Instead, Florida statutes control how an award is reviewed, reduced, or sent back for a new trial. A dollar figure is therefore never promised in advance. The amount in your case depends on the facts, the evidence, and the decisions of an insurer or a jury.

Why Most Florida Claims Have No Fixed Ceiling

Pain and suffering is what the law calls a non-economic damage. It covers physical pain, emotional distress, loss of enjoyment of life, and disfigurement. Economic damages, such as medical bills and lost wages, can be added up from receipts and pay records. Pain and suffering cannot be added up the same way.

This applies to claims such as car accidents, slip-and-fall incidents, truck crashes, and negligent security cases. Apart from the exception below, there is no fixed dollar limit on what you can recover for pain and suffering in these claims.

One exception involves claims against the state or its agencies or subdivisions. Recovery limits under Florida Statute § 768.28 apply to these claims. If your injury involves a government vehicle, road, or property, tell the firm right away so these rules can be reviewed early.

How Courts Review Jury Awards

Because juries decide many damage amounts, Florida gives judges the job of checking them. This is one of the most important reasons an award does not simply stand as announced.

If the amount is inadequate, it orders an additur, which increases it. If the party adversely affected does not agree, the court orders a new trial on damages only.

What judges look at. The same statute lists the criteria a court considers. These include whether the amount reflects prejudice, passion, or corruption on the part of the jury, whether the jury ignored the evidence, and whether the amount bears a reasonable relation to the damages proved and the injury suffered. The Legislature states that awards should be “subject to close scrutiny by the courts and that all such awards be adequate and not excessive.”

The motor vehicle standard. For claims arising out of the operation of a motor vehicle, Fla. Stat. § 768.043 applies a stricter test. The court reviews whether the award is “clearly excessive or inadequate,” and it applies similar criteria. This is why a car or truck crash verdict can be reviewed on the same basis as other personal injury verdicts, but with the “clearly” standard.

Knowing this helps explain why an award is not a promise. A verdict is a starting point: in any action for the recovery of damages based on personal injury or wrongful death arising out of the operation of a motor vehicle, upon proper motion, the court must review the amount of the award, and the review follows the standards in these statutes.

How Comparative Fault Can Reduce a Recovery

Shared blame matters. Fla. Stat. § 768.81 addresses comparative fault. Under Fla. Stat. § 768.81(2), in a negligence action, contributory fault chargeable to the claimant diminishes proportionately the amount awarded as economic and noneconomic damages for an injury attributable to the claimant’s contributory fault, but does not bar recovery, subject to subsection (6). Subsection (6) of Fla. Stat. § 768.81 provides that, in a negligence action to which this section applies, any party found to be greater than 50 percent at fault for his or her own harm may not recover any damages. This subsection does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766.

The details of § 768.81 are technical, and how they apply depends on the facts of your case. Do not assume that a shared-fault question ends a claim. Ask the firm to review how fault is likely to be argued.

What Shapes the Value of Pain and Suffering

Insurance adjusters and juries look at several factors.

Severity and permanence. A broken arm heals. A spinal cord injury that causes paralysis may not. Permanent disability, disfigurement, or chronic pain generally carries more weight than an injury that fully heals.

Duration. Pain that lasts weeks is valued differently from pain that lasts years.

Age and life expectancy. A 25-year-old paralyzed in a truck crash faces decades of daily limits. The same injury affects a 75-year-old differently, and the law and the evidence treat those differences with care.

Impact on daily life and work. Losing the ability to work, drive, care for children, cook, or enjoy hobbies can increase a claim’s value. A construction worker who loses a hand may face a different loss than an office worker with the same injury.

Medical records. Records of emergency visits, imaging, surgeries, physical therapy, prescriptions, and doctors’ notes about future care are the foundation of the claim. Follow your doctors’ care plan. Gaps in treatment can be used to question how serious the injury was.

A personal record. Many people keep a simple daily journal of pain levels, sleep, missed work, activities they can no longer do, and appointments. Written details made close to the events are often more persuasive than memories recalled months later.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Two Common Ways Pain and Suffering Is Estimated

The multiplier method. Economic damages (medical bills plus lost wages) are multiplied by a factor, often described as between 1.5 and 5, and sometimes higher for severe injuries. This is a hypothetical example, not a prediction:

Medical bills and lost wages: $50,000

Multiplier: 3

Hypothetical pain and suffering figure: $150,000

The per diem method. A daily amount is assigned for each day from the injury until recovery or maximum medical improvement. This is also a hypothetical example: at $250 per day for 200 days, the figure would be $50,000.

These examples show how the math works. They do not show what any case is worth. Insurers often use their own formulas, which can be more conservative than a jury’s judgment. A jury, by contrast, weighs the evidence and decides what the suffering is worth, and that result is still subject to court review described above.

Florida Crash Claims: Early Steps That Matter

Several steps in the first days and weeks after a crash often shape the evidence:

Get medical care promptly and follow your doctors’ instructions.

