Legal rights come second. But a few avoidable mistakes can harm both at once.

The stakes here are different from a small fender-bender. A spinal cord injury, a TBI, a lost limb, or a severe burn can change a life forever. The Mayo Clinic explains that spinal cord injuries can cause lasting changes in strength, feeling, and body function (Mayo Clinic). When harm may last a lifetime, the mistakes you avoid now matter for decades.

Don’t leave the scene or skip calling 911

Never leave the scene of a serious crash. Always call 911. Leaving can lead to criminal charges. It also erases the official record you may need later.

For any serious-injury crash, two things become key evidence: the crash report and the emergency medical (EMS) records. They show who was there, what was said, and how badly someone was hurt.

Are you a family member who arrived after the crash? Ask for the crash report number. Note which agency responded — city police, county sheriff, or the Florida Highway Patrol.

In Florida, a driver in a crash with injury or death must report it right away. Law enforcement must file a written report (Fla. Stat. §316.066). That report number is often the fastest way to find everything else.

Don’t assume you’re “fine” or delay medical care

Don’t assume you’re okay. Don’t delay medical care. Serious injuries hide behind adrenaline. They can appear hours or days later.

A TBI, internal bleeding, or spinal cord damage may not hurt at first. The Mayo Clinic warns that a spinal cord injury’s full effects may not be clear right away. Symptoms can develop or get worse over time (Mayo Clinic). Waiting to be checked can turn a fixable problem into a permanent one.

There’s a legal cost too. When someone refuses or delays care, it creates a “gap” in the records. Adjusters use that gap to argue the injuries came from something other than the crash. Get checked right away. Follow every treatment instruction. Keep every follow-up appointment.

Wondering about recovery time? See our guide on how long you should rest after a car accident.

Don’t admit fault or apologize at the scene

Don’t apologize or admit fault at the scene, even to be polite. A quick “I’m so sorry” or “I didn’t see you” can later be treated as an admission of fault.

Here is why that matters in Florida. Vague warnings aren’t enough. Florida follows a modified comparative-negligence rule. This means your payout is reduced by your own share of fault.

Under Fla. Stat. §768.81, a 2023 change added a hard limit. A person found more than 50% at fault for their own harm generally recovers nothing at all.

On a catastrophic claim, that is not a small detail. It is the difference between a lifetime of care being paid for and being left to your family. Words at the roadside are one of the first things an insurer will use to push your percentage up.

In truck crashes, you usually can’t judge fault from the side of the road. Fault may involve the driver, the trucking company, poor maintenance, or badly loaded cargo. When you speak with police, stick to facts you actually know. Don’t guess about the cause. Don’t guess about how badly you’re hurt.

Don’t fail to document the scene and gather information

Document the scene if you can do so safely. Photos and details taken early are hard to dispute later.

If you’re physically able, try to capture:

Photos of the vehicles, the road, traffic signals, and any visible injuries.

The truck’s company name and its USDOT (U.S. Department of Transportation) number. It is usually printed on the door or trailer.

Names and contact details for drivers, passengers, and witnesses.

The responding officer’s name and the crash report number.

Too hurt to do this? Ask a passenger, bystander, or family member. In a serious crash, that’s normal and expected. No one should gather evidence over their own injuries.

Here’s a truck point that insurance-company pages never mention. In the catastrophic truck cases our attorneys handle, key evidence can vanish within days. That includes:

Electronic logging device (ELD) hours-of-service data.

The tractor’s engine control module (the “black box”).

Dashcam video.

Paper driver logs.

Federal rules require carriers to keep certain records only for a limited time. Normal business practice can overwrite or throw out the rest. That’s why a written demand to preserve evidence often needs to go out fast. Don’t accept an early settlement before you understand your rights. Both can quietly work against you.

Adjusters often call within a day or two. They may sound truly friendly. But a recorded statement can be used to shrink your claim. And an early offer rarely covers the true, lifelong cost of a catastrophic injury.

Think about what those costs really include. Emergency surgery. Months of inpatient rehab. Prosthetics or a power wheelchair. Home and vehicle changes. In-home care. Lost earning power for years to come. A fast check for a few thousand dollars cannot cover a lifetime of care.

You can be polite and still say no. To see why catastrophic claims take time, read how long truck accident cases take to settle.

Don’t post about the crash on social media

Don’t post about the crash, the injuries, or daily activities on social media. Anything you share can be twisted to make things look less serious.

A single photo can be taken out of context. A smiling picture at a family gathering might be used to argue someone is “fine” — even on a good day between hard ones. A location check-in might be used to question how limited a person really is.

Change your privacy settings. Pause posts about health, activities, and the case itself. Family members should also avoid posting about a loved one’s condition or the crash. Well-meaning updates to relatives can end up in an insurer’s file.

Don’t sign paperwork or throw away evidence

Don’t sign insurance releases or throw away evidence before you understand them. What looks like routine paperwork can quietly limit your rights.

Insurers may send a medical authorization or a release to sign. Some forms give the insurer wide access to your entire medical history. Others ask you to settle the whole claim. Don’t sign until you know exactly what you’re giving up.

Keep everything. Save the damaged vehicle, medical bills, receipts, and all letters from insurers. In a serious case, repairing or scrapping the vehicle can erase evidence you need to prove what happened.

Don’t wait too long to get legal guidance

Don’t wait too long to understand your rights. Legal deadlines and vanishing evidence both work against delay.

Every state sets deadlines called statutes of limitation. These are legal filing deadlines. In Florida, most negligence-based injury and wrongful-death claims that begin on or after March 24, 2023, must usually be filed within two years, under Fla. Stat. §95.11. Miss the deadline, and a valid claim can be barred forever. You can check these rules on the Florida Legislature’s Online Sunshine site.

There’s also the evidence problem. Truck data, driver records, and video are best saved early. A free case evaluation carries no cost and no obligation. And we can’t and won’t promise any particular outcome.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

A note for families of someone catastrophically injured or lost

Are you deciding for a loved one who can’t act for themselves?
