It depends on the insurance policies that apply to the crash. Most of those policies have set limits.

Three things shape what you may recover:

Your own coverage

The at-fault driver’s coverage

Florida’s no-fault rules

This guide explains where the money comes from. It covers the limits that matter. It also covers what can change the final amount. This is general information. It is not legal advice about your case.

CHG Personal Injury Lawyers is a Florida-based firm. Igor Hernandez is the responsible lawyer for this page.

What is the maximum insurance payout for a car accident in Florida?

There is no single maximum. Payouts usually come from three places:

Personal injury protection (PIP)

The at-fault driver’s bodily injury liability coverage

Uninsured or underinsured motorist coverage

Each one has its own limits and its own rules.

Think of them as layers. Each layer covers different losses. The limits on each layer set the ceiling for that layer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Where does the money come from after a Florida crash?

Florida uses a no-fault system for many crashes. The Insurance Information Institute explains that drivers generally make their first claim through their own insurer. For most people, that is the starting point.

Personal injury protection (PIP)

PIP is the first layer. Under Fla. Stat. § 627.736, the insurer of a vehicle’s owner pays PIP benefits only for the listed persons and circumstances, such as accidental bodily injury sustained in this state by the owner while occupying a motor vehicle.

This includes:

Injuries to the owner while in the vehicle

Injuries sustained in Florida to a person struck by the owner’s motor vehicle while not an occupant of a self-propelled vehicle, if that person is a resident of Florida and the injury is caused by physical contact with that motor vehicle, provided the person does not own a vehicle that must carry PIP security and is not entitled to PIP benefits from the insurer of the owner of such a vehicle.

PIP is not the whole recovery. It pays certain bills and losses first. Other layers may apply on top of it.

Bodily injury liability coverage

Bodily injury liability is the at-fault driver’s insurance. It pays for injuries that driver causes.

Its limits are the most common ceiling in a claim against that driver. If your losses are bigger than those limits, the gap matters a great deal.

Uninsured and underinsured motorist coverage

Your own uninsured motorist (UM) and underinsured motorist (UIM) coverage can help. It can help when the at-fault driver has no insurance or too little.

Under Fla. Stat. § 627.727, UM coverage limits must be not less than your bodily injury liability limits unless a named insured rejects the coverage or selects a lower limit that complies with the insurer’s rating plan.

Read more in our guide to uninsured and underinsured motorist claims in Florida.

Why do serious injuries change what you can recover?

Florida limits pain-and-suffering damages in most car accident cases. In Florida car-crash cases, an injured person may recover pain, suffering, mental anguish, and inconvenience damages from the owner or driver of a vehicle with required security only if the injury meets one of the conditions in § 627.737(2)(a)-(d). But only if the injury meets a threshold.

Under § 627.727(7), an uninsured motorist insurer’s legal liability does not include damages for pain, suffering, mental anguish, and inconvenience unless the injury or disease is described in one or more of paragraphs (a)-(d) of s. 627.737(2):

Significant and permanent loss of an important bodily function.

Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.

Significant and permanent scarring or disfigurement.

Death.

Serious injuries often fit within these categories.

Whether a particular injury fits depends on medical records and the facts of the crash. Follow your doctors’ care. Keep every record.

UM coverage follows the same threshold. A UM insurer’s legal liability generally does not include pain, suffering, mental anguish, and inconvenience unless the injury meets Florida’s serious-injury conditions. That is true unless the injury meets that same test.

How do medical bills affect the payout?

Medical charges are often a large part of a claim. The rules for them are specific.

Under Florida’s personal injury protection rules, Fla. Stat. § 627.736 provides that eighty percent of all reasonable expenses for medically necessary medical, surgical, X-ray, dental, and rehabilitative services is covered, up to the $10,000 limit. This applies only if the individual receives initial services and care within 14 days after the motor vehicle accident. That initial care must come from a licensed physician, dentist, chiropractic physician, or advanced practice registered nurse. It may also come from a hospital, a facility that owns or is wholly owned by a hospital, or a licensed emergency transportation and treatment provider. There are limited exceptions for coinsurance and policy maximums.