Keep a copy of the crash report and the names of the drivers, witnesses, and officers involved.

Photograph the scene, vehicles, and injuries as soon as you can do so safely.

Keep bills, pay stubs, and receipts for every cost.

Be careful about recorded statements to insurers before you understand your claim.

Ask us how your own auto insurance policy’s medical coverage applies to your bills.

Truck and Commercial Vehicle Claims

Crashes involving commercial vehicles are often more complicated than ordinary car crashes. Delivery trucks, freight haulers, and company vehicles can involve several parties: the driver, the company that employs the driver, the carrier, and sometimes a broker who arranged the trip. The firm handles truck accidents, including Amazon truck accidents and FedEx truck accidents.

One recent federal decision shows why this matters. In Montgomery v. Caribe Transport II, LLC (U.S. Supreme Court, 2026), the Court held that a state-law negligent-hiring claim against a broker that selected an unsafe motor carrier falls within the safety exception of the Federal Aviation Administration Authorization Act (FAAAA), which saves it from preemption. In the Court’s words, “Montgomery’s negligent-hiring claim falls within the FAAAA’s safety exception, which saves it from preemption.” In plain terms, a claim about who chose an unsafe carrier can stay in court. Whether such a claim applies to your crash depends on the facts, so the details of who was responsible for hiring and overseeing the driver matter.

Air Travel: Why Limits Are Different

Airplane crash cases raise a separate question about limits. For international air travel governed by the Montreal Convention, the carrier’s liability for a passenger’s death or injury is set by treaty rules. According to ICAO, Article 21 provides that the carrier cannot exclude or limit its liability for damages up to 100,000 Special Drawing Rights (SDR) for each passenger. ICAO notes this is about US$202,500 when announced. Above that amount, the carrier can avoid liability only by proving that the damage was not due to its negligence or other wrongful act or omission, or that the damage was solely due to the negligence or other wrongful act or omission of a third party.

Whether the Convention applies to a particular flight depends on the facts, so have your situation reviewed early.

Negligent Security: When Someone Else’s Property Failed to Protect You

Some people are hurt not in a crash or a fall but by another person’s violence on someone else’s property. They may have been assaulted, shot, robbed, or sexually assaulted in an apartment complex, a parking lot or garage, a hotel or motel, a bar or nightclub, a gas station, a store, or near an ATM. The property may have lacked working locks and gates, adequate lighting, cameras, or guards, and the attack may have happened because of that.

If this describes what happened to you or someone you love, you may have a claim against the property owner. Lawyers call this a negligent security claim: a claim that the owner did not provide reasonable security and that the failure caused the injury. The claim focuses on what the owner knew or should have known about the risk and what steps were reasonable to prevent harm.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Catastrophic Injuries and Pain and Suffering

Catastrophic injuries cause permanent, life-altering suffering. In these cases, pain and suffering often makes up a large share of the total claim.

Spinal cord injuries and paralysis. A person paralyzed from the waist down (paraplegia) or from the neck down (quadriplegia) may face lifelong medical care, assistive equipment, home changes, and lost independence.

Traumatic brain injuries. A severe TBI can cause cognitive impairment, personality changes, memory loss, and chronic pain. Some victims never return to work or live independently.

Amputations and limb loss. Losing a limb can cause phantom pain, psychological trauma, and permanent loss of function. A young person faces a lifetime without that limb, which the law takes into account.

Severe burns. Extensive burns cause scarring, disfigurement, chronic pain, and infection risk. Victims often endure multiple surgeries and skin grafts.

Back and neck injuries. Serious spinal injuries can cause lasting pain and limit work and daily activities.

In these claims, the value depends on the medical evidence, the available insurance, and the jury’s assessment, and any award is subject to the review described above. No one can promise a particular result.

When a Death Occurs: Wrongful Death Claims

When a crash or injury causes a death, the family left behind has its own claim. Under Fla. Stat. § 768.21, a surviving spouse may recover for loss of the decedent’s companionship and protection and for mental pain and suffering from the date of injury. Each parent of a deceased minor child may also recover for mental pain and suffering, and each parent of an adult child may do so if there are no other survivors, except in claims for medical negligence, where parents of an adult child cannot recover these damages.

These claims are about the people who loved the person who died, and they are handled with the same care as any other claim. If you are facing this, you do not need to decide everything at once. Ask the firm what steps to take first.

Pain and Suffering Terms in English and Spanish

We use the same terms throughout this article:

Pain and suffering (Spanish: dolor y sufrimiento)

Non-economic damages (Spanish: daños no económicos)

Economic damages (Spanish: daños económicos)

Medical bills (Spanish: facturas médicas)

Lost wages (Spanish: salarios perdidos)

Wrongful death (Spanish: muerte por negligencia o homicidio culposo)

Working With a Lawyer

Insurance adjusters often make early offers to people without a lawyer.
