First, personal injury protection (PIP) benefits pay part of your medical care. Second, a lawsuit for pain and suffering is allowed only in limited situations. Under § 627.737, a plaintiff may recover damages for pain, suffering, mental anguish, and inconvenience from the owner, registrant, operator, or occupant of a motor vehicle with respect to which security has been provided as required by ss. 627.730-627.7405, or from any person or organization legally responsible for her or his acts or omissions, only in the event that the injury or disease consists in whole or in part of:

Significant and permanent loss of an important bodily function.

Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.

Significant and permanent scarring or disfigurement.

Death.

This is why your early words matter. If you tell an adjuster “I’m fine” in the first week, that statement may later be used to argue your injury is not permanent, even if your medical records show otherwise. Many serious injuries, including spinal cord damage, traumatic brain injury, and internal bleeding, do not produce obvious symptoms right away. Report what you actually feel, and let your doctors document what they find. Follow your doctors’ care.

Timing matters for medical benefits too. Ask for a copy, but first you must present a valid driver license or other photographic identification and file a written sworn statement that the information will not be used for commercial solicitation of accident victims or knowingly disclosed to any third party for that purpose, and then read the report carefully for errors. The report also lists the officer’s name and badge number and the insurance companies for each party.

Written requests for insurance information. Under § 627.4137, each insurer that may provide liability insurance coverage must provide, within 30 days of the claimant’s written request, a statement under oath setting forth specified information about each known policy. The statute also requires that, in a negligence action, courts enter judgment against each liable party on the basis of that party’s percentage of fault and not on the basis of joint and several liability. That is why an early statement about fault can have lasting effects, even when several drivers or companies are involved.

Stick to facts: “The other vehicle crossed into my lane” is better than “I should have seen them coming.” If you are unsure who was at fault, say so, and do not speculate.

Recorded Statements

Adjusters often ask to record your statement “for accuracy.” A recording is permanent. Adjusters may also ask leading questions designed to lock you into a sequence of events before you understand what happened.

You have options. Crash reports, toxicology results, and medical records are often available to the insurer. If there is a question about alcohol or medication, tell your attorney the complete truth at the start. An account that conflicts with the records damages your credibility on everything else.

Families After a Serious or Fatal Crash

If someone you love died or was catastrophically injured in a crash, the weeks ahead can be overwhelming. You do not have to decide anything in a phone call. Contact a lawyer promptly, so that deadlines are protected while you focus on your family.

Do Not Sign or Release Anything Without Understanding It

Insurers often make a quick first offer. A settlement that looks reasonable now may not cover future medical care, lost income, or permanent impairment.

Be careful with releases. Under § 768.041, a release or covenant not to sue as to one tortfeasor for personal injury or wrongful death does not operate to release or discharge the liability of any other tortfeasor who may be liable for the same tort or death. Those insurers then have 30 days after receiving the notice to consider authorizing the settlement or keeping their subrogation rights. These steps are easy to miss on your own, and they affect your rights.

Florida law sets deadlines for filing injury claims. They apply to every case, and the exact deadline depends on the facts. Do not assume you have time.

Social Media and Surveillance

Insurers monitor social media and sometimes conduct surveillance, especially in claims involving serious injuries. A photo of you smiling at a family event, or a video of you walking to your car on a good day, can be presented without the pain or medication that followed. Until your claim is resolved:

Do not post about the accident, your treatment, or your daily activities.

Set accounts to private, but do not delete content, because deletion can be portrayed as concealment.

Be cautious about what friends and family post about you.

When to Talk With Our Lawyers

If you have a serious or permanent injury, or the insurer is pressing you to settle, speak with a lawyer before you make decisions.
