The <a href=\"https:\/\/www.nscisc.uab.edu\/\">National Spinal Cord Injury Statistical Center (NSCISC)<\/a> reports that falls are the <strong>second-leading cause<\/strong> of spinal cord injury in the United States, after vehicle crashes \u2014 and that falls become an even larger share of new injuries among people over 45.<\/p>\n<p>Doctors grade these injuries as <strong>complete<\/strong> or <strong>incomplete<\/strong> using the International Standards for Neurological Classification of Spinal Cord Injury (ISNCSCI), maintained by the <a href=\"https:\/\/asia-spinalinjury.org\/international-standards-neurological-classification-sci-isncsci\/\">American Spinal Injury Association<\/a>. A complete injury means total loss of feeling and movement below the level of injury; an incomplete injury means some function remains. The ASIA scale runs from <strong>A (complete)<\/strong> to <strong>E (normal)<\/strong> \u2014 a distinction that often drives how much future care a person will need, which is exactly what a claim has to account for.<\/p>\n<p>Where the injury sits on the spine matters, too. Florida enforces the <strong>Florida Building Code<\/strong>, and Florida elevators, escalators, and related equipment are regulated under <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0399\/0399.html\">Fla. Stat. \u00a7399<\/a> and inspected by the Department of Business and Professional Regulation. A stairway with a broken rail or a treated riser height that violates code is not a matter of opinion \u2014 it can be documented against a written rule.<\/p>\n<h2>Premises liability: when does an owner owe you a duty?<\/h2>\n<p>Property owners and managers must keep their property reasonably safe for people who are there lawfully. Lawyers call this <strong>premises liability<\/strong> \u2014 but you don\u2019t need the term to understand the idea.<\/p>\n<p>Reasonable care means the owner should fix hazards they know about, inspect for hazards they <em>should<\/em> have found, and warn people about dangers they can\u2019t fix right away.<\/p>\n<p>Who was on the property affects the duty owed. In Florida, courts have long distinguished an <strong>invitee<\/strong> (a customer or paying tenant, owed the most protection) from a <strong>licensee<\/strong> and a <strong>trespasser<\/strong> (owed less). The specifics vary by state.<\/p>\n<h3>The same duty behind negligent-security cases<\/h3>\n<p>Here is a connection most fall articles miss. The <em>same<\/em> legal duty to keep a property reasonably safe also applies when a property fails to protect people from an attack it could have foreseen.<\/p>\n<p>Say you were beaten, robbed, shot, or sexually assaulted \u2014 in an apartment complex, a parking lot or garage, a hotel, a gas station, or a store \u2014 and it happened because the property lacked working locks or gates, adequate lighting, security cameras, or guards.<\/p>\n<p>A landlord who ignores a broken stairwell can be responsible for a fall. In the same way, a property owner who ignores known crime risks can be responsible for harm from an attack. Stat. \u00a7768.0755<\/a> requires the injured person to prove the business had <strong>actual or constructive knowledge<\/strong> of the hazard and should have fixed it. Constructive knowledge can be shown by how long the condition existed or that it happened regularly. No one can tell you whether a claim exists \u2014 or what it is worth \u2014 until a lawyer looks at what really happened.
