The real question is narrower: did the owner fail to fix or warn about a danger they knew about \u2014 or should have known about?<\/p>\n<p>Florida law asks what a <em>reasonable<\/em> property owner should have done. It does not ask only whether an accident happened. Stat. \u00a7768.0755<\/a>, you generally must show either that the condition existed long enough that the business should have caught it, or that it occurred regularly enough to be foreseeable.<\/p>\n<p>Falls that cause catastrophic harm include:<\/p>\n<ul>\n<li>Falls from height, such as a collapsing balcony railing<\/li>\n<li>Falls down poorly maintained or unlit stairs<\/li>\n<li>Heavy objects falling from shelves or overhead<\/li>\n<li>A structure or floor that gives way<\/li>\n<\/ul>\n<p>A single fall can cause a spinal cord injury or a serious brain injury. The <a href=\"https:\/\/www.mayoclinic.org\/diseases-conditions\/spinal-cord-injury\/symptoms-causes\/syc-20377890\">Mayo Clinic<\/a> lists falls among the leading causes of spinal cord injury; higher, neck-level injuries can affect the arms, trunk, and legs.<\/p>\n<h3>How liability for a serious fall is proved<\/h3>\n<p>To hold an owner responsible, you generally have to prove four things:<\/p>\n<ol>\n<li>A dangerous condition existed on the property.<\/li>\n<li>The owner knew about it \u2014 or should have known.<\/li>\n<li>The owner failed to fix it or warn you.<\/li>\n<li>That failure caused your injury.<\/li>\n<\/ol>\n<p>Point 4 is where serious cases are won or lost. Many involve permanent loss of movement or feeling.<\/p>\n<p>Florida uses a <strong>modified comparative-fault<\/strong> system, so fault can be shared. Under <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.81.html\">Fla. Stat. \u00a7768.81<\/a>, amended in March 2023, if you are found <em>more than 50%<\/em> at fault for your own injury, you generally cannot recover damages at all. Below that line, your recovery is reduced by your share of fault, dollar for dollar. Florida courts often look at whether similar crimes happened at or near the property before, which is why police reports and prior-incident records are so important.
