These changes don’t always appear on a standard scan. A CT scan or MRI can miss tiny damage. That damage includes torn and stretched nerve fibers. Doctors sometimes call this diffuse axonal injury. It changes how someone thinks, feels, and functions every day.

The CDC explains that a TBI can affect many things. It can change thinking (memory and reasoning). It can also change sensation, language, and emotion. Emotional changes include personality shifts and depression. These are exactly the changes that leave no visible mark.

This creates a real problem after an accident. Insurance companies and defense lawyers may argue the person “looks fine.” They may say the person is exaggerating. With no visible wound, they treat the injury as minor or made up.

That is where neuropsychological testing comes in. It measures brain function in a clear, repeatable way. In the catastrophic-injury cases our attorneys handle, this testing is often the clearest proof. It shows, in an objective way, that the injury is real and life-altering.

What neuropsychological testing actually is

Neuropsychological testing is a battery (a set) of standard tests. They measure how the brain performs across specific skills. The tests show where the brain works normally and where it struggles.

The evaluation looks at several areas, called domains. These terms come up in reports and depositions. Here is what each one means in plain language:

Memory — recalling new information (a list you just heard) and past events

Attention and concentration — staying focused without drifting off

Processing speed — how fast the brain takes in and responds to information. Think of how quickly you can copy symbols or answer a question. After a TBI this often slows down. The person may feel “a step behind.”

Executive function — the brain’s “manager.” This covers planning, organizing, switching tasks, and controlling impulses. Damage here is why someone may start a task and never finish it, or blurt things out.

Language — finding words and understanding others

Visual-spatial skills — judging space, shapes, and directions

Motor skills — coordination and hand movement

Emotional and behavioral functioning — mood, anxiety, irritability, and personality changes

Here is the key point. This testing measures function and change over time. It does not replace imaging like MRI, CT, or DTI. DTI stands for diffusion tensor imaging. It is a special MRI. It maps the brain’s white-matter nerve pathways. It can reveal tiny damage a routine scan misses. Instead, testing works alongside those scans. Together they show how the injury affects real life.

This is different from the quick check done in an emergency room. An ER might use the Glasgow Coma Scale. That is a 3-to-15 score of eye, verbal, and motor response. It shows how alert someone is. A full neuropsychological evaluation goes much deeper. It takes hours of detailed measurement, not a quick bedside check.

Who performs the testing and why their qualifications matter

A licensed clinical neuropsychologist performs the testing. This is a doctoral-level psychologist (PhD or PsyD). They have special training in how the brain affects behavior.

That training matters. A neuropsychologist is not the same as a neurologist or neurosurgeon. Those doctors focus on the physical brain and nervous system. A neuropsychologist is also different from a general psychologist. A general psychologist may treat mental health. But they aren’t trained to give and read this kind of cognitive testing. Some neuropsychologists are board-certified through the American Board of Professional Psychology (ABPP). That credential is worth asking about.

The examiner’s credentials make the findings more reliable. A qualified neuropsychologist uses proven, standard tests. So the results carry more weight. “Standardized” means the test was given to large groups of people first. So one person’s score can be compared against known normative data. That is the average range for people of similar age and education.

This reliability matters later. A defense expert will look for any weakness in the testing. Solid credentials and proven test tools make the findings much harder to dismiss.

Have questions about what happened?

Ask our team directly. Then it moves into several hours of testing. Expect it to be thorough and, honestly, tiring.

First, the neuropsychologist gathers history. This includes medical records, school records, and work history. It helps set a baseline. A baseline is a picture of how the person functioned before the injury. Comparing before and after is central to proving change.

Next comes the testing itself. There are paper-and-pencil tasks and computer-based tasks. Some cover memory. Others measure speed or problem-solving. A full evaluation can take several hours. It may be split across more than one session.

