to costs and attorney’s fees if the judgment obtained is at least 25 percent less than the offer. A plaintiff’s demand has a parallel rule if the judgment is at least 25 percent greater than the demand.

Do not let a deadline pass while you are still reviewing the numbers. Ask your lawyer to explain each deadline in writing.

Liens and When Checks Are Released

A settlement check usually is not divided until the bills and liens tied to the case are worked out. The timing depends on each case, so there is no single number of days that fits every claim.

Settlements with more than one party can add steps. Under § 768.041, a release or covenant not to sue with one party does not release the liability of the others who may be liable for the same injury. If a release was delivered in partial satisfaction of the damages, the court sets off that amount from any judgment entered at trial.

Ask for a written accounting that shows the gross amount, the fee, the case costs, the liens, and your net share.