Treatment under a letter of protection raises its own questions. A letter of protection is a promise to be paid from a future settlement or verdict. See Fla. Stat. § 768.0427 for the details.

Collateral sources can also reduce a damages award. These include some insurance benefits you received. Under Fla. Stat. § 768.76, the court reduces the award by amounts paid or available from collateral sources. The exception is when a subrogation or reimbursement right exists. Subrogation means another party has a right to be repaid from your recovery.

How do you find out the other driver’s policy limits?

You can ask the insurer for a sworn statement. Under Fla. Stat. § 627.4137, an insurer must provide one within 30 days of your written request.

The statement lists:

Each known insurer and each insured

The liability limits

Any coverage defense the insurer reasonably believes it has

The insurer must also give you a copy of the policy.

You generally cannot sue the other driver’s liability insurer directly. Under Fla. Stat. § 627.4136, a person not insured under the policy must first get a settlement or verdict against the insured. An insurer can be added at the judgment or settlement stage by motion, unless the insurer denied coverage or defended under a reservation of rights under s. 627.426(2).

What if the at-fault driver has no insurance?

Florida requires vehicle owners to keep security. Under Fla. Stat. § 627.733, an owner who lacks required security at the time of a crash has no immunity from tort liability. Tort liability means legal responsibility for harm caused by a wrongful act. That owner is personally liable for PIP benefits.

If an insurer becomes insolvent, meaning it cannot pay its claims, unpaid covered claims may be handled through the state-created association that pays covered claims of insolvent Florida insurers.

Have questions about what happened?

Ask our team directly. Florida uses modified comparative fault, also called shared fault (Fla. Stat. § 768.81(6)).

Under Florida’s comparative fault system:

In a negligence action to which this section applies, a claimant found more than 50 percent at fault for their own harm may not recover any damages; this rule does not apply to personal injury or wrongful death actions arising out of medical negligence.

Otherwise, damages are reduced by the claimant’s share of fault.

Timing matters too. For most Florida negligence claims, the deadline to file a lawsuit is two years, under Fla. Stat. § 95.11. Our guide on Florida’s statute of limitations for car accidents covers this in more detail.

Do commercial and rental vehicles have different limits?

Yes, they can. Under Fla. Stat. § 324.021, a lessor under a lease of one year or longer is not deemed the owner for financial responsibility purposes. A lessor is the owner who leases the vehicle out. This applies while the lessee’s required insurance is in effect. The lessee is the person renting the vehicle.

The statute sets minimum limits for that lessee insurance:

Commercial and rental crashes can involve several policies at once. This is one reason these cases need careful review.

What should families know after a fatal crash?

A death is the most serious outcome a crash can cause. Under Florida’s threshold, death is one of the conditions that allows a claim for pain and suffering. Families may also pursue wrongful death claims. A wrongful death claim is brought by the family after a person dies.

Families often need the official crash record early. The Florida Department of Highway Safety and Motor Vehicles publishes information on crash reporting. It also explains how involved parties can obtain crash details. Keep the report, the insurance information, and every bill.

Speed is a common factor in serious crashes. The Insurance Institute for Highway Safety reports that speeding increases both the likelihood and the severity of crash injuries.

Common mistakes that can reduce a payout

Accepting an early offer before the full extent of an injury is known.

Giving a recorded statement without understanding what it may be used for.

Posting about the crash or your activities on social media.

Missing the filing deadline.

Skipping recommended medical care. This can make it harder to show the injury’s effect.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

Frequently asked questions

Is there one maximum payout for a Florida car accident?
No. The total depends on PIP, the at-fault driver’s liability limits, and your own UM or UIM coverage.

Does Florida have no-fault car insurance?
Florida uses a no-fault structure.