Good evaluations build in validity measures. These are also called effort or performance-validity tests. They check whether the person is giving steady, genuine effort. This directly answers the defense claim that someone is faking or exaggerating. When effort measures pass, the results are far stronger.

The neuropsychologist may also ask family or caregivers about daily changes. A spouse might notice the person now forgets appointments or loses their temper easily. That input adds real-world context that scores alone can’t capture.

Good examiners plan for fatigue and pain. A person with a catastrophic injury may need breaks. Skilled clinicians plan for this. So the results reflect true ability, not exhaustion.

How the results become evidence in a claim

The results become evidence when the neuropsychologist writes a report. The report documents the deficits (the areas of loss). It notes how severe they are and their likely link to the injury. It turns test scores into a clear story.

Here is how it works. Scores are compared to normative data — the average range for similar people. Where possible, they are also compared to the person’s estimated pre-injury baseline. Say a former engineer now scores far below expected on memory and reasoning. That decline is measurable, not guesswork.

A strong report supports several kinds of damages:

Future care needs — therapy, supervision, or support the person will need. These are often summarized in a life-care plan.

Lost earning capacity — the reduced ability to work and earn

Reduced quality of life — the daily impact on relationships and independence

The neuropsychologist may also serve as an expert witness. This means explaining the findings in plain terms to a judge or jury. In federal court and many state courts, expert testimony must meet reliability standards. This is the Daubert standard, from Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579. That is another reason proven tests and qualified examiners matter.

Testing over time can also document permanence. That is proof the injury is lasting. This is a key factor in catastrophic, life-altering injury claims. If deficits remain after months or years, the evidence shows the injury isn’t going away. Learn more in our guide to catastrophic injury claims.

Timing, repeat testing, and documenting a permanent injury

Early baseline testing is often valuable. It is done once the person is medically stable. It captures the injury’s effects soon after the accident. Then later tests can measure change.

Repeat evaluations tell an important story. They show whether deficits are improving, leveling off (plateauing), or staying permanent. That pattern helps counter the argument that the injury was minor or fully healed.

Consistency is powerful. Several evaluations may point the same way over time. Then it’s hard to claim the person recovered. This is why two things matter so much. First, coordinate testing with the treating care team. Second, save all records.

Timing also matters for legal deadlines. In Florida, some negligence claims arose on or after March 24, 2023. For those, the general deadline to file a lawsuit is two years under Fla. Stat. §95.11. Florida also follows a modified comparative-negligence rule under Fla. Stat. §768.81. Under this rule, someone found more than 50% at fault generally can’t recover damages. Because deadlines apply, don’t wait to get advice.

When a brain injury is fatal or profoundly disabling

Some families face the most catastrophic outcomes. For them, the evidence comes from medical records and treating providers. A death is the most catastrophic outcome there is. The evidence looks different than a living person’s testing.

Sometimes a loved one cannot be tested. This happens because they died or are profoundly disabled. Then the record of impairment comes from other sources. These include hospital records, treating doctors’ notes, and imaging. It also includes the documented decline before death. Family observations of daily struggles matter too.

A family may pursue a wrongful-death or catastrophic-injury claim. They can gather this evidence with legal help. A lawyer can request records, work with treating providers, and preserve the medical timeline. The focus stays on the family — on their dignity, their loss, and what they can do next.

Want to know where you stand?

Tell us what happened and our team will walk you through the options available to you, at no cost.

Get a free review

Get a free review

How a catastrophic-injury lawyer helps build the medical evidence

A catastrophic-injury lawyer coordinates qualified experts. The lawyer also connects the medical proof to the legal parts of a claim. Strong medical evidence and strong legal strategy work together.

In practice, that means several things. The lawyer helps ensure testing is done properly. That means qualified professionals using standard tools. It also means gathering records, working with treating providers, and organizing the timeline. Then the lawyer connects that documentation to the legal elements. They prove the injury, its cause, and its lasting effect.

Our firm is Florida-based and handles catastrophic-injury cases nationwide.
