The Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) ran it together. The study looked at a large sample of serious large-truck crashes.

Each crash received one critical reason. This is the immediate event that made the crash unavoidable.

Every critical reason falls into one of three groups:

The driver: a mistake in recognizing, deciding, or performing.

The vehicle: a mechanical failure, such as brakes or tires.

The environment: road conditions, weather, or visibility.

In the LTCCS, the driver group gets the critical reason far more often than the vehicle or environment. That is why “driver error” is the usual short answer. But the study also makes two things clear.

First, the critical reason is often assigned to the other vehicle’s driver, not the truck driver. OSHA notes that unsafe actions by passenger-vehicle drivers contribute to a large share of fatal crashes involving large trucks. So “driver error” does not automatically mean the trucker.

Second, a “critical reason” is not the same as blame. The critical reason might be that a driver fell asleep. The cause of that could be a dispatcher who scheduled 14 hours of driving into an 11-hour legal limit.

Our catastrophic truck-crash work looks at the full chain. We ask not only what went wrong in the last second. We also ask who and what put the driver in that position.

What “driver error” actually means

The LTCCS sorts driver errors into four types. Knowing them helps you see what an investigator looks for:

Recognition errors: The driver did not see the danger in time. This can come from inattention, distraction, or poor watchfulness.

Decision errors: The driver made a bad choice. Examples include driving too fast for conditions, following too closely, or misjudging a gap.

Performance errors: The driver lost control, such as by overcorrecting or steering poorly.

Non-performance errors: The driver could not act. Examples include falling asleep or having a sudden medical emergency.

At highway speed and weight, any of these can turn deadly in seconds.

A fully loaded tractor-trailer can weigh up to 80,000 pounds. A typical passenger car weighs roughly 3,000 to 4,000 pounds. When the two collide, the people in the car absorb the force.

Why truck-crash physics produces catastrophic injuries

The energy in an 80,000-pound impact does not spread out evenly. It concentrates on the people in its path. That is why truck crashes so often cause the permanent, life-altering injuries our firm handles:

Spinal cord injuries and paralysis. The Mayo Clinic lists motor-vehicle crashes as a leading cause of traumatic spinal cord injury.

Traumatic brain injuries. A violent stop can cause permanent damage to thinking, memory, and movement.

Amputations and limb loss, and severe burns when fuel or cargo catches fire.

Fatal outcomes. A death is the most catastrophic result of all. When a family loses someone, a wrongful-death claim gives them a path forward. That loss deserves the same care as any other injury.

How spinal cord injuries are classified, and why the label matters

Not all paralysis is the same. The medical classification affects a lifetime care plan and the value of a claim.

Physicians grade traumatic spinal cord injuries using the International Standards for Neurological Classification of Spinal Cord Injury (ISNCSCI). The American Spinal Injury Association (ASIA) publishes it. Two parts of this framework are useful to understand:

Level. The injury is described by the lowest spinal segment with normal function, such as C5 or T6. Higher (cervical) injuries generally affect more of the body. Cervical injuries can cause tetraplegia, also called quadriplegia. This means loss of function in the arms, trunk, and legs. Injuries lower down can cause paraplegia, which affects the trunk and legs.

Completeness: the ASIA Impairment Scale (AIS). The AIS grades injuries from A to E. It measures how much feeling and movement remain below the injury. AIS A means no motor or sensory function is preserved in the lowest sacral segments. AIS E means normal function. This grade helps physicians describe the likely outlook.

For more context, the National Institute of Neurological Disorders and Stroke (NINDS) explains how these injuries interrupt signals between the brain and body. When a claim is built, this classification becomes the backbone of the life-care plan.

The driver-related factors we see most

Within the “driver” group, a few factors come up again and again in serious cases:

Fatigue. FMCSA hours-of-service rules limit most property-carrying drivers to 11 hours of driving. The period starts after 10 consecutive hours off duty. Federal rules also bar driving when fatigue makes it unsafe (49 C.F.R. § 392.3). Some drivers and some carriers ignore these rules.

Distraction. Phones, dispatch tablets, and eating pull eyes off the road. 49 C.F.R. § 392.82 prohibits drivers from using a hand-held mobile telephone while driving a commercial motor vehicle (CMV), and it bars motor carriers from allowing or requiring their drivers to do so. The rule permits such use only when necessary to communicate with law enforcement officials or other emergency services. 49 C.F.R. § 392.80 prohibits drivers of commercial motor vehicles from texting while driving, and it bars motor carriers from allowing or requiring their drivers to text while driving. The rule permits texting only when necessary to communicate with law enforcement officials or other emergency services.

Speeding. OSHA flags unsafe speed as a serious risk. It is a classic decision error.

Impairment. Alcohol, illegal drugs, and misused medications slow reactions. Federal rules bar drivers from using alcohol within 4 hours before going on duty or operating a commercial motor vehicle (49 C.F.R. § 392.5).

Inexperience and poor training. A driver who was never properly taught to handle a heavy rig makes more mistakes under pressure. Federal rules require a qualified driver to be able to operate the vehicle safely through experience, training, or both (49 C.F.R. § 391.11).

When the cause is not the driver

Sometimes the critical reason is the vehicle or the environment. Other times, it traces back to a company that put the driver in a losing position:

Equipment failure: worn brakes, bad tires, or skipped maintenance.

Improper cargo loading: overweight, shifting, or loose loads that make a truck hard to control.

Company pressure: unrealistic schedules that push drivers past legal limits. Federal rules also bar a motor carrier from scheduling a run that would require speeds above the posted limits (49 C.F.R. § 392.6).

Road and weather: poor road design, rain, and low visibility, especially at high speed.

The key point is this: more than one party can share the blame. The driver, the motor carrier, a maintenance contractor, and a cargo loader can each be partly responsible.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why the cause matters for your claim, and how it’s proven

The cause shows who was negligent and who should pay. In these cases, attorneys typically move quickly to secure:

Electronic logging device (ELD) data. An ELD is the device that records driving time. Together with the engine control module (the “black box”), it can show speed, braking, and hours driven. Except for a private motor carrier of passengers (nonbusiness), a motor carrier subject to the requirements of this part must require drivers to record their duty status for each 24-hour period (49 C.F.R. § 395.8).

Maintenance records that show skipped repairs or ignored warnings.

Driver qualification files that show training, testing, and past violations.

Compliance records for the FMCSA safety regulations the driver or carrier may have broken.

Florida law also shapes the outcome. Florida’s rules on shared fault and filing deadlines can affect a claim. That is why it is important to act early.

ELD data can be overwritten. Acting early protects both the evidence and your rights. No lawyer can promise a specific result.
